【摘要】：高校法人治理來(lái)自于高校法人地位的確立,高校法人化是大學(xué)制度的重要的改革。法人就意味著人格獨(dú)立、組織自治。明確的高校法人化地位確認(rèn)了高校治理結(jié)構(gòu)的形成,因而高校的治理結(jié)構(gòu)又被稱為高校法人治理結(jié)構(gòu)。由于中國(guó)特殊的國(guó)情環(huán)境,決定了中國(guó)高校法人治理結(jié)構(gòu)的構(gòu)建,不是單面的高校自身的結(jié)構(gòu)構(gòu)建,而是應(yīng)該采取由政府引導(dǎo)下的高校法人治理結(jié)構(gòu)的構(gòu)建。 大學(xué)治理是指大學(xué)內(nèi)外利益相關(guān)者參與大學(xué)重大事務(wù)決策的過(guò)程,包括治理結(jié)構(gòu)和治理過(guò)程兩個(gè)方面。治理結(jié)構(gòu)是一種基本的制度安排,具有可觀察性和可控制性。本文旨在通過(guò)探討高校法人治理結(jié)構(gòu)、進(jìn)而豐富和完善我國(guó)高校在政府引導(dǎo)下如何構(gòu)建的相關(guān)理論,進(jìn)而指導(dǎo)實(shí)踐。通過(guò)政府與高校的治理關(guān)系分析,總結(jié)出我國(guó)的高校應(yīng)該是在政府的引導(dǎo)下進(jìn)行改革、構(gòu)建。以此指導(dǎo)大學(xué)管理的實(shí)踐和領(lǐng)導(dǎo)大學(xué)體制的改革。研究中攝入了管理學(xué)、經(jīng)濟(jì)學(xué)等學(xué)科內(nèi)容,以更好地闡述政府引導(dǎo)下的高校法人治理結(jié)構(gòu)的構(gòu)建。同時(shí)在分析具體關(guān)系的界定中,用到了比較分析法以解釋相關(guān)概念。 政府引導(dǎo)下高校法人治理結(jié)構(gòu)的構(gòu)建,是建立現(xiàn)代大學(xué)制度的重要內(nèi)容之一,是現(xiàn)代大學(xué)制度形成和完善的根基和保障�，F(xiàn)代的大學(xué)制度建立將是整個(gè)世界高校發(fā)展的重要趨勢(shì)和潮流,根據(jù)各國(guó)的大學(xué)環(huán)境的不同,采取了不同的治理結(jié)構(gòu)模式。為了我國(guó)現(xiàn)代大學(xué)制度的建立,更好的為社會(huì)主義的現(xiàn)代化服務(wù),培養(yǎng)社會(huì)主義事業(yè)的建設(shè)者和接班人,那么建立適合我國(guó)高校法人治理結(jié)構(gòu)則顯得至關(guān)重要,進(jìn)而需要建立在政府引導(dǎo)下的高校法人治理結(jié)構(gòu)框架。
[Abstract]:The governance of university legal person comes from the establishment of the status of university legal person, and the legalization of university is an important reform of university system. Legal person means personality independence and organizational autonomy. The clear status of legalization in colleges and universities confirms the formation of the governance structure of colleges and universities, so the governance structure of colleges and universities is also called the governance structure of legal persons in colleges and universities. Because of the special national conditions of China, it is decided that the construction of the corporate governance structure of Chinese colleges and universities is not the one-sided construction of the university's own structure, but the construction of the university's corporate governance structure under the guidance of the government. University governance refers to the process in which the stakeholders inside and outside the university participate in the decision-making of the major affairs of the university, including the governance structure and the governance process. Governance structure is a basic institutional arrangement with observability and controllability. The purpose of this paper is to explore the structure of corporate governance in colleges and universities so as to enrich and improve the relevant theories on how to construct universities under the guidance of the government and to guide the practice. Based on the analysis of the relationship between the government and the universities, it is concluded that the colleges and universities in our country should be reformed and constructed under the guidance of the government. In order to guide the practice of university management and lead the reform of the university system. In order to better explain the construction of the corporate governance structure under the guidance of the government, the contents of management, economics and other subjects have been absorbed in the study. At the same time, in the analysis of the definition of specific relationships, comparative analysis is used to explain the related concepts. The construction of corporate governance structure under the guidance of the government is one of the important contents of establishing the modern university system and the foundation and guarantee of the formation and perfection of the modern university system. The establishment of modern university system will be an important trend and trend of the development of universities all over the world. According to the different university environment in different countries, different governance structure models have been adopted. In order to establish the modern university system of our country, to serve the socialist modernization better, to train the constructors and successors of the socialist cause, it is very important to set up the corporate governance structure suitable for our country's universities and colleges. Furthermore, it is necessary to establish the framework of corporate governance under the guidance of the government.
