高校突發(fā)事件行政問責(zé)制研究

【摘要】:高校作為社會(huì)的一個(gè)細(xì)胞,是整個(gè)社會(huì)極為重要的組成部分,擔(dān)負(fù)著為社會(huì)主義現(xiàn)代化事業(yè)培養(yǎng)高層次人才,大力發(fā)展先進(jìn)科學(xué)技術(shù)和繁榮發(fā)展先進(jìn)文化的重任,在實(shí)現(xiàn)民族偉大復(fù)興的征程中其地位越來越重要,責(zé)任也越來越重大。然而近年來,我國高校校園中多次發(fā)生影響學(xué)校正常運(yùn)轉(zhuǎn),造成校園動(dòng)蕩的突發(fā)危機(jī)事件,這些突發(fā)事件對(duì)高校造成破壞性的影響,它給高校帶來巨大的財(cái)物損失甚至人員傷亡。對(duì)于突發(fā)事件的研究、管理已成為擺在高校行政管理者面前不得不面對(duì)的課題。因此針對(duì)高校突發(fā)事件的行政問責(zé)也越來越多地出現(xiàn)在人們的視野中。高校突發(fā)事件行政問責(zé)制的建立與加強(qiáng)高校工作人員處理突發(fā)事件的能力并提高他們應(yīng)對(duì)的責(zé)任意識(shí),對(duì)保障高校安全、健康、和諧發(fā)展有著重要的意義。高校突發(fā)事件行政問責(zé)制是學(xué)校突發(fā)事件管理的重要組成部分,也是確保校園穩(wěn)定的基礎(chǔ)。 本文采用的研究方法主要有文獻(xiàn)檢索法、案例研究法、比較研究法和訪談?wù){(diào)查法。全文共分為四個(gè)部分: 第一部分,引言。主要闡明本文選題的緣由和目的、研究內(nèi)容和研究意義,指明本文的研究思路與研究方法。 第二部分,主要對(duì)高校突發(fā)事件行政問責(zé)制的概念及理論進(jìn)行分析與探討。首先探討了高校突發(fā)事件的概念及特征,對(duì)高校突發(fā)事件的概念和特征進(jìn)行了分析。其次,明晰了行政問責(zé)制的定義及屬性。第三,對(duì)高校突發(fā)事件行政問責(zé)制的內(nèi)涵進(jìn)行了分析,最后探討了高校突發(fā)事件行政問責(zé)制的理論基礎(chǔ)。 第三部分,高校突發(fā)事件行政問責(zé)制建設(shè)的必要性與現(xiàn)實(shí)困境分析。首先對(duì)高校突發(fā)事件行政問責(zé)制的必要性進(jìn)行了分析,從高校突發(fā)事件的凸顯,依法治校的精神和科學(xué)行政管理以及責(zé)任高校等四個(gè)方面進(jìn)行闡述。其次,分析了高校突發(fā)事件行政問責(zé)制的現(xiàn)實(shí)困境,分別剖析了高校突發(fā)事件中問責(zé)理念意識(shí)上的障礙、配套的法律機(jī)制不健全和問責(zé)中的制度缺失等方面。最后對(duì)英國和美國的高校突發(fā)事件行政問責(zé)制進(jìn)行分析,提出對(duì)我國高校的相關(guān)啟示與借鑒。 第四部分,高校突發(fā)事件行政問責(zé)制的原則與架構(gòu)。首先對(duì)高校突發(fā)事件行政問責(zé)制體系的基本原則做出了分析。其次,對(duì)高校突發(fā)事件行政問責(zé)制的基本架構(gòu)進(jìn)行了分析。最后,針對(duì)高校突發(fā)事件行政問責(zé)制的實(shí)施與運(yùn)行,提出建立并完善與高校突發(fā)事件行政問責(zé)制相配套的理念、法律和制度。
[Abstract]:As a cell of the society, colleges and universities are an extremely important part of the whole society, shouldering the important task of cultivating high-level talents for the cause of socialist modernization, vigorously developing advanced science and technology and prospering and developing advanced culture. In the course of the great rejuvenation of the nation, its status is becoming more and more important, and its responsibility is becoming more and more important. However, in recent years, there have been a number of unexpected crises that have affected the normal operation of the university and caused the campus turbulence in our country. These emergencies have a destructive impact on the colleges and universities. It brings huge property losses and even casualties to colleges and universities. For the research of unexpected events, management has become a subject that university administrators have to face. Therefore, administrative accountability for unexpected events in colleges and universities appears more and more in people's vision. It is of great significance to establish the administrative accountability system for university emergencies and to strengthen the ability of university staff to deal with emergencies and improve their sense of responsibility to ensure the safety, health and harmonious development of colleges and universities. The administrative accountability system of university emergency is an important part of school emergency management and the basis of ensuring campus stability. The main research methods used in this paper are literature retrieval, case study, comparative research and interview investigation. The full text is divided into four parts: the first part, introduction. This paper mainly expounds the reason and purpose, the content and significance of the research, and points out the research ideas and methods. The second part mainly analyzes and discusses the concept and theory of the administrative accountability system of university emergencies. Firstly, the concept and characteristics of university emergencies are discussed, and the concepts and characteristics of university emergencies are analyzed. Secondly, it clarifies the definition and attribute of administrative accountability system. Thirdly, the connotation of the administrative accountability system for university emergencies is analyzed, and the theoretical basis of the administrative accountability system for emergencies in colleges and universities is discussed. The third part, the necessity and the realistic predicament analysis of the university emergency administrative accountability system construction. Firstly, this paper analyzes the necessity of the administrative accountability system for university emergencies, and expounds the following four aspects: the prominence of university emergencies, the spirit and scientific administration of running a university according to law, and the responsible universities. Secondly, this paper analyzes the realistic dilemma of the administrative accountability system of university emergencies, analyzes the obstacles in the concept of accountability, the imperfect legal mechanism and the lack of the system in the emergency. Finally, this paper analyzes the administrative accountability system of university emergencies in the United Kingdom and the United States, and puts forward the enlightenment and reference to the universities in our country. The fourth part, the principle and structure of administrative accountability system of university emergency. First of all, the basic principles of the administrative accountability system of university emergencies are analyzed. Secondly, it analyzes the basic structure of the administrative accountability system of university emergencies. Finally, aiming at the implementation and operation of the administrative accountability system for emergencies in colleges and universities, this paper puts forward the idea, law and system of establishing and perfecting the administrative accountability system for emergencies in colleges and universities.
