【摘要】:隨著高等教育體制改革的深入推進(jìn),我國公立高校辦學(xué)自主權(quán)逐步得到落實(shí),在當(dāng)前完善我國公立高校董事會(huì)制度具有十分重要的意義。 本文將運(yùn)用利益相關(guān)者理論、委托代理理論等系統(tǒng)分析建立公立高校董事會(huì)的必要性和現(xiàn)存問題,并在合理借鑒西方高校董事會(huì)治理經(jīng)驗(yàn)的基礎(chǔ)上,提出完善我國公立高校董事會(huì)制度的政策建議。 目前我國公立高校董事會(huì)制度還存在一些不容忽視的問題,主要是:董事會(huì)成員構(gòu)成相對(duì)單一,忽視利益相關(guān)者權(quán)益;對(duì)學(xué)校缺乏有效監(jiān)督,未能有效解決“代理入”問題:法律地位不明確,體系不完善。基于利益相關(guān)者理論和我國的現(xiàn)行領(lǐng)導(dǎo)體制,我們認(rèn)為應(yīng)當(dāng)把我國公立高校董事會(huì)的性質(zhì)確定為一種準(zhǔn)決策機(jī)構(gòu),擁有重大決策審議權(quán),對(duì)高校辦學(xué)方針、教學(xué)、科研、基建、財(cái)務(wù)等重大問題進(jìn)行指導(dǎo)和審議;在保證實(shí)現(xiàn)各方利益相關(guān)者權(quán)益的前提下,董事會(huì)負(fù)責(zé)對(duì)相關(guān)決議進(jìn)行討論,決定是否通過并提交黨委最終審議。公立高校董事會(huì)成員應(yīng)包括學(xué)校主要領(lǐng)導(dǎo)、教師代表、學(xué)生代表、政府、校友、社區(qū)公正人士、捐資人等高校利益相關(guān)者,黨委書記擔(dān)任學(xué)校董事會(huì)主席。我國公立高校董事會(huì)制度還需進(jìn)一步完善:明確我國公立高校董事會(huì)的性質(zhì)、職責(zé)和人員構(gòu)成,健全我國公立高校董事會(huì)的組織制度與激勵(lì)約束機(jī)制,完善我國公立高校董事會(huì)政策環(huán)境和制度保障。
[Abstract]:With the deepening of the reform of higher education system, the autonomy of running schools of public universities in China has been gradually implemented, and it is of great significance to perfect the board of directors system of public universities in our country at present. This paper will use stakeholder theory, principal-agent theory and so on to analyze the necessity and existing problems of establishing the board of directors of public colleges and universities, and on the basis of the reasonable reference to the governing experience of the board of directors of western universities. Put forward the policy suggestion of perfecting the board of directors system of our country public university. At present, there are still some problems that can not be ignored in the system of board of directors of public colleges and universities in our country. The main problems are: the composition of board of directors is relatively single, the rights and interests of stakeholders are ignored; Failed to effectively solve the problem of "agent in": the legal status is not clear, the system is not perfect. Based on the stakeholder theory and the current leadership system in China, we believe that the nature of the board of directors of public colleges and universities in China should be defined as a quasi-decision-making body, with major decision-making and deliberation power, and with regard to the policies, teaching, scientific research and infrastructure construction of colleges and universities. On the premise of ensuring the realization of the rights and interests of all stakeholders, the board of directors is responsible for discussing the relevant resolutions, deciding whether to adopt them and submitting them to the party committee for final consideration. The members of the board of directors of public colleges and universities should include the main leaders of the school, teachers' representatives, student representatives, government, alumni, community justice persons, donors and other university stakeholders. The Party secretary shall serve as the chairman of the board of directors of the school. The system of the board of directors of public colleges and universities in our country needs to be further consummated. Perfect the policy environment and system guarantee of the board of directors of public colleges and universities in our country.
