【摘要】：政府與大學關系問題一直是困擾我國和世界各國高等教育發(fā)展的難題,從我國的實際來看,受我國政治經(jīng)濟體制、歷史文化傳統(tǒng)等因素的影響,我國政府將大學視為自己的附屬機構(gòu),對大學的管理是干預過多,控制過強,大學自主權缺乏,從而影響了大學學術事業(yè)的發(fā)展。而政府放權的結(jié)果,則是一放就亂。因此,如何處理和協(xié)調(diào)我國政府與大學的關系是我國高等教育事業(yè)發(fā)展亟待解決的問題。何以解憂?專家、學者各述己見,提出眾多解題之道。本文以已有研究為基礎,借鑒有益經(jīng)驗,從信任的視角,審視我國政府和大學關系之癥結(jié),分析影響我國政府和大學信任的制度因素,并提出建立基于制度的我國政府和大學信任的對策,以實現(xiàn)我國政府與大學關系的和諧發(fā)展。 信任作為一種以主體間性為基礎,雙向互動為特征的關系,作為一種減少不確定性,降低成本,維護社會秩序,促進合作的機制,為構(gòu)建和諧的政府與大學關系提供了一種新思路。而從政府與大學關系的實際看,政府與大學關系本身也包含著信任問題,表現(xiàn)在：首先,大學自治是大學悠久的傳統(tǒng)之一,也是大學立足之本,而政府的信任是大學獲得自治權的前提；其次,政府和大學作為利益相關者,其權力博弈的最好選擇是合作,而信任是政府和大學合作的前提。最后,和諧有序的政府與大學關系是雙方的訴求,而信任具有維護政府與大學秩序的功能。因此,用信任理論研究政府與大學關系問題具有非常重要的現(xiàn)實意義。 我國政府和大學信任狀況及導致的后果,是本研究的前提和現(xiàn)實基礎。政府和大學信任是組織間信任,是彼此相信對方在相關活動中,不會做有損自己利益的行為的信心。政府和大學信任是以主體間性為基礎,雙方相互尊重,真誠相待,以實現(xiàn)雙方利益的最大化為目的,以制度為保障。以此為基礎,論文以政策法規(guī)文本為參照物,對新中國成立至今,我國政府與大學關系的演變進行了回顧。從歷史的追溯中可以看出,我國政府和大學信任存在政府干預過多,大學學術自主權缺乏,社會力量缺失等問題。這些問題導致政府管理成本高,社會監(jiān)督力量薄弱,大學運行規(guī)范性差等嚴重后果,從而影響了我國政府與大學之間的和諧。 縱觀我國政府與大學關系之現(xiàn)狀,導致我國政府和大學信任度不高的制度根源有三：其一,由于我國大學法律地位模糊,既導致大學權責含糊、混亂,大學與政府關系定位不清,也導致大學在司法實踐中行政法律關系和民事法律關系的混淆,使政府難以信任大學。其二,由于我國現(xiàn)有立法對政府和大學權責規(guī)定的模糊,導致政府越權,大學缺乏應有的自主權,而權力與責任是對等的,大學因無權而不愿承擔責任,致使大學的行為讓政府難以信任,政府集權而不愿放權。其三,大學作為被信任方,能否很好地履行責任,實現(xiàn)公共利益和政府的目標,還必須要有完善的監(jiān)督機制,而我國目前監(jiān)督大學行為的機制卻存在法理依據(jù)不足、同體監(jiān)督不力、異體監(jiān)督虛置等問題,使政府對大學的行為沒有信心而不愿給予信任。 何以解題?從理論上構(gòu)建我國政府和大學和諧的信任機制,是本研究價值訴求實現(xiàn)的關鍵。從應然的維度看,理解和合作是和諧的政府和大學關系的重要特征,而信任是達成理解和合作的重要前提和有效途徑。因此,論文對我國政府和大學和諧的信任機制進行理論建構(gòu)。主要從健全有效的法律規(guī)范體系是政府和大學信任機制的基石,權責清晰、統(tǒng)一是政府和大學信任機制的核心,完善的問責制是政府和大學信任機制的保障三方面,構(gòu)建三位一體的理論框架。 對癥下藥,提出我國政府和大學和諧之路的具體對策,是本研究的價值所在。本文最后一章以三位一體的信任機制理論框架為基礎,針對我國政府與大學關系存在的問題,提出建立政府和大學和諧的對策。首先要確立大學的公務法人地位,明晰大學與政府的法律關系,為厘清政府和大學的權責奠定基礎,也是政府和大學信任建立的前提；其次,主要從明確政府和大學的權責,以及推進大學章程建設兩方面完善高等教育法律法規(guī),厘清政府和大學權責邊界,是實現(xiàn)政府和大學信任的關鍵。最后,建立高校社會問責制,保障政府權益的實現(xiàn),是建立政府和大學信任,實現(xiàn)政府和大學和諧的制度保障。
[Abstract]:The relationship between the government and the university has been a difficult problem which has troubled the development of higher education in our country and the world . From the practical point of view of our country , the government regards university as its subsidiary organ , which has influenced the development of university academic career .

As a mechanism to reduce uncertainty , reduce costs , maintain social order and promote cooperation , trust is a mechanism to reduce uncertainty , reduce costs , maintain social order and promote cooperation .
Secondly , government and university as stakeholders , the best choice of power game is cooperation , and trust is the premise of cooperation between government and university . Finally , harmonious and orderly government and university relationship are the demands of both parties , and trust has the function of maintaining government and university order . Therefore , it is of great practical significance to study the relationship between government and university with trust theory .
