大學章程內(nèi)容要素研究

【摘要】:《國家中長期教育改革和發(fā)展規(guī)劃綱要(2010-2020年)》第十三章明確指出“加強章程建設(shè)”,同年,國務(wù)院確定以北京大學、北京師范大學等26所高校為試點,推動建立健全大學章程。2011年11月,教育部以第31號令的形式頒布了《高等學校章程制定暫行辦法》,2012年1月,教育部決定“2012年推動所有高校全面啟動章程制定或修訂工作,實現(xiàn)‘政校分開’”。制定大學章程成為中國高校面臨的重要任務(wù);诖,希冀為中國大學章程制定切實可行的章程提供可資借鑒的依據(jù)。 遵循“問題提出——文獻分析——構(gòu)建分析框架——分類研究——基本結(jié)論——政策建議”歸納式思維線路,按照理想類型法,將大學章程分為盎格魯—撒克遜傳統(tǒng)大學章程和羅馬傳統(tǒng)大學章程。通過大學章程的學術(shù)史考察與典型舉要,分別描述了美國、英國、法國、德國、日本和中國大學章程的歷史流變與內(nèi)容構(gòu)成。盎格魯—撒克遜傳統(tǒng)大學章程的內(nèi)容特性是:第一,規(guī)定學校辦學目的、發(fā)展目標與主要任務(wù);第二,社會參與的發(fā)展決策機制;第三,規(guī)定大學內(nèi)部管理體制和運行機制;第四,規(guī)定大學與政府的關(guān)系;第五,規(guī)定章程的修改主體和程序。羅馬傳統(tǒng)大學章程的內(nèi)容特性是:第一,規(guī)定政府參與大學治理的優(yōu)先權(quán);第二,規(guī)定大學最高權(quán)力機構(gòu)的運行程序;第三,大學理念、使命的闡述;第四,規(guī)定章程的制定、修改主體與程序。 歸納總結(jié),現(xiàn)代大學章程的基本內(nèi)容包括:第一,確定大學目標,闡述大學使命;第二,大學的組織機構(gòu)和管理體制;第三,大學的財務(wù)、經(jīng)費管理;第四,大學教職員工的權(quán)利與義務(wù);第五,學生的權(quán)利與義務(wù);第六,章程的制定、生效與修改。 “他山之石,可以攻玉”。我國近期制定的大學章程與境外大學章程在內(nèi)容上存在差異,主要表現(xiàn)在:第一,董事會(理事會)領(lǐng)導下的校長負責制;第二教授治校與學術(shù)自由;第三,內(nèi)容安排上差異較大。我國大學章程內(nèi)容上存在的主要問題是:第一,大學法律地位以及大學與政府、大學與社會的關(guān)系尚不明確;第二,內(nèi)容過于關(guān)注原則,對細節(jié)規(guī)定不足;第三,文字表述不夠規(guī)范。因此,基于中國大學制定的章程既要體現(xiàn)“中國特色”更要遵循“世界通則”的原則,結(jié)合立法以及其他類型章程的制定慣例,提出我國大學章程內(nèi)容的建議。序言部分應(yīng)該包括:1.大學的歷史及建設(shè)成就;2.大學的使命和大學的理想;3.制定大學章程的緣由?倓t部分應(yīng)包括:1.學校名稱、校址;2.辦學宗旨。正文部分應(yīng)包括:1.學校標志;2.黨委和行政之間的職權(quán);3.校、院管理體制;4.教授治學、學術(shù)機構(gòu)的職權(quán);5.教職員工和學生的權(quán)利;6.財務(wù)制度;7.師生社會服務(wù)與外部關(guān)系;8.校友參與。附則部分應(yīng)包括:1.章程的核準生效及修改;2.章程的解釋權(quán)。
[Abstract]:Chapter 13 of the National Medium- and Long-Term Education Reform and Development Program (2010-2020) clearly pointed out that "strengthening the construction of the articles of association". Promoting the establishment and improvement of the university charter. Based on this, we hope to provide a reference basis for the establishment of Chinese university charter. Following the generative thinking line of "problem proposition-literature analysis-construction of analytical framework-classification research-basic conclusions-policy recommendations", according to the ideal type method, The university charter is divided into Anglo-Saxon traditional university charter and Roman traditional university charter. Through the academic history of the university charter and the typical exposition, this paper describes the historical evolution and content constitution of the university charter of the United States, Britain, France, Germany, Japan and China respectively. The contents and characteristics of Anglo-Saxon traditional university charter are as follows: first, the purpose, development goal and main task of the school; second, the decision-making mechanism of social participation; third, the regulation of the internal management system and operation mechanism of the university; Fourth, regulate the relationship between the university and the government; fifthly, stipulate the subject and procedure of the amendment of the constitution. The characteristics of the constitution of the traditional university in Rome are as follows: first, the priority of government participation in university governance; second, the operation procedure of the university's supreme authority; third, the elaboration of the university's concept and mission; and fourth, the formulation of the statute.
