【摘要】：法律信仰是指基于社會(huì)主體通過對(duì)法律現(xiàn)象的感受而形成的內(nèi)心對(duì)法律價(jià)值的認(rèn)同,對(duì)法律的堅(jiān)定信念和尊重,是公眾自覺守法的升華。目前,我國社會(huì)主義法治建設(shè)取得了一系列的進(jìn)展,但仍存在各種問題和挑戰(zhàn),譬如公民法律信仰的缺失。在高校亦是如此,大學(xué)生擁有法律的基本知識(shí),認(rèn)識(shí)到法律的作用,但大部分學(xué)生只能是在感性上對(duì)法律制度有所了解,還不能上升到理性的高度。大多數(shù)學(xué)生能夠遵守法律和紀(jì)律,但不能把法律信仰當(dāng)做自己長期堅(jiān)守的信念。大學(xué)生是未來社會(huì)主義建設(shè)事業(yè)的主要力量和源泉,其法律意識(shí)的狀況將直接關(guān)系到社會(huì)主義法治建設(shè)的成效。當(dāng)前高校教育刻不容緩的責(zé)任和義務(wù)就是努力培養(yǎng)大學(xué)生的法律意識(shí)以及崇尚法律的情操,進(jìn)而加強(qiáng)他們法律信仰的培養(yǎng),提高他們的民主法制觀念。培育大學(xué)生法律信仰有助于培養(yǎng)大學(xué)生對(duì)法律的尊重和信任,促使他們變被迫守法為自愿守法,變強(qiáng)制守法為良心守法。本文從對(duì)大學(xué)生法律信仰的一般理論分析入手,首先闡明了法律信仰的內(nèi)涵,然后,全面地分析了當(dāng)前大學(xué)生法律信仰缺失的主要表現(xiàn),并著重從社會(huì)、學(xué)校和大學(xué)生自身方面對(duì)大學(xué)生法律信仰缺失的原因進(jìn)行了較為深入的分析。在此基礎(chǔ)上,有針對(duì)性地就如何加強(qiáng)大學(xué)生法律信仰的培養(yǎng)作了具體探討。文章從四個(gè)部分論述了大學(xué)生法律信仰的培養(yǎng)。第一部分首先介紹了法律信仰的概念；第二部分對(duì)大學(xué)生法律信仰現(xiàn)狀進(jìn)行調(diào)查分析；第三部分從傳統(tǒng)文化、社會(huì)、學(xué)校和大學(xué)生自身方面對(duì)大學(xué)生法律信仰缺失的原因進(jìn)行了較為深入的分析；進(jìn)而,文章最后指出了高等法學(xué)教育培養(yǎng)法律信仰的根本途徑在于學(xué)生的法律實(shí)踐,并在此基礎(chǔ)上提出了培養(yǎng)法律信仰的教學(xué)方法和實(shí)踐的基本設(shè)想。
[Abstract]:The legal faith is the formation of the community through the subject of legal phenomena based on the identity of the inner feelings of the legal value, belief in law and respect, is the sublimation of the public consciously abide by the law. At present, the construction of socialist rule of law in China has made a series of progress, but there are still various problems and challenges, such as the lack of civil law faith. So it is in the University, students have a basic knowledge of the law, to realize the function of the law, but most students can only be an understanding of the legal system in the emotional is not up to the rational level. Most students can abide by the law and discipline, but not the law of faith as their long held beliefs. College students are the main source of strength and the future of socialist construction, the legal awareness of the situation will be directly related to the effectiveness of the socialist law construction. When the University Education urgent responsibility and obligation is to cultivate the students' legal consciousness and advocate legal sentiment, and strengthen and cultivate their belief in law, improve their sense of democracy and legality. The cultivation of College Students' legal belief can help students cultivate the trust and respect for the law, to encourage them to become law-abiding voluntarily abide by the law, law-abiding for conscience forced change abide by the law. This paper starts from the general theory on College Students' belief in the legal analysis, firstly expounds the connotation of legal belief, then, a comprehensive analysis of the performance of college students lack of legal belief, and emphatically from the social, legal reasons for College students' lack of faith schools and the students themselves are deeply analyzed. On the basis of, it has focused on how to strengthen the cultivation of students' legal belief specifically discussed. This paper discusses from four parts. The cultivation of College Students' belief in law. The first part introduces the concept of legal faith; the second part gives an analysis on the current situation of College Students' legal belief; the third part from the traditional culture, society, reasons for the lack of legal belief of college and university students themselves is analyzed; then, the essay points out the basic way of higher law education is the cultivation of legal belief in the legal practice of the students, and put forward the basic ideas of teaching methods and practice of cultivating the legal belief.
