【摘要】：教師懲戒權(quán)是實(shí)現(xiàn)教育目的的有效手段,其有一定的合理性。然而當(dāng)下教師懲戒權(quán)處于失落的狀態(tài):缺乏國(guó)家立法層面的保障、遭遇社會(huì)觀念意識(shí)的沖擊、缺乏教師的自我反思與確認(rèn)。為此我們必須對(duì)教師懲戒權(quán)的合理性、合法性進(jìn)行再確認(rèn),進(jìn)而從國(guó)家層面完善法律,賦予懲戒權(quán)以根本保障,社會(huì)層面創(chuàng)設(shè)環(huán)境,賦予懲戒權(quán)運(yùn)行的氛圍,教師自身轉(zhuǎn)變觀念,完成懲戒權(quán)的自我確認(rèn),以便實(shí)現(xiàn)教師懲戒權(quán)的理性回歸。
[Abstract]:Teachers' right to discipline is an effective means to achieve the purpose of education, and it has certain rationality. However, when the right to discipline of teachers is in a lost state: lack of national legislation level of protection, encounter the impact of social concepts and consciousness, lack of self-reflection and recognition of teachers. Therefore, we must reconfirm the rationality and legitimacy of teachers' disciplinary power, and then perfect the law from the national level, endow the disciplinary power with the fundamental guarantee, create the environment at the social level, and give the atmosphere of the operation of the disciplinary power. Teachers themselves change their ideas and complete the self-confirmation of disciplinary power so as to realize the rational return of teachers' disciplinary power.
