【摘要】：學(xué)校依法自主辦學(xué)意味著學(xué)校自主辦學(xué)的法律主體地位得以確認(rèn),學(xué)校在法律與制度框架下自主辦學(xué)權(quán)利的實(shí)現(xiàn),學(xué)校直接辦學(xué)責(zé)任、教育責(zé)任的落實(shí)。教育管辦評(píng)分離改革試點(diǎn)工作啟動(dòng)后,相關(guān)省市逐步推行清單管理,適時(shí)出臺(tái)地方教育法律規(guī)章,現(xiàn)代學(xué)校制度建設(shè)持續(xù)推進(jìn),學(xué)校內(nèi)部治理結(jié)構(gòu)不斷完善。但改革仍面臨挑戰(zhàn),須建立與完善基于學(xué)校章程的學(xué)校多元治理機(jī)制,保障學(xué)校權(quán)力的有效運(yùn)用,促進(jìn)學(xué)校自主發(fā)展;建立與完善多元參與的學(xué)校事務(wù)監(jiān)督、評(píng)價(jià)與問(wèn)責(zé)制度,加強(qiáng)學(xué)校依法自主辦學(xué)過(guò)程中的事中、事后監(jiān)管;建立與完善學(xué)校法律顧問(wèn)制度與法律救濟(jì)制度,支持與保障學(xué)校依法自主辦學(xué)權(quán)益。
[Abstract]:The independent running of school according to law means that the legal subject status of independent school running is confirmed. Under the framework of law and system, the realization of the right to run a school independently, the responsibility of running a school directly and the implementation of the responsibility of education. After the start of the reform, the relevant provinces and cities gradually carried out the list management, issued local education laws and regulations in good time, continued to promote the construction of modern school system, and the internal governance structure of the school was constantly improved. However, the reform is still facing challenges. It is necessary to establish and improve the school multi-governance mechanism based on the school constitution, to ensure the effective use of school power, to promote the independent development of the school, to establish and improve the multi-element school affairs supervision, evaluation and accountability system. In the process of school running according to law, we should strengthen the supervision afterwards, establish and perfect the system of school legal consultant and legal remedy, and support and guarantee the rights and interests of the school in accordance with the law.
