懲罰的倫理學辯護與教育建構(gòu)

【摘要】:懲罰是指對個人或集體所進行的合法戒責,旨在制止某種行為的發(fā)生。對于懲罰,當前主要存在三種視角的辯護;貓笳(應得論)認為懲罰可以矯正因過錯而導致的不平衡;結(jié)果論(功利主義理論)認為懲罰可以對犯有過錯的人及其他人形成威懾,使其學會為自己的行為負責;賠償論(補償受害者的理論)則認為只有懲罰可以有助于賠償受害人,實現(xiàn)公正。三種理論的分析都能某種程度上為懲罰辯護,但均存在一定的局限和弊端。在當前的學校語境中,教育者應該在尊重學生人格的基礎(chǔ)上,綜合考慮三種觀點,追求懲罰的正當性和教育性。
[Abstract]:Punishment refers to the legal punishment of individuals or groups, aimed at stopping the occurrence of certain acts. For punishment, there are three main perspectives of defense. According to the theory of retribution, punishment can correct the imbalance caused by fault, and the theory of result (utilitarianism) holds that punishment can act as a deterrent to the wrongdoer and others, and make them learn to be responsible for their own actions. The theory of compensation (the theory of compensating victims) that only punishment can help to compensate victims and achieve justice. The analysis of the three theories can defend punishment to some extent, but there are some limitations and drawbacks. In the current school context, educators should consider three views comprehensively on the basis of respecting students' personality and pursue the legitimacy and education of punishment.
