未成年人犯罪預(yù)防的德育對策研究

【摘要】:未成年人犯罪是衡量未成年人道德行為的標(biāo)準(zhǔn)。2008年以來,我國未成年人犯罪人數(shù)呈逐年下降趨勢,反映了我國未成年人道德素質(zhì)穩(wěn)步上升。但近幾年校園暴力頻發(fā)的事實也警醒我們未成年人的道德狀況遠沒有我們想象的美好。德育是有效地提高未成年人道德素質(zhì)的方式。本文以教育學(xué)理論為基礎(chǔ),借鑒犯罪學(xué)、法學(xué)、倫理學(xué)等學(xué)科知識,對未成年人犯罪、德育的概念進行了界定,分析了未成年人犯罪的特點和德育的功能,分析了德育介入未成年人犯罪的必要性與可能性,找出了當(dāng)前德育存在的問題及其原因,提出了未成年人犯罪預(yù)防的德育對策。本文除緒論外由四章組成。緒論主要介紹了研究背景、目的和意義,以及研究的思路和方法,述評了國內(nèi)外研究現(xiàn)狀及發(fā)展趨勢。第一章未成年人犯罪預(yù)防的德育對策概述。主要根據(jù)預(yù)防未成年人犯罪的目的界定了未成年人犯罪及德育的概念,分析了未成年人犯罪的特點和德育的功能。第二章德育介入未成年人犯罪預(yù)防的必要性與可能性。刑罰是有效的犯罪預(yù)防手段。但是犯罪的多因性決定了刑罰預(yù)防犯罪的有限性。此外,刑罰還可能導(dǎo)致多方面的消極效果,甚至引發(fā)新的犯罪。對未成年人犯罪來說,監(jiān)禁刑絕大多數(shù)都是短期監(jiān)禁,刑罰的弊端更為明顯。而且,由于未成年人身心發(fā)展的不成熟性,刑罰對未成年人消息作用還可能產(chǎn)生泛化的作用。所以,德育是刑罰之外的有效的未成年人犯罪預(yù)防手段。第三章未成年人德育的現(xiàn)狀。當(dāng)前我國未成年人德育取得了很大的成績,未成年人道德素質(zhì)不斷提高。但也存在著德育實效性不足、針對性不強的問題。這主要是由德育理念偏差、德育內(nèi)容陳舊、德育方法落后、道德環(huán)境的不良影響及家庭、學(xué)校、社會沒有形成合力所造成的。第四章未成年人犯罪預(yù)防的德育對策。通過德育預(yù)防未成年人犯罪必須加強未成年人德育。加強未成年人德育首先要轉(zhuǎn)變德育理念,樹立未成年人主體地位和以人為本的德育理念。同時,還有不斷豐富德育內(nèi)容、變革德育方法、優(yōu)化未成年人德育的家庭、學(xué)校和社會環(huán)境。此外,還要充分利用網(wǎng)絡(luò)技術(shù)實現(xiàn)家庭、學(xué)校、社會德育的良性互動。
[Abstract]:Juvenile delinquency is the standard to measure the moral behavior of minors. Since 2008, the number of juvenile delinquency in China has been decreasing year by year. It reflects the steady rise of the moral quality of the minors in our country. But the fact that the campus violence occurs frequently in recent years also reminds us that the moral condition of the minors is far less beautiful than we imagined. Moral education is an effective way to improve the morality of the minors. Based on pedagogy theory, Based on the knowledge of criminology, law and ethics, this paper defines the concepts of juvenile delinquency and moral education, and analyzes the characteristics of juvenile delinquency and the function of moral education. This paper analyzes on the necessity and possibility of moral education intervention in juvenile delinquency, and finds out the existing problems and causes of moral education. This article consists of four chapters except the introduction. The introduction mainly introduces the background, purpose and significance of the research, as well as the ideas and methods of the research. This paper reviews the current research situation and development trend at home and abroad. The first chapter summarizes the moral education countermeasures for the prevention of juvenile delinquency, mainly defines the concept of juvenile delinquency and moral education according to the purpose of preventing juvenile delinquency. This paper analyzes the characteristics of juvenile delinquency and the function of moral education. Chapter two: the necessity and possibility of moral education intervention in the prevention of juvenile delinquency. Punishment is an effective means of crime prevention. The limitation of crime prevention. Penalties can also lead to many negative effects, and even lead to new crimes. For juvenile delinquents, the vast majority of prison sentences are short-term imprisonment, and the disadvantages of the penalty are more obvious. Because of the immature nature of minors' physical and mental development, punishment may also have a generalized effect on the information of minors. Moral education is an effective means to prevent juvenile delinquency in addition to punishment. Chapter three is the present situation of moral education for minors. At present, great achievements have been made in the moral education of minors in our country. The moral quality of minors is constantly improved. However, there are also the problems of insufficient effectiveness and weak pertinence of moral education. This is mainly due to the deviation of moral education idea, the outmoded content of moral education, the backward moral education methods, the negative influence of moral environment and the influence of family and school. The moral education countermeasures of the prevention of juvenile delinquency in Chapter 4th. To prevent juvenile delinquency through moral education, we must strengthen the moral education of minors. In order to strengthen moral education of minors, it is necessary to change the concept of moral education in the first place. At the same time, we can enrich the content of moral education, reform the methods of moral education, optimize the family, school and social environment of moral education of minors. We should make full use of network technology to realize the positive interaction of family, school and social moral education.
