【摘要】：20世紀(jì)初期,清廷為彌補(bǔ)官府司法不足而在《商會(huì)簡(jiǎn)明章程》中正式賦予商會(huì)以商事公斷權(quán)。實(shí)踐表明,商會(huì)商事公斷成效斐然,廣獲官商兩界深度認(rèn)同,成為清末時(shí)期重要的商事紛爭(zhēng)解決途徑。商會(huì)公斷的成功,一方面要?dú)w因于商會(huì)的自我功能定位、人力資源以及程序制度建設(shè)等方面的優(yōu)勢(shì),另一方面也有賴于當(dāng)時(shí)地方官府的大力支持與配合。20世紀(jì)90年代,消失了近半個(gè)世紀(jì)的商會(huì)再次出現(xiàn)在中國(guó)經(jīng)濟(jì)舞臺(tái),并在市場(chǎng)經(jīng)濟(jì)秩序構(gòu)建中發(fā)揮著越來(lái)越重要的作用。在構(gòu)建多元糾紛解決機(jī)制背景下,特別是隨著我國(guó)行業(yè)協(xié)會(huì)、商會(huì)自治能力的不斷提升,商會(huì)或許再次煥發(fā)歷史生機(jī),成為重要的商事糾紛解決資源。
[Abstract]:In the early 20th century, in order to make up for the lack of government justice, the Qing Dynasty formally endowed the Chamber of Commerce with the power of commercial adjudication in the Concise Charter of the Chamber of Commerce. The practice shows that the commercial judgment of the Chamber of Commerce has a great effect and has been widely recognized by both the official and the commercial circles, and has become an important way to resolve commercial disputes in the late Qing Dynasty. On the one hand, the success of the Chamber of Commerce's judgment is attributed to the advantages of the Chamber of Commerce in terms of its self-function, its human resources and the construction of its procedural system. On the other hand, it also depends on the strong support and cooperation of the local authorities at that time in the 1990s. The Chamber of Commerce, which has disappeared for nearly half a century, once again appears on the stage of Chinese economy and plays an increasingly important role in the construction of market economic order. Under the background of building a pluralistic dispute resolution mechanism, especially with the continuous improvement of the autonomy ability of China's trade associations and chambers of commerce, chambers of commerce may once again radiate historical vitality and become an important resource for commercial dispute resolution.
