【摘要】:城鄉(xiāng)居民基本養(yǎng)老保險制度的建立是我國在社會保障領域改革的重要成果,有利于城鄉(xiāng)居民公平地享有改革發(fā)展紅利,改善民生,促進勞動力自由流動,帶動經(jīng)濟發(fā)展。其對象是城鄉(xiāng)非正式就業(yè)群體,也即農(nóng)民以及城鎮(zhèn)中沒有正式工作的居民。本文從理論層面闡述了城鄉(xiāng)居民基本養(yǎng)老保險制度,實質(zhì)上是新型農(nóng)村社會養(yǎng)老保險與城鎮(zhèn)居民社會養(yǎng)老保險制度合并后的結果。在實踐層面,筆者調(diào)研了甘肅省平?jīng)鍪嗅轻紖^(qū)城鄉(xiāng)居民基本養(yǎng)老保險制度的運行情況:目前該制度基本實現(xiàn)全覆蓋,參保率已達99.8%(1),基金收支、結余數(shù)額較大,配套轉移接續(xù)制度逐漸完備,制度越來越成熟,但該制度的運行主要依靠國務院及各地制定的政策,穩(wěn)定性差、權威性不足,相關立法缺失制約著其可持續(xù)發(fā)展。本文通過總結現(xiàn)有政策實施的經(jīng)驗、借鑒國外典型國家對非正式就業(yè)群體進行立法規(guī)制的有益做法,旨在構建城鄉(xiāng)居民基本養(yǎng)老保險法律制度,制定《城鄉(xiāng)居民基本養(yǎng)老保險條例》。具體內(nèi)容構想如下:在基金籌集和管理方面,應當采用“投保互助”型籌資模式,即由個人、集體、國家三方共同負擔,特別要發(fā)揮基層群眾自治組織作用,做實集體在資金籌集中的工作,不斷提高集體的籌資比重;在基金管理方面,應引入競爭機制,由專業(yè)管理機構采用商業(yè)化運作方式負責投資運營,實現(xiàn)保值增值;在轉移接續(xù)制度方面,應將市、縣統(tǒng)籌提高為省級統(tǒng)籌,最后過渡為國家統(tǒng)籌,建立跨區(qū)域基金調(diào)劑機制,實行人力資源和社會保障部-省-市-縣-鄉(xiāng)-村(社區(qū))六級聯(lián)網(wǎng),實現(xiàn)系統(tǒng)兼容、信息共享,方便參保對象跨區(qū)域流動;在經(jīng)辦機構建設方面,應在基層配備專業(yè)工作人員、開設基層服務窗口;在監(jiān)督機制建設方面,應建立專門的城鄉(xiāng)居民基本養(yǎng)老保險監(jiān)管機構,直接隸屬國務院,同時建立專業(yè)化的社會監(jiān)管組織;在權利義務方面,應當明確經(jīng)辦機構、參保人等的具體權利義務;在爭議處理機制方面應當引入復議前置程序,建立調(diào)解機制。
[Abstract]:The establishment of the basic old-age insurance system for urban and rural residents is an important achievement of the reform in the field of social security in China, which is conducive to the fair enjoyment of the reform and development dividend by urban and rural residents, the improvement of people's livelihood and the promotion of the free flow of labor. Promote economic development. Its object is urban and rural informal employment groups, that is, farmers and urban residents who do not have a formal job. This paper expounds the basic old-age insurance system for urban and rural residents from the theoretical level. In essence, it is the result of the combination of the new rural social old-age insurance and the urban residents' social old-age insurance system. The author investigated the operation of basic old-age insurance system for urban and rural residents in Kongtong District of Pingliang City, Gansu Province. At present, the system has basically achieved full coverage, the participation rate has reached 99.8%, and the fund income and expenditure. The balance amount is large, the supporting transfer succession system is gradually complete, the system is more and more mature, but the operation of the system mainly depends on the policies formulated by the State Council and other places, so it has poor stability and insufficient authority. The lack of relevant legislation restricts its sustainable development. This paper summarizes the experience of the implementation of existing policies and draws lessons from the useful practices of legislative regulation of informal employment groups in typical foreign countries. The purpose of this paper is to construct the legal system of basic old-age insurance for urban and rural residents and to formulate the regulations on basic old-age insurance for urban and rural residents. The specific contents are as follows: in the aspect of fund raising and management. We should adopt the "insured and mutual assistance" mode of financing, that is, the individual, the collective, and the state should share the burden. In particular, we should give play to the role of grass-roots mass autonomous organizations, and do the collective work in raising funds. Increasing the proportion of collective financing; In the aspect of fund management, the competition mechanism should be introduced, and the specialized management institutions should be responsible for the investment operation in the way of commercial operation, so as to maintain and increase the value of the funds. In the system of transfer and succession, we should improve the overall planning of city and county to provincial level, and finally make the transition to national overall planning, and establish the mechanism of trans-regional fund allocation. Implementation of the Ministry of Human Resources and Social Security, provinces, cities, counties, townships, villages (communities) six levels of networking, to achieve system compatibility, information sharing, easy to participate in cross-regional mobility; In the construction of administrative institutions, professional staff should be provided at the grass-roots level, and grass-roots service windows should be opened; In the construction of supervision mechanism, we should establish a special supervision organization of basic old-age insurance for urban and rural residents, directly under the State Council, and establish a specialized social supervision organization. In the aspect of rights and obligations, the specific rights and obligations of agencies and insured persons should be clarified. In the aspect of dispute settlement mechanism, we should introduce review procedure and establish mediation mechanism.
