法典法系是以古代羅馬法、特別是19世紀初《拿破侖法典》作為傳統(tǒng)而產(chǎn)生、發(fā)展的法律的總稱，，又稱“羅馬法系”。我國習慣稱之為“大陸法系”,又稱“民法法系”。法典法系傳播的地區(qū)非常廣、包括法、德、瑞士、意大利、比利時、盧森堡、荷蘭、西班牙、葡萄牙以及亞非拉的部分法語地區(qū)。其主要特點是：強調(diào)成文法的地位和作用，認為成文法為法的主要形式，是本國法律的基礎，判例在這些國家一般不具有法律的效力，僅作為法官在審理案件時的參考。此外，法典法系國家在法律分類、部門法的劃分、訴訟程序和法律術語等方面也有不同于英美法系的特點。
