【摘要】：二十世紀(jì)后半期以來，經(jīng)濟全球化與國際貿(mào)易飛速發(fā)展。在國際貿(mào)易合作交往過程中，交易雙方簽訂相關(guān)的法律合同，是至關(guān)重要的一個環(huán)節(jié)。而作為商務(wù)領(lǐng)域重要的溝通方式之一，合同不僅關(guān)系到合作能否順利進行，更加承載著交易雙方的直接經(jīng)濟利益。因此，準(zhǔn)確而恰當(dāng)?shù)暮贤g在更好地實現(xiàn)國際貿(mào)易合同的功能，以及在避免任何可能產(chǎn)生的爭議上起到至關(guān)重要的作用。 雖然國內(nèi)眾多學(xué)者從各種視角對國際貿(mào)易合同的翻譯進行了探討，并已取得諸多成果。但從文化差異視角對國際貿(mào)易合同翻譯進行的研究卻鮮有之。由于全球化的飛速發(fā)展，世界各國間的交往越發(fā)頻繁，由此引發(fā)的文化差異與沖突在方方面面都帶來了不小的影響，在國際貿(mào)易合同翻譯中也有所體現(xiàn)。由此，在國際貿(mào)易合同的翻譯問題上，我們不應(yīng)僅從法律語言學(xué)或一般翻譯理論角度對其進行探究，同時也應(yīng)從中西方文化差異的角度展開討論。本文做此研究以期對合同翻譯實踐有所幫助，并為法律執(zhí)業(yè)者及譯者們提供些許有益的參考或指引。 本文旨在探討國際貿(mào)易合同的文化內(nèi)涵，及其翻譯策略。本文根據(jù)中西方文化差異的四個表現(xiàn)，即道德觀，價值觀，宗教信仰，以及思維方式這幾方面，結(jié)合實例，找出詞匯，句式以及語篇層面上國際貿(mào)易合同的文化內(nèi)涵，并在此基礎(chǔ)上提出國際貿(mào)易合同的翻譯策略。 本文共分為七個部分: 引言部分回顧了前人總結(jié)的中西方文化差異，，以及國際貿(mào)易合同翻譯準(zhǔn)則，指出了文化差異在國際貿(mào)易合同翻譯中可能的影響，進而描述了本文研究的目的和重要性。 第二部分作為文獻綜述，分別介紹了國內(nèi)外現(xiàn)階段對國際貿(mào)易合同翻譯的研究，以及文化缺省及翻譯補償理論。并總結(jié)前人在文化差異對合同翻譯影響的領(lǐng)域所做的得研究。 第三部分論述了中西方文化差異。首先概括了文化差異以及文化差異的形成原因。繼而從不同的道德觀，價值觀，宗教信仰以及思維方式這四個方面總結(jié)出中西方文化差異的具體表現(xiàn)。 第四部分論述了國際貿(mào)易合同的篇章結(jié)構(gòu)及語言特點。從格式以及包含的主要條款介紹國際貿(mào)易合同的篇章結(jié)構(gòu)。并從詞匯，句式及語篇層面詳細(xì)論述國際貿(mào)易合同的語言特點。 第五部分討論了國際貿(mào)易合同中體現(xiàn)的文化內(nèi)涵。分別根據(jù)上文論述的文化差異存在的四個方面，即道德觀，價值觀，宗教信仰，以及思維方式的基礎(chǔ)上，總結(jié)出國際貿(mào)易合同文化內(nèi)涵。 第六部分提出了國際貿(mào)易合同在中西方文化差異下的翻譯策略。根據(jù)在上一章中總結(jié)出的國際貿(mào)易合同中的文化內(nèi)涵，分別從詞匯，句式，語篇層面討論其文化內(nèi)涵下的翻譯方法。最后一部分總結(jié)全文。對整篇文章做了全面總結(jié)，包括研究的主要發(fā)現(xiàn)，意義以及局限性。
[Abstract]:Since the second half of the twentieth century, economic globalization and international trade have developed rapidly. In the process of international trade cooperation, the signing of relevant legal contracts between the two parties is a crucial link. As one of the important communication methods in the field of business, contract not only relates to the smooth progress of cooperation, but also bears the direct economic interests of both parties. Therefore, accurate and appropriate contract translation plays a crucial role in achieving the functions of international trade contracts and avoiding any possible disputes. Although many domestic scholars have explored the translation of international trade contracts from various perspectives, many achievements have been made. However, there are few studies on the translation of international trade contracts from the perspective of cultural differences. With the rapid development of globalization, the communication between countries in the world becomes more and more frequent, and the cultural differences and conflicts caused by it have brought great influence in all aspects, and have also been reflected in the translation of international trade contracts. Therefore, on the issue of translation of international trade contracts, we should not only explore it from the angle of legal linguistics or general translation theory, but also discuss the cultural differences between China and the West. This study is intended to be helpful to the practice of contract translation and provide some useful reference or guidance for legal practitioners and translators. The purpose of this paper is to explore the cultural connotations of international trade contracts and their translation strategies. According to the four manifestations of the cultural differences between China and the West, that is, morality, values, religious beliefs, and ways of thinking, this paper combines with examples to find out the cultural connotations of international trade contracts at the level of vocabulary, sentence structure and discourse. On this basis, the translation strategy of international trade contract is put forward. This paper is divided into seven parts: the introduction reviews the cultural differences between China and the West summarized by predecessors and the translation criteria of international trade contracts, and points out the possible impact of cultural differences in the translation of international trade contracts. Furthermore, the purpose and importance of this paper are described. The second part, as a literature review, introduces the current studies on the translation of international trade contracts at home and abroad, as well as the theory of cultural default and translation compensation. It also summarizes the previous studies on the impact of cultural differences on contract translation. The third part discusses the cultural differences between China and the West. First of all, it summarizes the cultural differences and the formation of cultural differences. Then it sums up the concrete manifestation of the cultural difference between China and the West from four aspects: morality, values, religious belief and mode of thinking. The fourth part discusses the text structure and language characteristics of international trade contract. The text structure of international trade contract is introduced in terms of format and main clauses. The linguistic features of international trade contracts are discussed in detail in terms of vocabulary, sentence structure and discourse. The fifth part discusses the cultural connotation of international trade contract. Based on the four aspects of the cultural differences discussed above, namely morality, values, religious beliefs, and ways of thinking, this paper summarizes the cultural connotation of international trade contracts. The sixth part proposes the translation strategies of international trade contracts under the cultural differences between China and the West. According to the cultural connotations of international trade contracts summarized in the previous chapter, this paper discusses the translation methods of international trade contracts from the lexical, sentence and textual levels. The last part summarizes the full text. A comprehensive summary of the whole article, including the main findings of the study, significance and limitations.
