【摘要】：本文是一篇翻譯項(xiàng)目報告。本翻譯報告選取了愛馬仕（上海）商貿(mào)有限公司（發(fā)包方）與上海維固工程實(shí)業(yè)有限公司（承包商）訂立的工程合同第八、九、十部分作為翻譯文本，該文本屬于應(yīng)用翻譯的范疇，應(yīng)用翻譯在傳遞信息為主要目的同時，又十分注重信息的傳遞效果的實(shí)用性翻譯。該文本主要規(guī)定了上海市淮海中路房屋地下室結(jié)構(gòu)加固改造工程的保險、責(zé)任和賠償、時間期限、合同總金額的計量、支付和調(diào)整等內(nèi)容，目前并沒有譯文正式發(fā)表。由尤金奈達(dá)提出的功能對等提出了從最小到最大的各程度上的對等，被定義為“譯文對譯文接受者所起的作用應(yīng)與原文對原文接受者所起的作用大體對等”(奈達(dá)1969:24)。不論法律合同被翻譯成何種語言，，其語言的準(zhǔn)確性和法律的嚴(yán)肅性的特點(diǎn)是不會變的，所以從這個角度看，功能對等可以作為合同翻譯的最佳原則。本報告的主要內(nèi)容分為以下四個部分：第一、翻譯項(xiàng)目介紹，包括項(xiàng)目的背景、目標(biāo)、意義等。第二、原作背景介紹，包括合同雙方簡介、原文版本、原文主要內(nèi)容介紹、原文分析等。第三、翻譯難點(diǎn)與翻譯方法：包括詞法難點(diǎn)，句法難點(diǎn)；在翻譯過程中用到的翻譯方法主要有：術(shù)語翻譯、詞性轉(zhuǎn)換、句式轉(zhuǎn)換、長句的翻譯等。第四、總結(jié)在翻譯過程中所得到的啟發(fā)、教訓(xùn)和仍待解決的問題。
[Abstract]:This article is a translation project report. This report selects the eighth, ninth and tenth parts of the contract concluded between Herm 貓 s (Shanghai) Trading Co., Ltd and Shanghai Weigu Engineering Industry Co., Ltd (contractor) as the translated text. This text belongs to the category of applied translation. Application translation is not only the main purpose of transmitting information, but also the practical translation of the effect of information transmission. The text mainly stipulates the contents of insurance, liability and compensation, time limit, measurement, payment and adjustment of the total amount of contract, etc. At present, no translation has been officially published. Functional equivalence, proposed by Eugene Nida, is defined as "the effect of the translation on the recipient of the target text should be roughly equal to that of the source text" (Nida 1969: 24). No matter what language the legal contract is translated into, the accuracy of the language and the seriousness of the law will not change, so from this point of view, functional equivalence can be regarded as the best principle of contract translation. The main contents of this report are as follows: first, the introduction of the translation project, including the background, objectives, significance, etc. Second, the background of the original, including the parties to the contract, the original version, the main content of the original, original analysis, etc. Third, translation difficulties and translation methods include lexical difficulties and syntactic difficulties, and the translation methods used in the process of translation mainly include: terminology translation, part of speech conversion, sentence transformation, translation of long sentences and so on. Fourthly, it summarizes the enlightenment, lessons and problems that remain to be solved in the process of translation.
