【摘要】：隨著中西方貿(mào)易往來(lái)的日益頻繁，律師事務(wù)所的法律活動(dòng)在經(jīng)濟(jì)全球化的舞臺(tái)上正起著越來(lái)越重要的作用，而律師事務(wù)所的內(nèi)部翻譯作為法律活動(dòng)的輔助行為為工作語(yǔ)言不同的各方搭建了溝通的橋梁，該等內(nèi)部翻譯大部分屬于法律翻譯。 但是，由于法律翻譯譯員水平參差、譯文質(zhì)量衡量標(biāo)準(zhǔn)模糊、翻譯工作量大等各方面的制約因素，律師事務(wù)所的法律翻譯工作仍處于無(wú)序和摸索的階段；現(xiàn)有的針對(duì)法律翻譯的研究大多側(cè)重于立法文本的翻譯或是具體合同文本的翻譯技巧，鮮有從宏觀層面指導(dǎo)翻譯工作展開的研究和探討；而在上述研究法律翻譯的著作中，大部分以德國(guó)功能理論的視角出發(fā)，而德國(guó)功能理論，相比之前的傳統(tǒng)翻譯理論，實(shí)則是將翻譯研究從微觀的角度提升到了宏觀的層次，更適合于研究整個(gè)翻譯過(guò)程。 有鑒于此，本論文探討了在功能理論的指導(dǎo)下，律師事務(wù)所的翻譯行為參與者以何種方式利用現(xiàn)有資源在既定的環(huán)境中開展翻譯工作的模式。 本論文首先簡(jiǎn)要回顧了法律翻譯研究的現(xiàn)狀以及現(xiàn)在律師事務(wù)所通常所采用的工作模式。然后對(duì)德國(guó)功能理論進(jìn)行了梳理，其中特別強(qiáng)調(diào)了功能理論的主要原則和啟示，特別是對(duì)翻譯過(guò)程研究的啟示。在此基礎(chǔ)上，本論文進(jìn)而探討了功能翻譯理論在律師事務(wù)所翻譯工作模式中的適用：法律文本的語(yǔ)言特點(diǎn)決定了其合作翻譯的可行性、法律文本的功能導(dǎo)向決定了其目的決定翻譯策略的主導(dǎo)思想、翻譯行為參與者的互動(dòng)溝通以及翻譯過(guò)程的構(gòu)建是保障其翻譯行為順利開展的基礎(chǔ)。在此理論結(jié)合客觀陳述的描述性研究之后，本論文列舉了一家律師事務(wù)所的一項(xiàng)收購(gòu)項(xiàng)目所涉及的翻譯案例。通過(guò)分析其具體的翻譯行為，特別是翻譯行為中各參與者之間開展工作的模式，從功能理論的視角審視這種工作模式的可取之處和不足之處。進(jìn)而在最后提出優(yōu)化的意見和建議。 律師事務(wù)所的內(nèi)部翻譯需在翻譯目的明確、翻譯綱要細(xì)化的情況下開展，其翻譯行為的參與者均可直接或間接溝通的特點(diǎn)是其在工作模式中需利用的優(yōu)勢(shì)，而其翻譯過(guò)程的環(huán)環(huán)相扣則要求前一環(huán)節(jié)的參與者及時(shí)做好整合反饋和整體協(xié)調(diào)工作；此外，翻譯行為結(jié)束之后對(duì)翻譯資料的整合對(duì)工作模式的長(zhǎng)期優(yōu)化和成熟起著重要作用。 本論文由于案例的單一和思考角度的限制有其局限性，，旨在為該領(lǐng)域研究的深入和成熟拋磚引玉。
[Abstract]:With the increasingly frequent trade between China and the West, the legal activities of law firms are playing an increasingly important role in the stage of economic globalization. The internal translation of law firms, as an auxiliary act of legal activities, provides a bridge for all parties with different working languages, and most of these internal translations belong to legal translation. However, the legal translation work of law firms is still in the stage of disorder and groping due to the various restrictive factors, such as the uneven level of legal translators, the vague standard of translation quality and the heavy translation workload. Most of the existing studies on legal translation focus on the translation techniques of legislative texts or specific contract texts, and there are few studies and discussions directed at translation at the macro level, while in the works on legal translation mentioned above, Most of them are from the perspective of German functional theory, which is more suitable for studying the whole translation process than the traditional translation theory. Under the guidance of functional theory, this thesis explores the ways in which the participants in the translation activities of law firms use their existing resources to carry out translation work in a given environment. This thesis first briefly reviews the current situation of legal translation studies and the current working patterns of law firms. Then the author makes an analysis of the German functional theory, with particular emphasis on the main principles and implications of the functional theory, especially on the study of the translation process. On this basis, the thesis further explores the application of functional translation theory in the translation mode of law firms: the language characteristics of legal texts determine the feasibility of cooperative translation. The functional orientation of legal texts determines the dominant idea of translation strategies. The interactive communication between participants in translation and the construction of translation process are the basis for the smooth development of translation. After a descriptive study of this theory and objective statements, this paper lists a case of translation involved in a acquisition project by a law firm. By analyzing its specific translation behavior, especially the mode of working among the participants in translation behavior, this paper examines the merits and shortcomings of this mode from the perspective of functional theory. Finally, suggestions and suggestions for optimization are put forward. The internal translation of a law firm should be carried out with a clear translation purpose and a detailed translation outline. The characteristics of direct or indirect communication among the participants in their translation activities are the advantages they need to take advantage of in the work model. In addition, the integration of translation materials plays an important role in the long-term optimization and maturity of the work model. Due to the limitation of single case and the limitation of thinking angle, this paper aims to offer a reference for the further and mature research in this field.
