【摘要】：體裁分析逐漸成為一種十分有效的語篇研究方法。體裁分析能更進一步地描述不同語言形式的功能特征。把語言因素,社會文化和心理因素都考慮在內(nèi)�？梢苑从吵鼋浑H目的,以及為達到既定交際目的而采用的策略。這是比其他分析方法更有效的原因。 隨著經(jīng)濟全球化,中國與世界其他國家的法律事務(wù)交往更加密切,近年來,關(guān)于法律英語的研究也在文體,翻譯等方面取得很大的進展。法院判決書是法律界常用且極為重要的法律文書。通過對中美法院判決書的體裁對比研究,探索二者之間的異同.從而為法律語篇的系統(tǒng)功能語言學(xué)研究進行了有益的探索。 本論文將通過對搜集到的40篇法院判決書(中美各20篇)對中美法院判決書的體裁結(jié)構(gòu)進行分析,以找出它們在體裁結(jié)構(gòu)方面的共性與差異。本研究擬解決以下問題：1)判決書是否構(gòu)成一特定體裁?2)中美判決書有哪些共性和差異? 通過探討,本論文得出以下結(jié)論：1)判決書具有共同普遍的體裁結(jié)構(gòu),美國判決書由“指明案件一建立案件事實-案件辯論-宣布判決-異議”五個語步(move)構(gòu)成。中國判決書由“首部-事實-判決理由-宣判-尾部”五個語步構(gòu)成。其中每個語步又都由若干個步驟構(gòu)成,并都有各自特定的交際功能,它們互相作用,共同實現(xiàn)文本總的交際目的。2)法院判決書均屬于法律英語體裁這一大類,它們在結(jié)構(gòu)上存在著一定的共性,即事實,判決理由,宣判等這些必要語步。但由于中美法律制度的不同,判決書也存在著很大的差異,導(dǎo)致它們在各語步的選擇、排列順序、判決書中所占的比重,所使用策略有所不同。
[Abstract]:Genre analysis has gradually become a very effective method of discourse research. Genre analysis can further describe the functional characteristics of different language forms. Taking into account linguistic factors, sociocultural and psychological factors, genre analysis can reflect the communicative purpose. This is more effective than other analytical methods. With the economic globalization, the legal affairs exchanges between China and other countries in the world are closer. In recent years, the research on legal English is also in style. Great progress has been made in translation and other aspects. Court judgments are commonly used and extremely important legal instruments in the legal profession. Through a comparative study of the genres of court judgments in China and the United States, This paper explores the similarities and differences between the two and makes a useful exploration for the systematic functional linguistics of legal discourse. This paper will analyze the genre structure of the court judgments in China and the United States through 40 court judgments collected (20 in China and 20 in the United States). In order to find out their similarities and differences in genre structure, this study intends to solve the following question: 1) does the judgment constitute a particular genre? 2) what are the similarities and differences between Chinese and American judgments? Through discussion, this paper draws the following conclusion: 1) the judgment has a common and universal genre structure. The United States judgment is composed of five words: "specifying the facts of the case established-case debating-declaring judgment-dissenting"). The Chinese judgment consists of five steps: "first-fact-reason of judgment-judgment-tail". Each of these steps consists of several steps, They all have their own specific communicative functions, and they interact with each other to achieve the total communicative purpose of the text. 2) the judgments of the court belong to the legal English genre. They have certain similarities in structure, that is, the facts and the reasons for the judgment. But because of the difference of the legal system between China and the United States, there are also great differences in the judgment, which leads to the difference of their choice, order of arrangement, the proportion in the judgment, and the strategies used.
