【摘要】：電視直銷廣告是一種借助電視臺的影響,通過多種藝術手段,詳盡完備的對商品和服務進行宣傳推銷的廣告形式。電視直銷廣告在快速發(fā)展過程中存在許多違法行為,如果不加強監(jiān)督、管理和引導,它最終將走向衰弱。本文結合相關案例,從我國電視直銷廣告的現狀入手,分析電視直銷廣告違法行為及其產生原因,借鑒國外立法,通過事前法律規(guī)制、完善事后救濟、以及建立事中監(jiān)督機制三方面的探討,提出解決我國當前電視直銷廣告中存在的諸多違法行為的解決方略,使我國電視直銷行業(yè)得到進一步發(fā)展。
[Abstract]:TV direct selling advertisement is a kind of advertising form which makes use of the influence of TV station and through a variety of artistic means to promote and promote goods and services in detail. There are many illegal behaviors in the rapid development of TV direct selling advertisement. If we do not strengthen the supervision, management and guidance, it will eventually become weak. Based on the relevant cases, this paper analyzes the illegal behavior of TV direct selling advertising and its causes from the current situation of TV direct selling advertising in China, and uses foreign legislation for reference to perfect the relief after the event through legal regulation in advance. This paper probes into the establishment of supervision mechanism in the event, and puts forward some countermeasures to solve the illegal behaviors existing in the TV direct selling advertisement in our country, so as to further develop the TV direct selling industry in our country.
