探析我國(guó)商業(yè)廣告的約束機(jī)制

【摘要】:在現(xiàn)實(shí)生活中,隨著經(jīng)濟(jì)與社會(huì)的發(fā)展,廣告對(duì)我們生活的影響越來(lái)越大。通常廣告分為商業(yè)廣告和非商業(yè)廣告,而商業(yè)廣告給人們的生活帶來(lái)了很多的便利,有利于商品與服務(wù)的宣傳和普及,使人們更快速、有效的獲取商品服務(wù)信息。有些經(jīng)典的商業(yè)廣告不僅僅起到宣傳商品的作用,同時(shí)還是有價(jià)值的藝術(shù)作品,成為社會(huì)文化的一部分。雖然商業(yè)廣告給人們的生活帶來(lái)了很多便利,但是,現(xiàn)實(shí)中存在的一些虛假?gòu)V告和不符合規(guī)范的廣告,傳達(dá)的是不準(zhǔn)確、不真實(shí)、不健康甚至是虛假的信息,不僅不能給人們帶來(lái)便利,相反會(huì)給消費(fèi)者帶來(lái)經(jīng)濟(jì)上、心理上甚至身體上的巨大傷害,最終影響整個(gè)社會(huì)經(jīng)濟(jì)的發(fā)展。如何建立有效的商業(yè)廣告約束機(jī)制,讓商業(yè)廣告在嚴(yán)格、切實(shí)有效的規(guī)范下運(yùn)行,是一件非常重要、迫切需要解決的事情。 本文旨在探析我國(guó)商業(yè)廣告約束機(jī)制的創(chuàng)建問(wèn)題。廣告的約束機(jī)制主要分為國(guó)家法律約束機(jī)制和廣告行業(yè)自律機(jī)制。一方面通過(guò)分析研究我國(guó)現(xiàn)有的廣告管理體系和行業(yè)自律規(guī)范,,從道德角度出發(fā)分析廣告的行業(yè)自律及社會(huì)監(jiān)督問(wèn)題,另一方面通過(guò)與經(jīng)濟(jì)發(fā)達(dá)國(guó)家的廣告約束機(jī)制進(jìn)行比較,分析我國(guó)現(xiàn)有商業(yè)廣告約束機(jī)制,發(fā)掘優(yōu)點(diǎn)。吸取西方經(jīng)濟(jì)發(fā)達(dá)國(guó)家的經(jīng)驗(yàn),對(duì)于優(yōu)勢(shì)部分進(jìn)行肯定和堅(jiān)持,改變和完善我國(guó)商業(yè)廣告約束機(jī)制方面的不足,創(chuàng)建適合我國(guó)的商業(yè)廣告約束機(jī)制。提出建立起覆蓋全面、法律監(jiān)管與行政監(jiān)督相互配合的廣告法律法規(guī)體系,來(lái)對(duì)商業(yè)廣告進(jìn)行約束,建立起真正有效的商業(yè)廣告行業(yè)自律組織。改變商業(yè)廣告的行業(yè)自律徒有虛名的狀態(tài),完善商業(yè)廣告的監(jiān)管措施,重視社會(huì)各方面對(duì)廣告業(yè)的監(jiān)督,通過(guò)倫理強(qiáng)化的自律約束,以呼喚社會(huì)道德、誠(chéng)信體系的建設(shè),真正建立起一個(gè)法規(guī)完善、權(quán)責(zé)明確、問(wèn)責(zé)有效、追究有途、監(jiān)督全面、自律有效的具有中國(guó)特色的商業(yè)廣告約束機(jī)制。
[Abstract]:In real life, with the development of economy and society, advertisement has more and more influence on our life. Usually advertising is divided into commercial advertisement and non-commercial advertisement, and commercial advertisement brings a lot of convenience to people's life. It is conducive to the promotion and popularization of goods and services, so that people can obtain information on goods and services more quickly and effectively. Some classic commercial advertisements not only serve to promote goods, but also valuable works of art. Become a part of social culture. Although commercial advertising has brought a lot of convenience to people's life, but in reality, some false advertisements and advertisements that do not conform to the norms are imprecise and untrue. Unhealthy or even false information, not only can not bring convenience to people, on the contrary, it will bring huge economic, psychological and even physical harm to consumers. It is a very important and urgent task to establish an effective restriction mechanism of commercial advertisement and make it run under strict, practical and effective norms. The purpose of this paper is to explore the establishment of the restriction mechanism of commercial advertising in China, which is mainly divided into national legal restraint mechanism and advertising industry self-discipline mechanism. On the one hand, through the analysis of the existing advertising management in China. System and industry self-regulation, On the other hand, by comparing with the advertising restraint mechanism of the developed countries, this paper analyzes the existing commercial advertising restraint mechanism in China. To explore the advantages, to absorb the experience of the western developed countries, to affirm and insist on the advantages, and to change and improve the restriction mechanism of commercial advertising in our country. It is proposed to set up a comprehensive system of advertising laws and regulations that covers all aspects and cooperate with administrative supervision to restrict commercial advertising. To set up a truly effective self-discipline organization of the commercial advertising industry, to change the self-discipline of the commercial advertising industry, to improve the supervision measures of the commercial advertisements, to attach importance to the supervision of the advertising industry by all aspects of the society, and to strengthen the self-discipline through ethical restraint. In order to call for the construction of social morality and credit system, we can really establish a binding mechanism of commercial advertising with Chinese characteristics such as perfect laws and regulations, clear power and responsibility, effective accountability, promising investigation, comprehensive supervision and effective self-discipline.
