伴隨著近些年來(lái)我國(guó)經(jīng)濟(jì)的高速發(fā)展，我國(guó)建筑業(yè)展現(xiàn)出了較高的發(fā)展勢(shì)頭，同時(shí)其規(guī)模以及數(shù)量也都得到了有效的提升；在建筑業(yè)高速發(fā)展的過(guò)程中，其已經(jīng)成為了我國(guó)國(guó)民經(jīng)濟(jì)的支柱產(chǎn)業(yè)。在建筑業(yè)發(fā)展的過(guò)程中，由于我國(guó)建筑業(yè)整體生產(chǎn)力水平一般，與之而來(lái)的安全生產(chǎn)問(wèn)題也一度上影響著我國(guó)建筑業(yè)的良性發(fā)展。建筑業(yè)是我國(guó)第二高危產(chǎn)業(yè)，強(qiáng)化對(duì)于建筑業(yè)的安全生產(chǎn)管理勢(shì)在必行。
法律作為建筑業(yè)安全生產(chǎn)管理、引導(dǎo)的基礎(chǔ)性措施，其通過(guò)規(guī)范性的制度說(shuō)明能夠?qū)τ谖覈?guó)建筑業(yè)的安全生產(chǎn)形成明顯的引導(dǎo)以及約束，從而提升我國(guó)建筑業(yè)的整體安全生產(chǎn)水平。目前我國(guó)以初步建立了建筑安全管理法律體系，其中對(duì)于相關(guān)機(jī)構(gòu)的權(quán)責(zé)也有著一定的說(shuō)明；但由于我國(guó)建筑安全管理法律體系尚處于發(fā)展初期，故而其中必然存在較多方面的問(wèn)題。在本文的研究過(guò)程中，本文通過(guò)對(duì)于我國(guó)建筑安全管理法律體系現(xiàn)狀的深入分析，筆者發(fā)現(xiàn)我國(guó)建筑安全管理法律體系主要存在立法觀念錯(cuò)位、法律體系內(nèi)容缺失、法律條款銜接性不強(qiáng)、法律條款靈活性低、法律條款可操作性低五大方面的問(wèn)題，其嚴(yán)重的影響了我國(guó)建筑安全管理法律體系的效應(yīng)展現(xiàn)。在本文的研究過(guò)程中，通過(guò)筆者對(duì)于國(guó)外先進(jìn)經(jīng)驗(yàn)的分析探討，筆者認(rèn)為應(yīng)當(dāng)從修正立法觀念、強(qiáng)化法規(guī)內(nèi)容完善、構(gòu)建建筑安全管理法律體系完善機(jī)制、提升條款靈活性四大方面上對(duì)于我國(guó)建筑安全管理法律體系進(jìn)行完善。通過(guò)本文的研究，筆者旨在通過(guò)本文對(duì)于我國(guó)建筑安全管理法律體系的現(xiàn)狀問(wèn)題分析以及策略提出，進(jìn)一步推動(dòng)我國(guó)建筑安全管理法律體系的優(yōu)化以及完善，從而實(shí)現(xiàn)我國(guó)建筑業(yè)的整體安全生產(chǎn)水平提升。

Abstract

With the rapid development of China's economy in recent years, China's construction industry showed a high momentum of development, also the scale and quantity have also been effective promotion; in the process of the rapid development of the construction industry, it has become the pillar industry of our national economy. In the process of the development of the construction industry, because of the construction industry in our country in general and the overall level of productivity, and the issue of safety in production, also once affects the healthy development of China's construction industry. The construction industry is the second high-risk industry in China, and it is imperative to strengthen the safety management of building industry.
Legal as the safe production in construction industry management, guide the basic measures, the through the normative system that can form clear guidance and constraints for the safety production of construction industry in our country, so as to enhance the construction of our country the overall level of safety in production. Currently our country established to the construction safety management of the legal system, which for the responsibilities of relevant institutions also has a certain description; but due to the legal management system of construction safety in China is still in the early stages of development, therefore, which must exist in many aspects. In the course of the study, this paper for in-depth analysis of China's construction safety management status of legal system, the author found that the legal management system of construction safety in China mainly exist in the legislation idea dislocation, legal system lack of content, legal terms cohesion of is not strong, the low flexibility of legal provisions, legal provisions can operate five aspects of the problem, the serious affected the effect of the legal system of China's construction safety management show. In the course of the study, through the analysis of the advanced experience of foreign study, the author thinks that should from revising the legislative concept, strengthening laws and regulations to perfect and construct the legal system of construction safetymanagement improve the mechanism, enhance the flexibility in terms of the four major aspects to our country building legal system of safety management to improve. Through the study of this paper. The author aims to for the legal system of China's construction safety management situation, problems analysis and strategy put forward by this paper, further promote the optimization of the legal system of China's construction safety management and improvement, in order to achieve to improve the construction industry in our country the overall level of safety in production.

一、緒論

（一）研究背景

近年來(lái)我國(guó)國(guó)民經(jīng)濟(jì)的高速發(fā)展，建筑行業(yè)也呈現(xiàn)較快的發(fā)展勢(shì)頭，同時(shí)在建筑業(yè)快速發(fā)展的過(guò)程中，建筑業(yè)規(guī)模以及數(shù)量都有著明顯的提升；同時(shí)我國(guó)正處于城鎮(zhèn)化建設(shè)階段，進(jìn)而建筑業(yè)在未來(lái)的發(fā)展過(guò)程中，也將持續(xù)呈現(xiàn)巨大的發(fā)展勢(shì)頭。就我國(guó)當(dāng)代建筑業(yè)發(fā)展現(xiàn)狀而言，其不僅是我國(guó)國(guó)民經(jīng)濟(jì)發(fā)展的基礎(chǔ)性保障，同時(shí)也是我國(guó)國(guó)民經(jīng)濟(jì)發(fā)展的核心支柱產(chǎn)業(yè)。在建筑業(yè)發(fā)展的過(guò)程中，其有效的吸納了大量的農(nóng)村剩余勞動(dòng)力，同時(shí)優(yōu)化了地方社會(huì)和諧穩(wěn)定發(fā)展。故而來(lái)說(shuō)，建筑業(yè)在我國(guó)當(dāng)代社會(huì)體制以及經(jīng)濟(jì)體制中都有著重要性的作用展現(xiàn)。
由于各方面的因素以及建筑業(yè)的自身特點(diǎn)，我國(guó)建筑業(yè)在發(fā)展的過(guò)程中一直展現(xiàn)出了較高的安全事故系數(shù)，其不僅是我國(guó)國(guó)民經(jīng)濟(jì)的損失，同時(shí)還會(huì)對(duì)于相關(guān)人員形成較高的人身安全威脅；就我國(guó)當(dāng)代建筑業(yè)的發(fā)展現(xiàn)狀展現(xiàn)來(lái)說(shuō)，建筑業(yè)已經(jīng)成為我國(guó)當(dāng)代社會(huì)發(fā)展過(guò)程中的第二危險(xiǎn)行業(yè)，故而整體上來(lái)說(shuō)我國(guó)建筑業(yè)的安全管理形勢(shì)十分嚴(yán)峻。優(yōu)化改善我國(guó)建筑業(yè)安全管理現(xiàn)狀，不僅是保障我國(guó)國(guó)民經(jīng)濟(jì)的穩(wěn)定發(fā)展需求展現(xiàn)，同時(shí)也是保障相關(guān)人員生命財(cái)產(chǎn)安全的重要措施。
建筑業(yè)的安全事故因素主要是由于人或物的不安全狀態(tài)以及建筑施工管理等方面的失誤，從根本上對(duì)建筑業(yè)的安全事故進(jìn)行規(guī)避，必須通過(guò)相關(guān)法規(guī)的構(gòu)建以及完善，進(jìn)而對(duì)相關(guān)行業(yè)或是相關(guān)責(zé)任人形成約束以及引導(dǎo)，從而有效的降低我國(guó)建筑業(yè)整體安全事故系數(shù)以及數(shù)量。就我國(guó)建筑安全管理法律體系現(xiàn)狀而言，我國(guó)建筑安全法律體系起步較晚，，同時(shí)在發(fā)展的過(guò)程中我國(guó)建筑安全管理法律體系展現(xiàn)出較低的發(fā)展水平，優(yōu)化我國(guó)建筑安全管理法律體系的完善，是保障我國(guó)建筑業(yè)持續(xù)穩(wěn)定發(fā)展的必然需求，同時(shí)也是構(gòu)建我國(guó)法制社會(huì)的必然方向。
