【摘要】：本論文是美國最高法院的一份判決書的翻譯報告�，F(xiàn)今,中國政府開啟了全面推進(jìn)依法治國的新征程,加快了建設(shè)法治政府的步伐。國家間的法律交流變得空前重要。而美國作為發(fā)達(dá)國家,其設(shè)立的相對完善、先進(jìn)的法律體系無疑能夠?yàn)橹袊ㄔO(shè)法治政府提供一些參考。因此,外國法律文本的漢譯工作就顯得尤其迫切且重要。在報告中,作者在分析了原文本的本質(zhì)特征后,選擇文本類型理論作為指導(dǎo),且在翻譯過程中嚴(yán)格遵守了法律對等和語用對等的原則。為了實(shí)現(xiàn)語言功能和法律效果的對等,作者主要運(yùn)用了語用充實(shí)的方法并使用了直譯、創(chuàng)造性翻譯、詞類轉(zhuǎn)換、增譯、減譯以及改譯的翻譯策略。在此翻譯報告中,作者主要關(guān)注三個問題:如何翻譯判決書中的案例編號;如何翻譯法律詞匯(包括:無普通詞意義的普通詞,專業(yè)術(shù)語,法律行話,正式程度較高的詞匯);如何翻譯法律長句(尤其是如何翻譯無主被動句和強(qiáng)調(diào)句)。根據(jù)文本類型理論,在翻譯法律術(shù)語和復(fù)雜句型時,作者采用了不同的翻譯策略以期實(shí)現(xiàn)法律對等。同時,作者也概括出了相關(guān)技巧來解決上述的三個問題。
