【摘要】：在法庭口譯中,由于雙語(yǔ)和法律制度的巨大差異,有時(shí)譯語(yǔ)產(chǎn)出會(huì)受到各種因素的影響,信息傳達(dá)不到位,無法讓目的語(yǔ)讀者理解。這使得雙方容易產(chǎn)生誤解,因此譯員在翻譯過程中應(yīng)謹(jǐn)慎處理信息,避免以上情形的發(fā)生。本報(bào)告以廣東省廣州市中級(jí)人民法院刑事審判第二庭關(guān)于毒品走私案的庭審為例。譯員在庭審中起到了橋梁的作用,之后,筆者深入分析了不同法律體制在口譯過程中的影響,最后,筆者分析了法律體制在口譯中的重要性,提出了應(yīng)對(duì)策略,以幫助譯者出色地完成口譯實(shí)踐。總體而言,本報(bào)告將回答以下幾個(gè)問題:1)為什么法律制度的不當(dāng)運(yùn)用會(huì)影響譯語(yǔ)產(chǎn)出?2)為使法律制度更好地影響翻譯實(shí)踐,可以采取哪些策略?作為不同文化以及語(yǔ)言之間溝通的橋梁,法庭口譯,無論是英漢口譯還是漢英口譯,都需要譯員具備豐富的法律專業(yè)知識(shí),同時(shí)具備口譯能力,如此,才能很好地處理各種在法庭口譯實(shí)踐過程中遇到的種種困難,因此,譯員不僅需要通曉中國(guó)法律制度,也需了解普通法法律制度。通過撰寫這篇報(bào)告,筆者希望對(duì)法律制度之于法庭口譯的影響這一研究領(lǐng)域略作貢獻(xiàn)。
[Abstract]:In court interpretation, due to the great differences in bilingual and legal systems, sometimes the output of the target language will be affected by various factors, and the information can not be communicated to the target readers. This makes both sides prone to misunderstanding, so translators should handle the information carefully in the translation process to avoid the occurrence of the above situation. This report takes the second Division of Criminal trial of Guangzhou Intermediate people's Court in Guangdong Province as an example. After that, the author analyzes the influence of different legal systems in the process of interpreting. Finally, the author analyzes the importance of legal system in interpreting and puts forward some countermeasures. In order to help the translator to complete the interpretation practice. In general, this report will answer the following questions: 1) Why does the improper use of the legal system affect the output of the target language? 2) what strategies can be adopted to better influence the translation practice of the legal system? As a bridge between different cultures and languages, court interpretation, whether English-Chinese or Chinese-English, requires an interpreter to have a wealth of legal expertise, as well as the ability to interpret. In order to deal with all kinds of difficulties encountered in the practice of interpretation in court, interpreters need to know not only the legal system of China, but also the legal system of common law. By writing this report, the author hopes to contribute a little to the research field of the influence of the legal system on court interpretation.
