【摘要】：當(dāng)今世界一流大學(xué)都有其獨(dú)具特色且完備的大學(xué)章程,由此被賦予了“高校憲法”的效力。在西方國家,大學(xué)章程伴隨著歐洲中世紀(jì)大學(xué)的誕生而產(chǎn)生,早期是教皇或國王為大學(xué)頒發(fā)的特許狀,它承認(rèn)或賦予大學(xué)一定程度的自治權(quán)力。因法律文書學(xué)習(xí)參考的需要,翻譯領(lǐng)域?qū)Υ髮W(xué)章程的研究多涉及英譯漢,以期在其良好法律示范作用下,規(guī)范我國高等教育管理體制和運(yùn)行機(jī)制。而近年來,隨著我國高等教育國際化的逐步推進(jìn),我國高等院校與海外院校合作交流日趨密切,中外合作辦學(xué)項(xiàng)目開展地如火如荼。在此大背景下,我國高校章程經(jīng)常需要作為補(bǔ)充協(xié)議附于正式合作協(xié)議中。我國高校章程的制訂一般涉及其發(fā)展歷程概述,學(xué)校辦學(xué)特點(diǎn)及各項(xiàng)內(nèi)部事務(wù)具體的管理規(guī)定。其英譯版本已然成為國外合作院校了解中國高校體制機(jī)制和校園文化的一扇窗口。本文旨在以《華北水利水電大學(xué)章程》英譯項(xiàng)目為依托,對大學(xué)章程類法律文本漢譯英翻譯領(lǐng)域有所研究,并針對翻譯中出現(xiàn)的問題提出可適用的翻譯策略。通過系統(tǒng)研究文本類型理論及其代表理論家賴斯和紐馬克的觀點(diǎn),作者發(fā)現(xiàn)二位理論家對于法律文本類型的劃分存在差異,進(jìn)而影響翻譯方法的施用。本文根據(jù)翻譯項(xiàng)目中原文本的實(shí)際特點(diǎn),將其文本內(nèi)容劃分為規(guī)約性部分和闡述性部分。再按照規(guī)約性篇章“重形式”和闡述性內(nèi)容“重信息”的原則,妥善采取可行的翻譯方法。“分而譯之”可謂是本文提出的一種創(chuàng)新性翻譯思路。除此之外,本文的研究重點(diǎn)在于結(jié)合實(shí)例分析英譯難點(diǎn)并解決難譯章節(jié)。依照謀篇、構(gòu)句、選詞的順序,作者羅列出所出現(xiàn)的諸如流水句、無主句及中國特色四字格等翻譯難點(diǎn)和可想到的諸如增譯、語態(tài)轉(zhuǎn)換及詞性轉(zhuǎn)換等翻譯方法。希望能為今后的大學(xué)章程英譯提出可行的翻譯思路及一定的借鑒意義。
[Abstract]:Nowadays, the world's first-class universities have their own unique and complete university charters, which are endowed with the validity of the "university constitution". In order to standardize the management system and operation mechanism of China's higher education, the study of University articles of association in the field of translation is mostly concerned with English-Chinese translation for the purpose of reference in the study of legal documents. In this context, the statutes of Chinese universities often need to be attached as supplementary agreements to formal cooperation agreements. The formulation of the statutes of Chinese universities generally involves an overview of their development process, the characteristics of running schools and the specific regulations governing internal affairs. The purpose of this paper is to study the translation of the articles of association of North China University of Water Conservancy and Hydropower from Chinese to English, and put forward some applicable translation strategies for the problems arising in the translation. According to the typology theory and the views of the representative theorists Rice and Newmark, the author finds that there are differences between the two theorists in the classification of legal texts, which affects the application of translation methods. In addition, this paper focuses on the analysis of difficulties in English translation and the resolution of difficult chapters with examples. The author lists the difficulties in translation such as flowing sentences, non-subject sentences and four-character Chinese characters and the possible translation methods such as addition, voice conversion and part-of-speech conversion.
