【摘要】：中國的對外開放吸引了越來越多的外國企業(yè)在中國落戶,外國企業(yè)大量雇傭中國員工,民事糾紛數(shù)量不斷上升。此類案件中,原告多為中國員工,被告多為外國公司負(fù)責(zé)人,涉及兩種文化,兩種甚至多種法律體系。法庭口譯是當(dāng)事人權(quán)利的重要保證也是實現(xiàn)法律平等的重要手段。本文分析的是2016年4月29日作者參與的法庭聽證會口譯項目,其中還涉及庭審前對于庭審材料的翻譯等其他準(zhǔn)備過程。通過對本項目過程的回顧,以及對本次口譯實踐的分析,報告重點討論了法庭口譯獨特的兩個方面:法庭口譯員的口譯要求以及口譯員角色的轉(zhuǎn)換。報告表明,法庭聽證會口譯遵循一套獨特的行為標(biāo)準(zhǔn),關(guān)乎法庭正義的申張。口譯員要在口譯前做好充分準(zhǔn)備。在庭審過程中要嚴(yán)格遵循忠實、保密、公正的原則以遵循職業(yè)操守,并完成信息傳遞者、文化中間人和緊張形勢調(diào)節(jié)者間角色的轉(zhuǎn)換。報告期待為未來法庭聽證會口譯的理論研究和實踐提供有益參考。
[Abstract]:China's opening to the outside world has attracted more and more foreign companies to settle in the country, employing large numbers of Chinese workers and increasing the number of civil disputes. In such cases, the plaintiffs are mostly Chinese employees and the defendants are mostly foreign company leaders, involving two cultures, two or more legal systems. Court interpretation is not only an important guarantee of the parties' rights, but also an important means to realize the equality of the law. This paper analyzes the interpretation project of the court hearing which the author participated in on April 29, 2016, which also involves other preparatory processes such as the translation of the trial materials before the trial. Based on the review of the project and the analysis of the interpretation practice, the report focuses on two unique aspects of court interpretation: the interpretation requirements of court interpreters and the conversion of interpreters' roles. The report shows that court hearing interpreters follow a unique set of standards of conduct that are relevant to court justice. Interpreters should be well prepared for interpretation. The principles of faithfulness, confidentiality and impartiality should be strictly followed in the course of the trial, and the roles of the information transmitter, the cultural intermediary and the moderator of the tense situation should be changed. The report looks forward to providing useful reference for the theoretical research and practice of court hearing interpretation in the future.
