【摘要】：以here-,there-,where-及介詞后綴構(gòu)成的古體詞是法律英語(yǔ)中的常見(jiàn)表達(dá),但在“簡(jiǎn)明英語(yǔ)運(yùn)動(dòng)”的影響下,該類(lèi)詞匯逐漸不受關(guān)注,在法律文本中僅保留最常見(jiàn)的用法。雖然國(guó)內(nèi)很多法律翻譯研究涉及法律術(shù)語(yǔ)或詞匯的翻譯,但鮮有研究專(zhuān)門(mén)針對(duì)here-,there-,where-及介詞后綴構(gòu)成的古體詞展開(kāi),更未有從語(yǔ)料庫(kù)方法、通過(guò)信息橋理論視角進(jìn)行探討�；诖�,本文選取美國(guó)官方法律原文和中國(guó)人大網(wǎng)的官方英譯各130多萬(wàn)詞作為語(yǔ)料,以探究古體詞在權(quán)威立法法律文本中的使用情況。本文首先從中美立法機(jī)構(gòu)官網(wǎng)搜集官方法律原文和英譯,建立兩個(gè)可比語(yǔ)料庫(kù),再通過(guò)語(yǔ)料庫(kù)分析軟件檢索出兩個(gè)語(yǔ)料庫(kù)古體詞的使用詞頻,分析詞匯搭配,對(duì)古體詞進(jìn)行具體的分類(lèi);其次,本文分析了法律英語(yǔ)中最常見(jiàn)古體詞“thereof”和“hereby”在兩個(gè)語(yǔ)料庫(kù)中的不同用法,歸納出兩個(gè)語(yǔ)料庫(kù)對(duì)特定古體詞使用的共性和差異;最后,通過(guò)信息橋理論視角闡釋所發(fā)現(xiàn)語(yǔ)言現(xiàn)象在社會(huì)文化體系、語(yǔ)言規(guī)約方面的成因。通過(guò)上述研究,作者發(fā)現(xiàn):(1)古體詞在中美權(quán)威的立法文本當(dāng)中的使用頻率較低,約為千分之一,僅保留了最常見(jiàn)的法律古體詞,可以把這些古體詞分為四大類(lèi);英譯古體詞使用相對(duì)較少。(2)美國(guó)法典靈活使用“hereby”,簡(jiǎn)化使用“thereof”,而中國(guó)法律英譯則簡(jiǎn)化使用“hereby”,而靈活使用“thereof”。(3)本文通過(guò)信息模型視角,從社會(huì)文化體系和語(yǔ)言規(guī)約兩個(gè)角度闡釋了上述現(xiàn)象產(chǎn)生的原因。
[Abstract]:The ancient words composed of here-there-where- and preposition suffixes are common expressions in legal English, but under the influence of the "concise English movement", these words have gradually gone unnoticed. Although many legal translation studies in China involve the translation of legal terms or words, few studies have been devoted to the development of archaic words composed of here-there-where- and prepositional suffixes, not to mention the corpus-based approach. From the perspective of information bridge theory, this paper selects more than 1.3 million words each of the original official laws of the United States and the official English translation of the Chinese National people's Congress as the corpus. In order to explore the usage of classical Chinese words in authoritative legislative texts, this paper first collects official legal texts and English translations from the official websites of Chinese and American legislatures, and sets up two comparable corpora. Then through the corpus analysis software to retrieve the use frequency of the two corpus words, analyze the collocation of words, carry on the concrete classification to the ancient type words; secondly, This paper analyzes the different usage of the most common ancient style words "thereof" and "hereby" in the two corpora in legal English, and concludes the commonness and difference between the two corpora in the use of specific ancient style words. From the perspective of information bridge theory, the author explains the causes of the language phenomenon in the sociocultural system and language regulation. Through the above research, the author finds that the use of the ancient style words in the authoritative legislative texts of China and the United States is relatively low. About 1/1000, only retained the most common ancient legal style words, can be divided into four categories of these ancient style words; "hereby" and "thereof" are used flexibly in the United States Code, while the English translation of Chinese laws simplifies the use of "hereby" and the flexible use of "thereof". The causes of the above phenomenon are explained from the two angles of sociocultural system and language regulation.
