公平視角下社會(huì)養(yǎng)老保險(xiǎn)制度分析

【摘要】:本論文嘗試以法學(xué)的社會(huì)養(yǎng)老保險(xiǎn)權(quán)的內(nèi)容為切入點(diǎn),從管理學(xué)的公平視角對(duì)我國(guó)社會(huì)養(yǎng)老保險(xiǎn)制度的公平性進(jìn)行分析,針對(duì)缺失的公平價(jià)值內(nèi)容完善我國(guó)社會(huì)養(yǎng)老保險(xiǎn)制度,并圍繞新型社會(huì)養(yǎng)老保險(xiǎn)制度的實(shí)施設(shè)置相關(guān)的配套措施。本文首先分析社會(huì)養(yǎng)老保險(xiǎn)制度的產(chǎn)生與發(fā)展過(guò)程,總結(jié)當(dāng)代社會(huì)養(yǎng)老保險(xiǎn)制度的主要內(nèi)容在于實(shí)現(xiàn)社會(huì)成員的社會(huì)養(yǎng)老保險(xiǎn)權(quán),在對(duì)其定義進(jìn)行界定的基礎(chǔ)上,再對(duì)社會(huì)養(yǎng)老保險(xiǎn)權(quán)的權(quán)利性質(zhì)及社會(huì)養(yǎng)老保險(xiǎn)權(quán)的權(quán)利結(jié)構(gòu)進(jìn)行分析,指出社會(huì)養(yǎng)老保險(xiǎn)權(quán)是一種普通法律權(quán)利;是一種社會(huì)性權(quán)利;是一種期待性權(quán)利,內(nèi)容包含參加權(quán)、受益權(quán)和監(jiān)管權(quán)。通過(guò)對(duì)公平價(jià)值哲學(xué)基礎(chǔ)的分析,總結(jié)公平價(jià)值是社會(huì)養(yǎng)老保險(xiǎn)制度的核心價(jià)值,包括強(qiáng)制參加公平、強(qiáng)制矯正公平、協(xié)議性公平和強(qiáng)制需求價(jià)值。將公平價(jià)值的四項(xiàng)內(nèi)容與社會(huì)養(yǎng)老保險(xiǎn)權(quán)的內(nèi)容相結(jié)合對(duì)我國(guó)現(xiàn)行社會(huì)養(yǎng)老保險(xiǎn)制度中符合公平價(jià)值的內(nèi)容進(jìn)行總結(jié)。其次,在對(duì)我國(guó)現(xiàn)行社會(huì)養(yǎng)老保險(xiǎn)制度中符合公平價(jià)值的內(nèi)容進(jìn)行總結(jié)后,進(jìn)一步對(duì)我國(guó)現(xiàn)行社會(huì)養(yǎng)老保險(xiǎn)制度的公平性問(wèn)題進(jìn)行分析。我國(guó)現(xiàn)行社會(huì)養(yǎng)老保險(xiǎn)制度公平性問(wèn)題主要包括:城鄉(xiāng)居民社會(huì)養(yǎng)老保險(xiǎn)參加權(quán)制度違背強(qiáng)制參加公平;城鄉(xiāng)居民社會(huì)養(yǎng)老保險(xiǎn)受益權(quán)內(nèi)容背離協(xié)議性公平及強(qiáng)制需求價(jià)值;職工社會(huì)養(yǎng)老保險(xiǎn)權(quán)之義務(wù)主體繳費(fèi)率背離協(xié)議性公平;社會(huì)養(yǎng)老保險(xiǎn)受益權(quán)之養(yǎng)老金替代率偏離強(qiáng)制矯正公平;社會(huì)養(yǎng)老保險(xiǎn)受益權(quán)取得條件之年齡背離協(xié)議性公平;社會(huì)養(yǎng)老保險(xiǎn)權(quán)其他內(nèi)容的缺失違反公平價(jià)值的強(qiáng)制性。再次,在對(duì)公平視角下完善我國(guó)社會(huì)養(yǎng)老保險(xiǎn)制度的目標(biāo)進(jìn)行界定的基礎(chǔ)上,在新型社會(huì)養(yǎng)老保險(xiǎn)制度對(duì)"二元社會(huì)"仍具有依賴(lài)但又致力于實(shí)現(xiàn)社會(huì)養(yǎng)老保險(xiǎn)制度的公平價(jià)值的背景下,設(shè)置我國(guó)"統(tǒng)分結(jié)合型"社會(huì)養(yǎng)老保險(xiǎn)制度;針對(duì)城鄉(xiāng)居民社會(huì)養(yǎng)老保險(xiǎn)參加權(quán)制度違背強(qiáng)制參加公平問(wèn)題設(shè)置全體社會(huì)成員必須參加的國(guó)民養(yǎng)老金制度,并對(duì)國(guó)民養(yǎng)老金制度的主體、繳費(fèi)標(biāo)準(zhǔn)及水平進(jìn)行規(guī)定;針對(duì)城鄉(xiāng)居民社會(huì)養(yǎng)老保險(xiǎn)受益權(quán)內(nèi)容背離協(xié)議性公平及強(qiáng)制需求價(jià)值問(wèn)題設(shè)置新型城鄉(xiāng)居民社會(huì)養(yǎng)老保險(xiǎn)制度,將統(tǒng)籌地區(qū)上年度農(nóng)民人均純收入作為繳費(fèi)基數(shù)、設(shè)置與靈活就業(yè)人員相同的繳費(fèi)比例及基礎(chǔ)養(yǎng)老金計(jì)算方式,并對(duì)新型城鄉(xiāng)居民社會(huì)養(yǎng)老保險(xiǎn)制度統(tǒng)籌層次進(jìn)行規(guī)定;針對(duì)職工社會(huì)養(yǎng)老保險(xiǎn)權(quán)之義務(wù)主體繳費(fèi)率背離協(xié)議性公平問(wèn)題降低企業(yè)繳費(fèi)率使企業(yè)與職工共同繳費(fèi)率等于靈活就業(yè)人員的繳費(fèi)率;針對(duì)社會(huì)養(yǎng)老保險(xiǎn)受益權(quán)之養(yǎng)老金替代率偏離強(qiáng)制矯正公平問(wèn)題提高職工基本養(yǎng)老金替代率并統(tǒng)一不同類(lèi)型社會(huì)養(yǎng)老保險(xiǎn)的養(yǎng)老金替代率;針對(duì)社會(huì)養(yǎng)老保險(xiǎn)受益權(quán)取得條件之年齡背離協(xié)議性公平問(wèn)題設(shè)置男女相同的退休年齡并統(tǒng)一職工基本養(yǎng)老保險(xiǎn)與城鄉(xiāng)居民社會(huì)養(yǎng)老保險(xiǎn)的退休年齡;針對(duì)社會(huì)養(yǎng)老保險(xiǎn)權(quán)其他內(nèi)容的缺失違反公平價(jià)值的強(qiáng)制性問(wèn)題提高我國(guó)社會(huì)養(yǎng)老保險(xiǎn)立法層次并設(shè)置我國(guó)的親屬社會(huì)養(yǎng)老保險(xiǎn)受益權(quán)及社會(huì)養(yǎng)老保險(xiǎn)監(jiān)管權(quán)。最后,為了新型社會(huì)養(yǎng)老保險(xiǎn)制度的實(shí)現(xiàn),還應(yīng)該設(shè)置相應(yīng)配套措施。在加強(qiáng)國(guó)家財(cái)政責(zé)任的基礎(chǔ)上,擴(kuò)大政府規(guī)模、優(yōu)化財(cái)政支出結(jié)構(gòu),同時(shí)對(duì)社會(huì)養(yǎng)老保險(xiǎn)制度進(jìn)行監(jiān)督、改革我國(guó)現(xiàn)行戶(hù)籍及土地制度,并實(shí)施農(nóng)業(yè)現(xiàn)代化為社會(huì)養(yǎng)老保險(xiǎn)制度的實(shí)現(xiàn)提供內(nèi)在動(dòng)力。
[Abstract]:This paper tries to analyze the fairness of the social endowment insurance system from the perspective of fair management, and to perfect the social endowment insurance system of our country according to the fair value of management, and set up relevant measures around the implementation of the new social old insurance system. This article first analyzes the production and development process of the social endowment insurance system, and summarizes the main content of the contemporary social endowment insurance system is to realize social members' social endowment insurance right. On the basis of defining its definition, the right nature of social endowment insurance right and the right structure of social endowment insurance right are carried out. It is pointed out that the social endowment insurance right is a kind of ordinary legal right; it is a kind of social right; it is a kind of expectant right, which includes the right of participation, the right to benefit and the right of supervision. Through the analysis of the philosophical foundation of the fair value, it concludes that the fair value is the core value of the social endowment insurance system, including compulsory participation in fairness and compulsory correction. Fairness, agreement equity and compulsory demand value. The four contents of fair value and the content of social endowment insurance are combined to summarize the content of the current social endowment insurance system in China. Secondly, after summarizing the content of the current social endowment insurance system in accordance with the fair value of the social endowment insurance system in China, The fairness of the current social endowment insurance system in China is analyzed. The current fairness of the social endowment insurance system in China mainly includes: the participation of the urban and rural residents' social endowment insurance system violates the compulsory participation, and the benefit right of the urban and rural social endowment insurance deviates from the contractual equity and the compulsory demand value; The payment rate of the main body of the social endowment insurance is deviated from the agreement fairness; the pension replacement rate of the benefit right of the social endowment insurance deviates from the fairness of the compulsory correction; the age of the benefit of the social endowment insurance deviates from the agreement fair; the loss of the other content of the social endowment insurance is contrary to the compulsory value of the fair value. On the basis of the goal of improving the social endowment insurance system in China from a fair perspective, under the background of the new social endowment insurance system still dependent on the "two yuan society" but also committed to the realization of the fair value of the social endowment insurance system, the social old-age insurance system is set up in China, and the urban and rural residents' social insurance system is set up. The participation right system of the pension insurance is contrary to the compulsory participation of the national pension system which all the members of the society must participate in, and stipulates the standards and levels of the main body of the national pension system and the standard and level of the payment of the benefits of the social endowment insurance of urban and rural residents, which deviates from the agreement and the compulsory demand value. The new social endowment insurance system of the new urban and rural residents will set up the annual per capita net income of the farmers as the basis of payment, set the same payment ratio and the basic pension calculation method with the flexible employment personnel, and make a provision on the overall level of the social endowment insurance system of the new urban and rural residents, and the meaning of the social endowment insurance right of the workers and workers. The contribution rate of the main body is deviated from the agreement equity to reduce the payment rate of the enterprise, which makes the joint contribution rate of the enterprise and the worker equal to the payment rate of the flexible employment personnel; the pension replacement rate for the benefit of the social endowment insurance deviates from the compulsory equity problem and improves the basic pension replacement rate and unifies the different types of social pension insurance. The rate of pension replacement; the age of the same retirement age and the retirement age of the basic pension insurance and the social endowment insurance of the urban and rural residents are set up in accordance with the condition of the age for the benefit of the social pension benefit from the agreement equity. To improve the legislative level of social endowment insurance in China and to set up the right to benefit from social pension insurance and the supervision right of social endowment insurance in China. Finally, the corresponding measures should be set up for the realization of the new social endowment insurance system. On the basis of strengthening the national financial responsibility, the scale of the government and the structure of the financial expenditure should be optimized. To supervise the social endowment insurance system, reform the current household registration and land system in our country, and implement the agricultural modernization for the realization of the social endowment insurance system.
