【摘要】：隨著我國社會主義市場經濟體制的不斷完善、城市化進程的加快及舊城改造的大力進行，各地征地拆遷補償安置工作日益增多，引發(fā)的各種矛盾、糾紛也越來越多，，導致群體上訪事件的時有發(fā)生，已成為社會關注的熱點、焦點問題，征地拆遷工作關系到一個地區(qū)的發(fā)展更關系到一個地區(qū)人民未來生活，是民生的問題，并成為影響社會和諧的一個不利因素。而一個新城區(qū)征地拆遷工作順利進行的關鍵是平衡好開發(fā)建設與被拆遷居民切身利益的關系，從而實現(xiàn)和諧搬遷。因此，建立和完善征地拆遷法律法規(guī)和相關制度不但可以改善征地拆遷工作的順利進行，也可以保障被拆遷居民的合法權益和切身利益，勢在必行。 本文從廣州南沙開發(fā)區(qū)征地拆遷工作的實際出發(fā)，以征地拆遷過程中存在的問題為研究對象，在對我國臺灣征地拆遷情況分析以及可借鑒的經驗等方面，同我國的征地拆遷情況等方面進行綜合比較和借鑒。并通過對南沙開發(fā)區(qū)開發(fā)建設過程中征地拆遷的現(xiàn)狀分析，聯(lián)系南沙區(qū)征地拆遷的主要問題，提出了完善拆遷補償制度、健全信用評價、征地拆遷宣傳到位等對策。例如：征地拆遷的政策把握到位；建章立制到位；計劃臺賬落實到位；宣傳培訓到位等，以期為南沙區(qū)建設過程中征地拆遷提供參考，為國內其他開發(fā)區(qū)的征地拆遷提供借鑒。
[Abstract]:With the continuous improvement of our socialist market economy system, the acceleration of urbanization process and the vigorous implementation of the old city transformation, the number of land requisition and demolition compensation and resettlement work is increasing day by day, resulting in more and more contradictions and disputes. As a result of the frequent occurrence of group petition incidents, it has become a hot spot of social concern. The focus of the issue is that land requisition and demolition work is related to the development of a region and to the future life of the people in a region, and is a matter of people's livelihood. And become an unfavorable factor that affects social harmony. The key of a new urban land requisition and demolition work is to balance the relationship between the development and construction and the immediate interests of the residents to achieve a harmonious relocation. Therefore, it is imperative to establish and perfect the laws, regulations and related systems of land expropriation and demolition, which can not only improve the smooth progress of land requisition and relocation, but also protect the legitimate rights and interests of the residents who have been demolished. Based on the practice of land expropriation and relocation in Nansha Development Zone, this paper takes the problems in the process of land acquisition and removal as the research object, and analyzes the situation of land requisition and relocation in Taiwan and the experience that can be used for reference. Comprehensive comparison and reference with the situation of land requisition and removal in China. Based on the analysis of the current situation of land requisition and removal in Nansha Development Zone and the main problems of land requisition and removal in Nansha District, this paper puts forward some countermeasures, such as perfecting the compensation system of demolition, perfecting credit evaluation and propaganda of land requisition and removal. For example: the policy of land expropriation and removal is in place; the establishment of rules and regulations is in place; the implementation of the plan and account is in place; the propaganda and training is in place in order to provide reference for the land requisition and relocation in the construction process of Nansha district, and to provide reference for the land requisition and relocation of other domestic development zones.
