【摘要】:住房消費(fèi)信貸作為當(dāng)前社會(huì)經(jīng)濟(jì)條件下產(chǎn)生的新事物,已成為國(guó)內(nèi)住房消費(fèi)者的主流購(gòu)房方式,為房地產(chǎn)領(lǐng)域提供著主要資金來(lái)源。同時(shí),由于市場(chǎng)需求猛增和住房消費(fèi)信貸本身“量多事少”的特性,各商業(yè)銀行也爭(zhēng)相將住房消費(fèi)信貸業(yè)務(wù)發(fā)展為主要資產(chǎn)業(yè)務(wù)。我國(guó)的住房消費(fèi)信貸業(yè)務(wù)起步較晚,相對(duì)比較稚嫩,面臨著大量的風(fēng)險(xiǎn)問題,集中表現(xiàn)為相關(guān)主體信用缺失、法律法規(guī)不健全、監(jiān)管工作薄弱、銀行內(nèi)部防控存在漏洞等。因此,對(duì)這些問題進(jìn)行仔細(xì)梳理,從而探討住房消費(fèi)信貸中銀行風(fēng)險(xiǎn)的法律防范機(jī)制顯得尤為必要,本文正是基于此點(diǎn)而寫。 全文分為六個(gè)部分: 第一部分“引言”,以住房消費(fèi)信貸市場(chǎng)為視閾,闡述住房消費(fèi)信貸中銀行風(fēng)險(xiǎn)法律防范機(jī)制的理論價(jià)值和現(xiàn)實(shí)意義,介紹國(guó)內(nèi)外對(duì)該機(jī)制的研究現(xiàn)狀,說(shuō)明研究的側(cè)重點(diǎn)、思路方法與創(chuàng)新之處。 第二部分“住房消費(fèi)信貸中銀行的風(fēng)險(xiǎn)概述”,闡述住房消費(fèi)信貸的內(nèi)涵,分析銀行在住房消費(fèi)信貸中面臨的主要風(fēng)險(xiǎn)及該種風(fēng)險(xiǎn)的特殊性,為之后的研究提供理論基礎(chǔ)。 第三部分“我國(guó)住房消費(fèi)信貸中銀行風(fēng)險(xiǎn)法律防范機(jī)制的現(xiàn)狀分析”,分為兩節(jié),第一節(jié)探討了住房消費(fèi)信貸中銀行風(fēng)險(xiǎn)法律防范機(jī)制的功能,凸顯其重要性,第二節(jié)在介紹我國(guó)目前住房消費(fèi)信貸銀行風(fēng)險(xiǎn)防范機(jī)制現(xiàn)狀的基礎(chǔ)上剖析了其缺陷,銀行在住房消費(fèi)信貸市場(chǎng)面臨的種種風(fēng)險(xiǎn),都可追溯于征信系統(tǒng)不完善、法律法規(guī)不健全、監(jiān)管工作不給力、內(nèi)部防控不嚴(yán)密等防范機(jī)制的缺陷。 第四部分“國(guó)外住房消費(fèi)信貸銀行風(fēng)險(xiǎn)案例及其對(duì)我國(guó)的啟示”對(duì)美國(guó)和日本的兩次典型住房消費(fèi)信貸銀行風(fēng)險(xiǎn)案例進(jìn)行梳理,與我國(guó)的現(xiàn)有住房消費(fèi)信貸狀況進(jìn)行比較,分析產(chǎn)生風(fēng)險(xiǎn)的共同原因,得出啟示。 第五部分“完善我國(guó)住房消費(fèi)信貸中銀行風(fēng)險(xiǎn)法律防范機(jī)制的對(duì)策和建議”從五個(gè)方面深入探討了我國(guó)住房消費(fèi)信貸中銀行風(fēng)險(xiǎn)法律防范機(jī)制的完善。 第六部分“結(jié)語(yǔ)”,進(jìn)一步凸出完善住房消費(fèi)信貸中銀行風(fēng)險(xiǎn)法律防范機(jī)制的重要性,并說(shuō)明該問題的解決不是一蹴而就而是需要持久和不懈的努力。
[Abstract]:As a new thing produced under the current social and economic conditions, housing consumption credit has become the mainstream housing purchase method for domestic housing consumers, and it provides the main source of funds for the real estate field. Due to the rapid increase of market demand and the characteristics of "more and less" of housing consumption credit itself, commercial banks are also scrambling to develop the housing consumption credit business into the main asset business. The housing consumption credit business in our country started relatively late. Relatively immature, facing a large number of risk problems, concentrated on the lack of credit related to the main body, laws and regulations are not perfect, supervision is weak, there are loopholes in the bank internal prevention and control, and so on. It is particularly necessary to discuss the legal prevention mechanism of bank risk in the housing consumption credit. This paper is based on this point. The full text is divided into six parts: The first part "introduction", taking the housing consumption credit market as the visual threshold, expounds the theoretical value and practical significance of the legal prevention mechanism of bank risk in the housing consumption credit, and introduces the current situation of the research on this mechanism at home and abroad. Explain the focus of the study, thinking methods and innovations. In the second part, "Overview of Bank risk in Housing consumption Credit", it expounds the connotation of housing consumption credit, analyzes the main risks faced by banks in housing consumption credit and the particularity of this kind of risk. To provide a theoretical basis for the subsequent research. The third part is "the analysis of the present situation of the legal prevention mechanism of bank risk in the housing consumption credit in China", which is divided into two sections. The first section discusses the function of the legal prevention mechanism of the bank risk in the housing consumption credit. Highlight its importance, the second section introduces the current situation of housing consumption credit bank risk prevention mechanism based on the analysis of its defects, banks in the housing consumption credit market facing a variety of risks. It can be traced back to the defects of the credit system, laws and regulations, supervision, internal prevention and control. Part 4th, "the risk cases of Foreign Housing consumption Credit Banks and their Enlightenment to China", combs the two typical housing consumer credit bank risk cases in the United States and Japan. Compared with the existing housing consumption credit in China, the author analyzes the common causes of the risk and draws inspiration. In the 5th part, the author probes into the perfection of the legal prevention mechanism of bank risk in China's housing consumption credit from five aspects: the countermeasures and suggestions of perfecting the legal prevention mechanism of bank risk in China's housing consumption credit. The conclusion of the 6th part further highlights the importance of perfecting the legal prevention mechanism of bank risk in the housing consumption credit, and explains that the solution to this problem is not overnight but requires sustained and unremitting efforts.
