我國房地產(chǎn)信托兌付危機(jī)法律問題研究

【摘要】:2010年以來,房地產(chǎn)信托規(guī)模一直保持快速增長,然而,在國家持續(xù)的房地產(chǎn)行業(yè)的調(diào)控措施下,房地產(chǎn)行業(yè)的發(fā)展模式也在悄然發(fā)生著變化,原有發(fā)展模式的風(fēng)險(xiǎn)也逐步顯現(xiàn)出來。2013年,涉及房地產(chǎn)信托產(chǎn)品的兌付金額有望達(dá)到4000億元,規(guī)模將接近2012年的兩倍,特別是隨著2013年第二季度兌付洪峰的來臨,與之而來的法律問題層出不窮,,本文將分四章進(jìn)行討論分析。 從我國房地產(chǎn)市場(chǎng)的現(xiàn)實(shí)情況入手,進(jìn)而擴(kuò)充到我國房地產(chǎn)信托市場(chǎng)所現(xiàn)存的各類系統(tǒng)風(fēng)險(xiǎn)和非系統(tǒng)風(fēng)險(xiǎn)。第二章從近期可能出現(xiàn)的大規(guī)模房地產(chǎn)信托兌付危機(jī)現(xiàn)狀入手,結(jié)合政策法律因素和市場(chǎng)因素對(duì)其形成原因進(jìn)行分析,同時(shí)采取案例分析方法。第三章主要闡述我國目前對(duì)房地產(chǎn)信托兌付危機(jī)的防范和監(jiān)管。第四章對(duì)我國房地產(chǎn)信托的監(jiān)管及相關(guān)創(chuàng)新提出了一些新想法。 筆者認(rèn)為目前房地產(chǎn)信托出現(xiàn)大規(guī)模兌付危機(jī)的可能性不大,但對(duì)此方面的法律監(jiān)管卻不可松懈,需從信托行業(yè)加強(qiáng)內(nèi)部監(jiān)管入手,同時(shí)輔以監(jiān)管層面的法律政策調(diào)控,使我國的房地產(chǎn)信托行業(yè)進(jìn)一步蓬勃發(fā)展。
[Abstract]:Since 2010, the scale of real estate trust has maintained a rapid growth. However, with the continuous regulation and control measures of the real estate industry, the development mode of the real estate industry is quietly changing. The risks of the original development model are also emerging. In 2013, the amount of repayments involving real estate trust products is expected to reach 400 billion yuan, which will be nearly twice the size of 2012, especially with the arrival of the Hong Feng payment in the second quarter of 2013. With the emerging of legal problems, this paper will be divided into four chapters to discuss and analyze. Starting with the reality of the real estate market in our country, it extends to all kinds of system risk and non-system risk existing in the real estate trust market of our country. The second chapter starts with the present situation of the large scale real estate trust payment crisis in the near future, analyzes the reasons for its formation by combining the policy and legal factors and the market factors, and adopts the case analysis method at the same time. The third chapter mainly elaborates our country to the real estate trust payment crisis prevention and the supervision. Chapter four puts forward some new ideas on the supervision and innovation of real estate trust in our country. The author thinks that there is little possibility of large-scale payment crisis in real estate trust at present, but the legal supervision in this respect cannot be relaxed. It is necessary to strengthen the internal supervision in the trust industry, and at the same time, to adjust and control the legal policy at the level of supervision. Make our country's real estate trust industry to further flourish.
