【摘要】:農(nóng)地流轉(zhuǎn)是解決“三農(nóng)”問題的關(guān)鍵,推動(dòng)農(nóng)業(yè)產(chǎn)業(yè)升級(jí),促進(jìn)農(nóng)村經(jīng)濟(jì)發(fā)展,需要走一條現(xiàn)代化規(guī)模經(jīng)營的道路,農(nóng)地流轉(zhuǎn)是使農(nóng)地規(guī);\(yùn)作的最有效手段,充分發(fā)揮農(nóng)地流轉(zhuǎn)的作用,需要巨額的資金支持。傳統(tǒng)的融資方式有諸多弊端,而作為新興融資方式的土地證券化便脫穎而出。本文通過對農(nóng)村土地證券化這種農(nóng)村金融創(chuàng)新方式的研究來破解農(nóng)村土地流轉(zhuǎn)及流轉(zhuǎn)之后土地規(guī)模經(jīng)營、農(nóng)業(yè)產(chǎn)業(yè)化經(jīng)營資金短缺的難題,以期達(dá)到實(shí)現(xiàn)農(nóng)業(yè)現(xiàn)代化,提高農(nóng)民收入水平,縮小城鄉(xiāng)差距,為解決“三農(nóng)”問題盡一份綿薄之力。 本文主要運(yùn)用跨學(xué)科研究、理論與調(diào)查研究相結(jié)合等研究方法。“證券化”本身是一個(gè)金融學(xué)研究的范疇,但土地證券化又離不開法學(xué)的研究,文章內(nèi)容還涉及產(chǎn)權(quán)等新制度經(jīng)濟(jì)學(xué)以及福利經(jīng)濟(jì)學(xué)的內(nèi)容。所以,對農(nóng)村土地證券化的研究必須從經(jīng)濟(jì)學(xué)、金融學(xué)、會(huì)計(jì)學(xué)和法學(xué)等學(xué)科多角度綜合研究。通過直接的鄉(xiāng)村實(shí)地調(diào)查、設(shè)計(jì)調(diào)查問卷及間接的信息搜集、事后數(shù)據(jù)處理,了解農(nóng)民、企業(yè)和政府對農(nóng)村土地證券化的理解和反應(yīng)。同時(shí)運(yùn)用經(jīng)濟(jì)學(xué)的理論,認(rèn)真分析實(shí)地調(diào)研所獲得的數(shù)據(jù)與資料,形成自己的結(jié)論。 本文首先對國內(nèi)外有關(guān)文獻(xiàn)進(jìn)行綜述,包括國外資產(chǎn)證券化和不動(dòng)產(chǎn)證券化的研究以及國內(nèi)農(nóng)村土地證券化的研究進(jìn)展,然后,對基本概念進(jìn)行界定并闡述基礎(chǔ)理論。以此為出發(fā)點(diǎn),在借助對國外不動(dòng)產(chǎn)證券化和國內(nèi)未來收益證券化實(shí)踐經(jīng)驗(yàn)以及我國特殊農(nóng)村土地制度與政策的研究,認(rèn)識(shí)農(nóng)村土地證券化的必要性與可行性。之后,在闡述資產(chǎn)證券化原理與各主體的基礎(chǔ)上,研究農(nóng)村土地證券化模式,結(jié)合土地流轉(zhuǎn)和農(nóng)業(yè)產(chǎn)業(yè)化經(jīng)營,,著重分析論證以農(nóng)業(yè)企業(yè)(土地使用者)為發(fā)起者的土地未來收益為擔(dān)保這種證券化模式。之后,進(jìn)行農(nóng)村土地證券化的技術(shù)分析——定價(jià)分析,詳細(xì)論述土地流轉(zhuǎn)中對農(nóng)民的補(bǔ)償定價(jià),“增人增補(bǔ)償,減人減補(bǔ)償”這種農(nóng)村土地流轉(zhuǎn)補(bǔ)償定價(jià)方式也是本文的創(chuàng)新點(diǎn)。 本文研究的主要結(jié)論是農(nóng)村土地流轉(zhuǎn)與農(nóng)村土地證券化是兩階段的關(guān)系,土地流轉(zhuǎn)是第一階段,土地證券化是第二階段,將土地收益證券化是為了解決土地流轉(zhuǎn)之后的農(nóng)地規(guī)模經(jīng)營和農(nóng)業(yè)產(chǎn)業(yè)化經(jīng)營的資金短缺問題。農(nóng)村土地證券化將會(huì)對傳統(tǒng)意義上的資產(chǎn)證券化理論有所突破,在實(shí)踐中存在諸多障礙,農(nóng)村土地證券化的順利實(shí)施,需要理論上的創(chuàng)新,制度、法律、政策等保障并大膽實(shí)踐。
[Abstract]:Agricultural land circulation is the key to solve the problem of "agriculture, rural areas and farmers". To promote the upgrading of agricultural industry and the development of rural economy, it is necessary to take a road of modern scale management. Agricultural land transfer is the most effective means to make the scale of farmland operation. It needs a huge amount of financial support to give full play to the role of agricultural land transfer. There are many drawbacks in the traditional financing method. Land securitization as a new form of financing will stand out. Through the study of rural land securitization the rural financial innovation to solve the rural land circulation and land scale management after the circulation. In order to realize the modernization of agriculture, raise the income level of farmers, narrow the gap between urban and rural areas, we can do our best to solve the problem of agriculture, rural areas and farmers. This paper mainly uses interdisciplinary research, theory and investigation and other research methods. "Securitization" itself is a financial research category, but land securitization can not be separated from the study of law. The content of the article also involves the contents of new institutional economics such as property rights and welfare economics. Therefore, the study of securitization of rural land must be based on economics and finance. Through the direct rural field investigation, the design questionnaire and indirect information collection, afterwards the data processing, understands the farmer. The understanding and response of enterprises and governments to the securitization of rural land. At the same time, by using the theory of economics, the data and data obtained from the field investigation are carefully analyzed, and their own conclusions are reached. This paper first reviews the relevant literature at home and abroad, including the study of foreign asset securitization and real estate securitization as well as the research progress of domestic rural land securitization, and then. To define the basic concepts and elaborate the basic theory, as a starting point, with the help of foreign real estate securitization and domestic future income securitization practical experience as well as China's special rural land system and policy research. After understanding the necessity and feasibility of rural land securitization, on the basis of expounding the principle and main body of asset securitization, the paper studies the mode of rural land securitization, combining land circulation and agricultural industrialization management. Focus on the analysis of agricultural enterprises (land users) as the initiator of land as the guarantee of the securitization model. After that, the rural land securitization technical analysis-pricing analysis. This paper discusses in detail the compensation pricing for farmers in the land circulation. "increasing people compensation, reducing people compensation", the rural land circulation compensation pricing method is also the innovation of this article. The main conclusion of this paper is that the relationship between rural land circulation and rural land securitization is two stages, land circulation is the first stage, and land securitization is the second stage. The purpose of securitization of land income is to solve the problem of capital shortage of agricultural land scale management and agricultural industrialization management after land circulation. Rural land securitization will break through the theory of asset securitization in the traditional sense. There are many obstacles in practice, the smooth implementation of rural land securitization needs theoretical innovation, system, law, policy and other safeguards and bold practice.
