【摘要】：空白票據(jù)制度產(chǎn)生于商事活動(dòng)中,交易當(dāng)事人基于對(duì)彼此的信任為了交易方便,同時(shí)提高票據(jù)的流通效率,采用了空白票據(jù)制度�？瞻灼睋�(jù)順應(yīng)了市場(chǎng)經(jīng)濟(jì)發(fā)展,突破了傳統(tǒng)票據(jù)理論的要式性。票據(jù)的效力受票據(jù)形式性影響,絕對(duì)必要記載事項(xiàng)空白的票據(jù),因未滿足形式要件,將被認(rèn)定為無(wú)效票據(jù)。然而,實(shí)際生活中,出票人和收款人往往有不同的目的和要求,傳統(tǒng)的票據(jù)形式已經(jīng)不能滿足出票人、收款人或者第三方交易人對(duì)交易多樣性的要求�？瞻灼睋�(jù)補(bǔ)充權(quán)對(duì)空白票據(jù)來(lái)說(shuō)至關(guān)重要,它關(guān)乎著空白票據(jù)的存在與適用。我國(guó)《票據(jù)法》對(duì)空白票據(jù)制度規(guī)定過(guò)于簡(jiǎn)單,僅允許空白支票的存在,對(duì)空白補(bǔ)充權(quán)的規(guī)定幾乎沒(méi)有涉及,已無(wú)法解決現(xiàn)實(shí)生活中的問(wèn)題。因此,對(duì)空白票據(jù)及空白補(bǔ)充權(quán)等問(wèn)題進(jìn)行探討,已顯得非常有必要。本文著重分析要式性與自治性視野下的補(bǔ)充權(quán)、空白補(bǔ)充權(quán)的立法比較、票據(jù)關(guān)系人的法律地位等內(nèi)容,希望能全面認(rèn)識(shí)空白補(bǔ)充權(quán)這一問(wèn)題,為完善我國(guó)空白補(bǔ)充權(quán)制度貢獻(xiàn)一份力量。本文主要分為以下四個(gè)部分:文章的第一部分,從票據(jù)的要式性與自治性視野下審視補(bǔ)充權(quán),總結(jié)補(bǔ)充權(quán)涉及的重要理論問(wèn)題,從該視角理解空白補(bǔ)充權(quán)制度。文章的第二部分,比較空白補(bǔ)充權(quán)的立法模式。本部分討論了域外立法對(duì)空白補(bǔ)充權(quán)采用的立法模式,并對(duì)我國(guó)立法上空白補(bǔ)充權(quán)進(jìn)行梳理。文章的第三部分,分析票據(jù)關(guān)系人之間的法律地位。通過(guò)對(duì)出票人、補(bǔ)充權(quán)人和后手持票人主要票據(jù)當(dāng)事人在補(bǔ)充權(quán)行使過(guò)程中的權(quán)利義務(wù)關(guān)系分析,討論在不同情形下行使補(bǔ)充權(quán)時(shí)各票據(jù)關(guān)系人的法律地位。文章的最后一部分,空白票據(jù)補(bǔ)充權(quán)的立法建議。希望通過(guò)對(duì)整篇文章的討論,最終提出有價(jià)值的法律建議。
[Abstract]:The blank bill system comes into being in commercial activities, the parties to the transaction based on mutual trust in order to facilitate the transaction, while improving the efficiency of the circulation of bills. The blank bill system is adopted. The blank bill conforms to the development of market economy and breaks through the requirement of the traditional bill theory. The effectiveness of the bill is influenced by the form of the bill and it is absolutely necessary to record the blank bill. However, in real life, the drawer and the payee often have different purposes and requirements, the traditional form of the bill can no longer meet the drawer. Requirements for diversity of transactions by payees or third-party traders. The right to supplement blank instruments is essential to blank instruments. It is related to the existence and application of blank instruments. The system of blank instruments is too simple to be stipulated in the Bill Law of our country, only the existence of blank checks is allowed, and the provisions on blank supplementary rights are hardly involved. There is no solution to the problems in real life. Therefore, it is very necessary to discuss the blank bill and blank supplementary right. This paper focuses on the analysis of complementary rights from the perspective of essentialism and autonomy. The legislation comparison of blank supplementary right, the legal status of the bill relation person and so on, hope to understand the blank supplementary right in an all-round way. This paper is divided into the following four parts: the first part of the article examines the supplementary right from the perspective of bill style and autonomy. Summary of the important theoretical issues involved in the right to supplement, from this perspective to understand the blank right to supplement the system. The second part of the article. This part discusses the legislative mode adopted by the extraterritorial legislation to the blank supplementary right, and combs the blank supplementary right in our legislation. The third part of the article. This paper analyzes the legal status of the bill parties. Through the analysis of the rights and obligations of the main parties to the bill in the process of exercising the supplementary rights, the author analyzes the rights and obligations of the principal parties to the bill in the exercise of the supplementary rights. The last part of the article, the legislative suggestion of the blank bill supplementary right. Hope to pass the discussion of the whole article. Finally put forward valuable legal advice.
