【摘要】：公路交通管理系統(tǒng)內(nèi)，由于歷史的原因，中國行政管理學(xué)和行政法學(xué)理論的研究相對滯后，許多行政法律法規(guī)都是在行政理論準(zhǔn)備不充足的情況下制定的，這導(dǎo)致了包括《中華人民共和國公路法》（以下簡稱《公路法》）在內(nèi)的多部相關(guān)法律、法規(guī)都對路政管理的理解過于狹隘，誤認(rèn)為保護(hù)公路路產(chǎn)、路權(quán)或公路執(zhí)法就是路政管理。其實(shí)，路政管理乃公路行政管理，即由政府和交通運(yùn)輸主管部門主導(dǎo)，公路管理機(jī)構(gòu)依法具體實(shí)施的公路規(guī)劃實(shí)施、建設(shè)管理（含設(shè)計(jì)審查和質(zhì)量監(jiān)督）、養(yǎng)護(hù)管理、保護(hù)、收費(fèi)管理、通訊管理、經(jīng)營服務(wù)管理等綜合行政管理。 中國國內(nèi)學(xué)者的研究基本都是基于現(xiàn)有的狹隘路政管理范疇展開的，對路政管理的范疇界定過于狹隘，這導(dǎo)致很多的問題，如行政職能界定不清、部門領(lǐng)導(dǎo)權(quán)力過大、行政行為缺乏法律監(jiān)督等。筆者對國外發(fā)達(dá)國家的公路管理情況進(jìn)行研究，發(fā)現(xiàn)像美國、英國、法國這樣的發(fā)達(dá)國家并沒有“路政管理”這一專有名詞，而是從對公路的全面行政角度來實(shí)現(xiàn)和演繹路政管理范疇的。在大部制改革的趨勢下，我國的路政管理范疇不應(yīng)僅僅局限在公路執(zhí)法上，而要借鑒美英法三國的公路行政管理經(jīng)驗(yàn)，樹立路政管理即是公路行政管理的理念。 本文從行政管理學(xué)和行政法學(xué)的角度對“路政”即為“公路行政”進(jìn)行雙重論證。最后，對公路行政管理范疇重新界定后的相關(guān)問題進(jìn)行解決，提出公路管理機(jī)構(gòu)改革和相關(guān)法律、法規(guī)完善的建議，并做出總結(jié)，，得出研究結(jié)論。
[Abstract]:In the highway traffic management system, due to historical reasons, the study of administrative management and the theory of administrative law in China lags behind. Many administrative laws and regulations are formulated under the condition that the administrative theory is not adequately prepared. This has led to many related laws, including the Highway Law of the people's Republic of China (hereinafter referred to as the Highway Law), which have too narrow an understanding of road administration, and mistakenly believe that the protection of highway property, the right of road or the enforcement of highway law is the administration of road administration. In fact, highway administration is highway administration, that is, highway planning and construction management (including design review and quality supervision, maintenance management, protection, etc.), which is led by the government and the transportation department, and carried out by highway management agencies according to law. Charge management, communication management, business service management and other integrated administration. The research of domestic scholars in China is basically based on the existing narrow scope of road management. The definition of road management is too narrow, which leads to a lot of problems, such as unclear definition of administrative functions, excessive power of leading departments. The administrative action lacks the legal supervision and so on. The author studies the road management situation in developed countries, and finds that developed countries such as the United States, Britain and France do not have the proper term "road administration". But from the road of the overall administrative perspective to achieve and deduce the category of road management. Under the trend of the reform of the large department system, the category of road administration in our country should not only be confined to the enforcement of highway law, but also draw lessons from the experience of highway administration in the United States, Britain and France, and establish the idea that road administration is the road administration. From the angle of administrative management and administrative law, this paper demonstrates that "road administration" is "highway administration". Finally, the paper solves the related problems after redefining the category of highway administration, puts forward some suggestions on the reform of highway management organization and the improvement of relevant laws and regulations, and makes a summary, and draws the conclusion of the research.
