【摘要】：近年來,我國市場經(jīng)濟(jì)發(fā)展處于調(diào)整階段,產(chǎn)業(yè)改造不斷深入和拓展,產(chǎn)品質(zhì)量整體得上到了提升,“中國制造”逐漸走向世界。區(qū)域性產(chǎn)品質(zhì)量缺陷明顯減少,但假冒偽劣屢禁不止的問題仍較突出,質(zhì)量安全形勢依然嚴(yán)峻,作為產(chǎn)品質(zhì)量安全和特種設(shè)備安全主要監(jiān)管力量的質(zhì)量技術(shù)監(jiān)督部門,作用愈發(fā)被凸顯出來。質(zhì)量技術(shù)監(jiān)督行政執(zhí)法機(jī)構(gòu)是履行執(zhí)法打假、為消費(fèi)者和守法經(jīng)營者保駕護(hù)航、保護(hù)經(jīng)濟(jì)秩序良性運(yùn)行的重要力量。在行政執(zhí)法工作的具體實(shí)踐中,部分基層質(zhì)量技術(shù)監(jiān)督行政執(zhí)法機(jī)構(gòu)不能及時(shí)調(diào)整工作思路,存在著一些不足,亟待重視和加以解決。根據(jù)質(zhì)量技術(shù)監(jiān)督系統(tǒng)現(xiàn)行的管理體制模式,通過調(diào)查問卷和訪談等方式,對(duì)于LS縣質(zhì)量技術(shù)監(jiān)督行政執(zhí)法機(jī)構(gòu)工作中存在的問題進(jìn)行探討和分析,找出解決問題的針對(duì)性對(duì)策,希望能夠促進(jìn)LS縣質(zhì)量技術(shù)監(jiān)督行政執(zhí)法機(jī)構(gòu)的工作方向和工作方法不斷進(jìn)行調(diào)整和完善,進(jìn)一步提高其行政執(zhí)法效能,更好地維護(hù)人民群眾身體健康和財(cái)產(chǎn)安全,服務(wù)經(jīng)濟(jì)社會(huì)發(fā)展,同時(shí)為其他基層行政執(zhí)法機(jī)構(gòu)提供借鑒,具有一定的現(xiàn)實(shí)意義和理論意義。本論文以行政管理學(xué)、質(zhì)量管理學(xué)、經(jīng)濟(jì)學(xué)為理論指導(dǎo),運(yùn)用實(shí)地走訪、調(diào)查問卷、實(shí)證等研究方法,把LS縣質(zhì)量技術(shù)監(jiān)督行政執(zhí)法機(jī)構(gòu)開展行政執(zhí)法工作的過程,看成是產(chǎn)品生產(chǎn)和輸出的過程,最終的行政執(zhí)法效能就是其生產(chǎn)和輸出的產(chǎn)品,利用博弈論的分析工具,對(duì)于影響行政執(zhí)法效能的多種因素進(jìn)行詳細(xì)分析和探討,針對(duì)LS縣質(zhì)量技術(shù)監(jiān)督行政執(zhí)法機(jī)構(gòu)存在的問題提出有針對(duì)性的對(duì)策。論文的第一部分對(duì)開展本次調(diào)查研究的背景、研究意義、研究主要內(nèi)容、所采用的方法和質(zhì)量技術(shù)監(jiān)督行政執(zhí)法領(lǐng)域的進(jìn)展情況進(jìn)行簡述。第二部分對(duì)質(zhì)量工作、開展質(zhì)量行政執(zhí)法工作的意義和重要性進(jìn)行闡述,對(duì)行政執(zhí)法以及質(zhì)量技術(shù)監(jiān)督行政執(zhí)法方面的研究,分別就國外和國內(nèi)的研究現(xiàn)狀進(jìn)行了綜述。第三部分對(duì)LS縣域內(nèi)的產(chǎn)品質(zhì)量狀況、LS縣質(zhì)量技術(shù)監(jiān)督行政執(zhí)法工作的狀況進(jìn)行簡述。為進(jìn)一步轉(zhuǎn)變LS縣質(zhì)量技術(shù)監(jiān)督行政執(zhí)法機(jī)構(gòu)的工作作風(fēng),提高其行政執(zhí)法效能。根據(jù)在LS縣開展的201X年度民主評(píng)議政風(fēng)行風(fēng)活動(dòng)中,查找出關(guān)于LS縣質(zhì)量技術(shù)監(jiān)督行政執(zhí)法工作中存在的問題。然后針對(duì)社會(huì)多方、本單位行政執(zhí)法人員設(shè)計(jì)出相對(duì)應(yīng)的調(diào)查問卷,對(duì)收回的調(diào)查問卷反饋的問題,進(jìn)行梳理、分類、匯總,查找LS縣質(zhì)量技術(shù)監(jiān)督行政執(zhí)法工作中存在的深層次問題。第四部分按照LS縣質(zhì)量技術(shù)監(jiān)督行政執(zhí)法機(jī)構(gòu)工作中,影響其行政執(zhí)法效能的主體不同,需要處理與不同主體之間的關(guān)系,運(yùn)用博弈分析工具,對(duì)LS縣質(zhì)量技術(shù)監(jiān)督行政執(zhí)法機(jī)構(gòu)工作的具體內(nèi)容進(jìn)行博弈分析。構(gòu)建了博弈模型,著重對(duì)與行政相對(duì)人、其他行政執(zhí)法機(jī)構(gòu)、當(dāng)?shù)氐胤秸⒈締挝恍姓䦂?zhí)法人員之間的博弈關(guān)系進(jìn)行分析,找出在行政執(zhí)法工作中問題產(chǎn)生的主要原因。從LS縣質(zhì)量技術(shù)監(jiān)督行政執(zhí)法機(jī)構(gòu)的外部環(huán)境與本單位內(nèi)部環(huán)境等方面,分析了LS縣質(zhì)量技術(shù)監(jiān)督行政執(zhí)法效能不高的原因。第五部分在第四章進(jìn)行詳細(xì)分析的基礎(chǔ)上,針對(duì)查找出每一項(xiàng)問題,提出針對(duì)性強(qiáng)的解決對(duì)策,對(duì)LS縣質(zhì)量技術(shù)監(jiān)督行政執(zhí)法機(jī)構(gòu)工作的過程中涉及到的因素進(jìn)行優(yōu)化,以期生產(chǎn)出好的產(chǎn)品,即達(dá)到行政執(zhí)法效能的高效。第六部分對(duì)本篇論文進(jìn)行總結(jié)和展望。在大部制改革的趨勢下,根據(jù)基層行政執(zhí)法工作的實(shí)際情況,希望能在探求適合基層質(zhì)量技術(shù)監(jiān)督行政執(zhí)法發(fā)展的新路子等方面進(jìn)行進(jìn)一步研究和探討。
[Abstract]:In recent years, the development of China's market economy is in the stage of adjustment, and the industrial transformation is deepening and expanding, the quality of the product has been promoted, and the "made in China" has gradually moved towards the world. The quality defects of the regional products have been reduced obviously, but the problems of the counterfeit and inferior quality are still prominent, the quality and safety situation is still severe, as the quality of the product. The quality and Technical Supervision Department of safety and special equipment safety is becoming more and more important. The administrative law enforcement agency of quality technical supervision is an important force to perform the enforcement of law, to protect the consumers and law-abiding operators and to protect the economic order. The administrative law enforcement agency of the level quality technical supervision can not adjust the work train of thought in time. There are some shortcomings, which need to be paid attention to and solved. According to the current management system mode of the quality technical supervision system, the problems in the work of the administrative law enforcement agencies of LS County Quality and technology supervision are discussed through questionnaires and interviews. And to find out the pertinent countermeasures to solve the problem, and hope to improve the work direction and method of the administrative law enforcement agency of LS county quality and technology supervision, to further improve the efficiency of its administrative law enforcement, to better safeguard the health of the people and the safety of the property, to serve the economic and social development, and to serve the other bases. It is of practical and theoretical significance to provide reference for the administrative law enforcement agencies of the layer. This paper, with the guidance of the theory of administration, quality management and economics, uses field visits, questionnaires and empirical research methods to carry out the process of administrative law enforcement by the administrative law enforcement machine of quality and Technology Supervision in LS County as product production. And the process of the output, the final administrative law enforcement effectiveness is its production and output, using the analysis tool of the game theory to analyze and discuss the various factors that affect the efficiency of administrative law enforcement in detail, and put forward the pertinent countermeasures against the problems existing in the administrative law enforcement agency of LS County quality and technology supervision. The background, significance, main contents, methods used and the progress of quality and technology supervision in the field of administrative law enforcement are briefly introduced. The second part expounds the significance and importance of quality work, the importance of quality administrative law enforcement, administrative law enforcement and the administrative law enforcement Party of quality and technology supervision.
