【摘要】:由于城鎮(zhèn)化建設(shè)的推進(jìn),從上世紀(jì)九十年代以來,特別是進(jìn)入本世紀(jì)后,我國進(jìn)入了城鎮(zhèn)房屋拆遷高峰期,拆遷人與被拆遷人圍繞拆遷補(bǔ)償多少及其相應(yīng)權(quán)益保障問題,產(chǎn)生了激烈的矛盾,并不斷出現(xiàn)類似“最牛釘子戶”、“自焚”等事件,引發(fā)了一系列社會(huì)問題。在我國,城鎮(zhèn)土地屬國家所有,并由《土地法》加以規(guī)范,對城鎮(zhèn)房屋征收則由《城鎮(zhèn)房屋拆遷管理?xiàng)l例》規(guī)范,這是我國特有的征收制度。在房屋拆遷中,被拆遷人失去的不僅僅是地上的房屋,還有房屋所占的土地使用權(quán)。根據(jù)《物權(quán)法》的精神,拆遷補(bǔ)償應(yīng)對被拆遷人因房屋拆遷而造成的全部物權(quán)損失進(jìn)行足額補(bǔ)償,但《我國房屋拆遷條例》沒有將土地使用權(quán)這一獨(dú)立物權(quán)納入補(bǔ)償范圍,沒有為被拆遷人的“全面”、“足額”補(bǔ)償提供法律支持。同時(shí),在引入市場資本參與城市舊區(qū)改造后,地方政府與拆遷人利益關(guān)系日益密切,行政部門在房屋拆遷許可證發(fā)放、拆遷補(bǔ)償定價(jià)等方面,無不偏袒拆遷人。當(dāng)拆遷人與被拆遷人產(chǎn)生矛盾時(shí),行政部門則通過行政裁決方式庇護(hù)拆遷人,是典型的“自己做自己的法官”,使被拆遷人無法取得完善的法律救濟(jì)途徑作為兜底保障,這也注定拆遷人與被拆遷人利益沖突必然成為一個(gè)城市矛盾最為突出的地方。本文分析了株洲市城鎮(zhèn)房屋拆遷的主要模式,主要包括、第三方評估補(bǔ)償模式、統(tǒng)一拆遷模式、強(qiáng)制拆遷模式等,同時(shí)文章提出株洲市房屋拆遷存在拆遷信息不對稱、補(bǔ)償標(biāo)準(zhǔn)不統(tǒng)一等五個(gè)方面的主要問題。同時(shí),文章采用從經(jīng)濟(jì)學(xué)的角度出發(fā),對株洲市城鎮(zhèn)房屋拆遷主體相關(guān)三方利益和被拆遷者的利益述求進(jìn)行了深入的分析,指出了城市房屋拆遷的利益沖突的焦點(diǎn)和根源。對此,文章提出了城鎮(zhèn)房屋拆遷必須遵從的主要工作原則,提出了解決株洲市城鎮(zhèn)化房屋拆遷矛盾沖突的具體對策建議:公開拆遷信息,營造和諧輿論氛圍、制定完善的補(bǔ)償標(biāo)準(zhǔn)、強(qiáng)化對房屋拆遷中相關(guān)行為的監(jiān)管、和建立以人為本的觀念。文章的理論研究可以為解決城市拆遷矛盾沖突提供理參考建議,并可以促進(jìn)城鎮(zhèn)化建設(shè)進(jìn)程和加快推進(jìn)和諧社會(huì)的構(gòu)建。
[Abstract]:Due to the progress of urbanization, from the last century since 90s, especially after the beginning of this century, China has entered the peak period of urban housing demolition, demolition and relocation of people around the demolition compensation amount and the corresponding protection of the rights and interests of the intense contradictions, constantly appear similar to the "holdout" and "self Immolation" other events, triggered a series of social problems. In our country, urban land belongs to the state ownership and is regulated by the land law. The collection of urban housing is regulated by the regulations of urban housing demolition and management, which is a unique collection system in China. In the house demolition, the people who have been removed are not only the land on the ground, but also the right to use the land. According to the "law" of the spirit, to be paid compensation for relocation compensation for housing demolition demolition caused by all property loss, but the "Regulations" of China's housing demolition no land use rights of the independent property rights into the scope of compensation, not to be taken in the "full" and "full compensation" to provide legal support. At the same time, after introducing market capitals to participate in the transformation of urban old districts, the interests relationship between the local governments and the relocated people is more and more closely. The administrative departments are all partial to the demolition people in terms of housing demolition permit issuance, demolition compensation pricing and so on. When the demolition and relocation of people when a conflict, administrative departments through administrative adjudication protected demolition, is a typical "own judges", make the demolition unable to obtain perfect legal remedies as a fallback guarantee, which is destined to the demolition and relocation of people conflicts of interest will become a city the most prominent contradiction place. This paper analyzes the main mode of urban housing demolition in the city of Zhuzhou, including the third party evaluation, compensation mode, unified removal mode, forced relocation mode, at the same time the housing demolition of Zhuzhou city the main problems of five aspects of information asymmetry, the demolition compensation standard is not unified. At the same time, from the perspective of economics, the article makes an in-depth analysis of the three party interests and the interests of the relocated people in Zhuzhou's urban housing demolition, and points out the focus and root of the conflict of interests in the urban housing demolition. In this regard, the article puts forward the main working principle of urban housing demolition must follow, put forward specific measures and suggestions to solve the urbanization of Zhuzhou city housing demolition demolition conflict: public information, create a harmonious atmosphere of public opinion, strengthen the formulation of compensation standard, perfect concept of housing demolition related behavior supervision, and establish a people-oriented. The theoretical research of the article can provide some suggestions for solving the conflicts and conflicts in urban demolition, and promote the process of urbanization and accelerate the construction of a harmonious society.
