【摘要】：汽車租賃業(yè)在我國是新興行業(yè)，經(jīng)過二十幾年的發(fā)展，已由大城市逐步擴(kuò)展到中小城市，汽車租賃市場的不斷擴(kuò)大促使汽車租賃公司大幅增加。作為汽車租賃市場經(jīng)營主體，汽車租賃公司高效、健康、有序的運(yùn)營對(duì)我國汽車租賃業(yè)的發(fā)展起著至關(guān)重要的作用。然而，由于相關(guān)法律法規(guī)調(diào)整范圍的局限性，政府沒有對(duì)汽車租賃業(yè)進(jìn)行適當(dāng)?shù)母深A(yù)，現(xiàn)階段我國汽車租賃公司普遍存在規(guī)模小、業(yè)務(wù)雜、違規(guī)經(jīng)營等諸多問題，汽車租賃市場秩序混亂，汽車租賃公司運(yùn)營非常困難。因此，建立健全汽車租賃公司監(jiān)管法律制度，對(duì)正處于過渡階段的汽車租賃業(yè)加以規(guī)制，為汽車租賃公司創(chuàng)造良好的市場競爭環(huán)境，保障汽車租賃業(yè)可持續(xù)穩(wěn)定發(fā)展，具有現(xiàn)實(shí)意義。 論文采用的研究方法主要有比較分析法、歸納分析法、實(shí)證分析法，在吸收國內(nèi)外研究成果的基礎(chǔ)上，首先從監(jiān)管基本理論入手，，介紹了汽車租賃公司監(jiān)管的相關(guān)概念，并且分析了汽車租賃公司監(jiān)管主體、監(jiān)管內(nèi)容和方式。其次，對(duì)國外汽車租賃公司發(fā)展趨勢(shì)和相關(guān)法律法規(guī)現(xiàn)狀進(jìn)行了研究。論述了國外汽車租賃公司規(guī)�；l(fā)展對(duì)我國汽車租賃業(yè)的影響，介紹了美、日、韓汽車租賃公司監(jiān)管相關(guān)法律制度，通過對(duì)國外汽車租賃公司相關(guān)監(jiān)管法律制度的分析，點(diǎn)明了對(duì)我國的借鑒意義。再次，對(duì)我國汽車租賃公司監(jiān)管法律制度現(xiàn)狀及存在的問題進(jìn)行了分析總結(jié)，指出目前我國汽車租賃相關(guān)立法層級(jí)較低、法律依據(jù)不健全及盡快完善汽車租賃公司監(jiān)管法律制度的重要意義。最后，論文對(duì)如何完善我國汽車租賃公司監(jiān)管法律制度作出了具體分析，提出構(gòu)建汽車租賃部門法、完善地方性立法、建立汽車租賃公司市場準(zhǔn)入制度等立法建議。
[Abstract]:Automobile leasing industry is a new industry in our country. After more than 20 years' development, it has gradually expanded from big city to small and medium-sized city. The efficient, healthy and orderly operation of car rental companies plays an important role in the development of automobile leasing industry in China. However, due to the limitation of the relevant laws and regulations, the government has not intervened properly in the car leasing industry. At present, there are a lot of problems such as small scale, miscellaneous business, illegal operation and so on. The order of car rental market is chaotic, and the operation of car rental company is very difficult. Therefore, it is necessary to establish and perfect the legal system of automobile rental company supervision. It is of practical significance to regulate the automobile leasing industry which is in the transition stage, to create a good market competition environment for the car rental companies and to ensure the sustainable and stable development of the car rental industry. The main research methods adopted in this paper are comparative analysis, inductive analysis and empirical analysis. On the basis of absorbing the domestic and foreign research results, this paper first introduces the related concepts of automobile rental company supervision from the basic theory of regulation. And analyzed the main body, the content and the way of the regulation of the car rental company. Secondly, This paper studies the development trend and related laws and regulations of foreign car rental companies, discusses the impact of the large-scale development of foreign car rental companies on the automobile leasing industry in China, and introduces the United States, Japan, the United States, Japan, the United States, Japan, the United States, Japan, the United States and Japan, Korea car rental company supervision related legal system, through the analysis of foreign car rental company related regulatory legal system, points out the reference significance to our country. Again, This paper analyzes and summarizes the present situation and existing problems of the legal system of automobile rental company supervision in China, and points out that the relevant legislation level of automobile lease in our country is relatively low at present. The significance of perfecting the legal system of automobile rental company supervision is not perfect. Finally, the paper makes a concrete analysis on how to perfect the legal system of automobile rental company supervision in our country, and puts forward the construction of automobile rental law. Perfect local legislation, establish car rental company market access system and other legislative proposals.
