我國房地產(chǎn)產(chǎn)權(quán)交易保險發(fā)展研究

【摘要】:伴隨著中國經(jīng)濟的快速發(fā)展,中國的房地產(chǎn)市場逐漸繁榮發(fā)展,而近兩年,在去庫存政策和寬松的貨幣環(huán)境之下,我國房地產(chǎn)行業(yè)更是異常的火爆。然而,房地產(chǎn)行業(yè)高速發(fā)展的背后潛伏了太多的交易風(fēng)險。房地產(chǎn)行業(yè)是國民經(jīng)濟的重要組成部分,是關(guān)乎民生的重要行業(yè),而房地產(chǎn)產(chǎn)權(quán)交易的安全性是房地產(chǎn)行業(yè)健康發(fā)展的重要因素。中國的房地產(chǎn)交易,在安全性、專業(yè)性、效率等多個方面均與發(fā)達國家成熟的房地產(chǎn)交易市場相差甚遠,造成這種巨大差距的原因并不在于房產(chǎn)中介行業(yè)本身,而在于國內(nèi)的房地產(chǎn)交易市場缺失了一項極為重要的金融工具,即房地產(chǎn)產(chǎn)權(quán)交易保險。在發(fā)達國家,在房地產(chǎn)產(chǎn)權(quán)交易的保駕護航之下,房產(chǎn)交易的風(fēng)險由保險公司承擔(dān),房地產(chǎn)交易不僅高效而且安全。而在中國,因房地產(chǎn)交易的風(fēng)險給購房者造成巨大風(fēng)險的案例比比皆是,尤其是在二手房的交易市場中。2016年3月23日,大道金服聯(lián)合中原地產(chǎn)、中國郵政儲蓄銀行、眾安保險共同舉辦了國內(nèi)首款房地產(chǎn)產(chǎn)權(quán)交易保險—“交易!钡漠a(chǎn)品發(fā)布會。這是國內(nèi)第一款利用了房地產(chǎn)產(chǎn)權(quán)交易保險這個專業(yè)的金融工具為房產(chǎn)交易提供安全保障的產(chǎn)品,它將會徹底重構(gòu)國內(nèi)二手房交易的流程,大大提高房產(chǎn)交易的效率和安全性,引起了不少銀行和保險公司的密切關(guān)注。本文選取大道金服推出的“交易!弊鳛榈湫桶咐,對房地產(chǎn)產(chǎn)權(quán)交易保險進行了詳細的分析。論文共分為六個部分,緒論部分闡述了房地產(chǎn)產(chǎn)權(quán)交易保險的研究背景、研究意義、研究內(nèi)容和方法,對已有的相關(guān)研究文獻進行了綜述,并對房地產(chǎn)產(chǎn)權(quán)交易保險這個概念本身作出了概念界定,同時對本文的創(chuàng)新之處和不足之處做了詳細的說明。在案例介紹部分,對大道金服聯(lián)合多家保險公司推出的首款房地產(chǎn)產(chǎn)權(quán)交易保險產(chǎn)品—“交易!弊隽吮容^詳細的介紹。而在案例分析部分,論述了房地產(chǎn)產(chǎn)權(quán)交易中存在的各種風(fēng)險,包括交易主體方面的風(fēng)險、交易房屋方面的風(fēng)險以及交易手續(xù)方面的風(fēng)險,同時辨析了房地產(chǎn)產(chǎn)權(quán)交易保險與其他的房地產(chǎn)相關(guān)保險之間的區(qū)別,并介紹了房地產(chǎn)產(chǎn)權(quán)交易保險在房地產(chǎn)交易中的作用。緊接著對我國房地產(chǎn)產(chǎn)權(quán)交易保險產(chǎn)品存在的問題作了詳細的闡述。然后描述了美國房地產(chǎn)產(chǎn)權(quán)交易保險的發(fā)展狀況,并揭示了其對我國的啟示。最后基于以上的分析,對我國房地產(chǎn)產(chǎn)權(quán)交易保險的發(fā)展提出了相關(guān)的建議。
[Abstract]:Along with the rapid development of China's economy, China's real estate market gradually flourishes, and in the past two years, in the absence of inventory policy and loose monetary environment, the real estate industry in China is particularly popular. However, the rapid development of the real estate industry behind the latent too many trading risks. The real estate industry is an important part of the national economy and an important industry related to the people's livelihood, and the security of the real estate property right transaction is an important factor for the healthy development of the real estate industry. The real estate trade in China is far from the mature real estate market in developed countries in many aspects, such as safety, professionalism and efficiency. The reason for this huge gap is not in the real estate intermediary industry itself. But the domestic real estate market lacks a very important financial instrument, namely the real estate property right transaction insurance. In developed countries, the risks of real estate transactions are borne by insurance companies under the protection of real estate property transactions, which are not only efficient but also safe. And in China, there are numerous cases of great risks to buyers because of the risk of real estate transactions, especially in the second-hand housing market. On March 23, 2016, Boulevard Gold Services United Central Plains Real Estate, China Postal savings Bank, Zhongan Insurance jointly organized the first real estate property rights transaction insurance-"transaction insurance" product conference. This is the first domestic product that makes use of the real estate property right transaction insurance as a professional financial instrument to provide security for the real estate transaction. It will completely reconstruct the domestic second-hand housing transaction process and greatly improve the efficiency and safety of the real estate transaction. It has attracted close attention from many banks and insurance companies. This paper analyzes the real estate property right transaction insurance in detail by choosing the transaction insurance of Boulevard Gold Service as a typical case. The paper is divided into six parts. The introduction part expounds the research background, significance, content and method of real estate property right transaction insurance, and summarizes the relevant research literature. And the concept of real estate property right transaction insurance itself is defined, and the innovation and shortcomings of this paper are explained in detail. In the part of case introduction, the first real estate property right transaction insurance product-"transaction insurance" introduced by several insurance companies of Boulevard gold suit is introduced in detail. In the part of case analysis, it discusses all kinds of risks existing in the real estate property right transaction, including the risk of the transaction subject, the risk of the trading house and the risk of the transaction formalities. At the same time, it analyzes the difference between real estate property right transaction insurance and other real estate related insurance, and introduces the role of real estate property right transaction insurance in real estate transaction. Then the problems of real estate property right transaction insurance products in China are expounded in detail. Then it describes the development of American real estate property right transaction insurance, and reveals its enlightenment to our country. Finally, based on the above analysis, some suggestions are put forward for the development of real estate property right transaction insurance in China.
