房地產(chǎn)市場中的政府規(guī)制研究

【摘要】:隨著我國的房地產(chǎn)市場的不斷發(fā)展,房地產(chǎn)業(yè)被確立為國民經(jīng)濟的支柱性產(chǎn)業(yè),然而在房地產(chǎn)業(yè)的地位的被逐漸提高的同時,伴隨著市場出現(xiàn)的高房價問題越來越引起社會的廣泛關(guān)注。由于長期以來沒能正確處理好市場與政府的關(guān)系,造成政府的過度干預(yù),不能有效地解決房地產(chǎn)市場非理性的繁榮狀態(tài)。面對不穩(wěn)定的房地產(chǎn)市場,一方面,由于市場自我調(diào)節(jié)的缺陷,需要國家運用經(jīng)濟職能加以調(diào)節(jié);另一方面,由于法規(guī)政策的不完善,房地產(chǎn)市場的穩(wěn)定發(fā)展也需要國家完善相關(guān)制度和程序。由于近些年的國家的調(diào)控與規(guī)制政策未達到應(yīng)有的效果,本文從分析房地產(chǎn)市場政府規(guī)制的相關(guān)理論及政府調(diào)控角色入手,目的是通過研究房地產(chǎn)市場規(guī)制的現(xiàn)狀及出現(xiàn)的問題,加上借鑒國外的經(jīng)驗,闡述在未來的房地產(chǎn)市場中,政府如何在法治環(huán)境下依法規(guī)制,從而解決房地產(chǎn)市場的非理性繁榮狀態(tài),促進社會民生進步。 本文通過對經(jīng)濟學(xué)及法學(xué)理論的學(xué)習(xí)與分析,運用文獻研究法,對與房地產(chǎn)市場規(guī)制及政府責(zé)任相關(guān)的文獻進行搜集、整理和研究分析,總結(jié)出不同學(xué)者對房地產(chǎn)市場調(diào)控政策的看法,以及政府規(guī)制行為的不同分析與對策建議,對于我的研究大有啟發(fā)。此外,論文還運用規(guī)范研究與實證研究的相結(jié)合的方法。通過分析房地產(chǎn)市場的近幾年發(fā)展情況及國家實施的政策效果,分析政策調(diào)整帶來的問題,得出對房地產(chǎn)市場規(guī)制的經(jīng)驗;加上運用實證研究方法,分析通過國家統(tǒng)計局給出的數(shù)據(jù),在對這些數(shù)據(jù)進行分析、整理之后,展開文章的論述。 由于市場固有的自我調(diào)節(jié)的缺陷性,有必要發(fā)揮經(jīng)濟法確認和規(guī)范政府的經(jīng)濟職能和權(quán)力的作用,維護市場秩序,穩(wěn)定經(jīng)濟發(fā)展;另一方面,由于相關(guān)法規(guī)及規(guī)章制度的不完善,政府在規(guī)制房地產(chǎn)市場過程中出現(xiàn)規(guī)制失當?shù)男袨,主要有政府的行政干預(yù)過度但經(jīng)濟手段使用不力,政府的管理不規(guī)范及中央與地方政府的利益博弈問題,導(dǎo)致沒能正確處理好房地產(chǎn)市場與政府的關(guān)系,政府調(diào)控及規(guī)制的效果不能滿足市場的需求,房價呈現(xiàn)不減反而增的趨勢,房地產(chǎn)市場持續(xù)過熱。為此,需要防止政府對市場機制的不當干預(yù),正確處理好“看得見的手”與“看不見的手”的關(guān)系,促進商品房市場穩(wěn)定發(fā)展。 在積極倡導(dǎo)建設(shè)法治政府的今天,需要充分發(fā)揮經(jīng)濟法中確認和規(guī)范政府的經(jīng)濟職責(zé)和權(quán)力的作用,維護房地產(chǎn)市場秩序,穩(wěn)定經(jīng)濟發(fā)展,防止政府對市場機制的不當干預(yù),明確政府的管理權(quán)限,達到完善商品房市場以滿足經(jīng)濟發(fā)展與民生的需求。因此,全文通過明確房地產(chǎn)市場相關(guān)規(guī)制理論,明確政府規(guī)制的憲法正當性,以及政府規(guī)制的角色定位,了解我國現(xiàn)階段房地產(chǎn)市場發(fā)展狀況及出現(xiàn)的問題,,并分析國外政府對房地產(chǎn)市場規(guī)制的情況,借鑒吸收國外的規(guī)制經(jīng)驗,不僅要有完善的政策措施,還有加強政府執(zhí)法與管理,發(fā)揮政府在保障房建設(shè)方面的主導(dǎo)作用,最終落腳點在于吸收經(jīng)驗、完善措施,為房地產(chǎn)市場穩(wěn)定發(fā)展不斷努力。
