農(nóng)村小產(chǎn)權(quán)房買賣實證研究

【摘要】:最近幾年,隨著城市化進程的加快和房地產(chǎn)市場的飛速發(fā)展,小產(chǎn)權(quán)房規(guī)模不斷擴大,,成為社會討論的熱點話題之一。雖然國家在政策上明令禁止小產(chǎn)權(quán)房的買賣行為,但是對于小產(chǎn)權(quán)房能否自由流轉(zhuǎn)及其合法性問題在社會各界仍存在較多爭議。小產(chǎn)權(quán)房產(chǎn)生的根源在于中國獨特的土地所有制,在國外由于土地的私有化,并不存在小產(chǎn)權(quán)房問題,小產(chǎn)權(quán)房是中國特有的一種社會現(xiàn)象。小產(chǎn)權(quán)房問題的妥善解決,關(guān)系到人民群眾的根本利益,對于社會的穩(wěn)定發(fā)展影響重大。因此,本文主要通過案例分析的形式,針對小產(chǎn)權(quán)房交易涉及的房屋買賣協(xié)議、宅基地使用權(quán)等問題進行論述。最后,在論述了小產(chǎn)權(quán)房面臨的各類風險和存在的必要性后,進一步肯定了允許此類房屋的合法流轉(zhuǎn)對社會進步的重要意義。因此,從制度改革上,為小產(chǎn)權(quán)房的優(yōu)化和完善提出了自己的建議。 小產(chǎn)權(quán)房觸動了農(nóng)民、城市居民、政府、房地產(chǎn)開發(fā)商等各方主體的相關(guān)利益,動搖了中國的土地政策和制度,因此,妥善地化解小產(chǎn)權(quán)房交易帶來的社會矛盾,改革法律和制度上的弊端,創(chuàng)造性地解決小產(chǎn)權(quán)房合法性的問題具有理論和實踐意義。對小產(chǎn)權(quán)房交易,應(yīng)當從政策上對其予以一定的支持,只要對其發(fā)展進行合理的引導、在實際運作中不斷調(diào)整和完善交易機制、并加強法律方面的監(jiān)督,小產(chǎn)權(quán)房交易活動必然會對中國土地制度改革和社會經(jīng)濟發(fā)展起到積極作用。 我國目前并沒有關(guān)于小產(chǎn)權(quán)房的立法,本文擬通過對司法實踐中發(fā)生的現(xiàn)實案例進行分析和總結(jié),以及結(jié)合當前已有的學術(shù)研究成果,通過運用文獻研究法,對比分析、解釋等方法,列舉實例將該問題提出、分析并尋求解決之道。通過剖析現(xiàn)實的案例,以求能為小產(chǎn)權(quán)房的完善和優(yōu)化提供些許思考。
[Abstract]:In recent years, with the acceleration of urbanization and the rapid development of the real estate market, the scale of small property housing has been expanding, which has become one of the hot topics of social discussion. Although the government explicitly forbids the purchase and sale of small property houses, there are still many controversies about the free circulation of small property houses and their legality in all walks of life. The origin of the small property house lies in the unique land ownership in China. Because of the privatization of the land in foreign countries, there is no small property house problem. The small property house is a special social phenomenon in China. The proper solution of the problem of small property right is related to the fundamental interests of the people and has a great impact on the stable development of society. Therefore, this article mainly through the case analysis form, regarding the small property right house transaction involves the housing sale agreement, the homestead use right and so on question carries on the elaboration. Finally, after discussing the various risks and the necessity of the existence of the small property right house, the significance of allowing the legal circulation of this kind of house to the social progress is further affirmed. Therefore, from the system reform, put forward their own suggestions for the optimization and improvement of small property housing. Small property houses have touched the related interests of farmers, urban residents, the government, real estate developers, and so on, which have shaken China's land policy and system. Therefore, the social contradictions brought about by the transaction of small property houses have been properly resolved. It is of theoretical and practical significance to reform the legal and institutional malpractices and to creatively solve the problem of the legality of small property houses. We should give some policy support to the transaction of small property right houses, so long as we give reasonable guidance to its development, constantly adjust and perfect the trading mechanism in the actual operation, and strengthen the supervision of the law. The transaction of small property right house will certainly play a positive role in the reform of land system and the development of social economy in China. There is no legislation on the small property right house in our country at present. This paper intends to analyze and summarize the actual cases that have taken place in the judicial practice, as well as combining the existing academic research results, through the use of literature research method, comparative analysis. Explain and give examples to put forward, analyze and seek solutions to this problem. Through the analysis of practical cases, in order to provide some thinking for the improvement and optimization of small property rights.
