我國(guó)二手房交易中欺詐行為法律規(guī)制問題探析

【摘要】:我國(guó)房地產(chǎn)市場(chǎng)的發(fā)展,對(duì)我國(guó)經(jīng)濟(jì)增長(zhǎng)起著主力的作用,龐大的一手房(新建商品房)交易二級(jí)市場(chǎng)促使商品房交易模式在實(shí)踐中不斷規(guī)范,二手房交易三級(jí)市場(chǎng)房屋交易模式,在我國(guó)現(xiàn)代房地產(chǎn)市場(chǎng)中也在不斷完善,扮演的角色日益突顯。交易與人類生活息息相關(guān),房屋交易在人類生活中起著重要支撐點(diǎn),但它有別于普通商品的交易,主要體現(xiàn)在房屋交易價(jià)值大,交易內(nèi)容復(fù)雜等,這就決定了一旦發(fā)生房屋交易欺詐行為,在處理這類糾紛時(shí)在適用法律上是比較復(fù)雜的。在一手房交易二級(jí)市場(chǎng),我國(guó)有相關(guān)法律對(duì)其進(jìn)行規(guī)制,而二手房交易三級(jí)市場(chǎng)卻沒有比較完善專門的法律進(jìn)行規(guī)制,適用一手房交易二級(jí)市場(chǎng)的法律法規(guī)幾乎不適用于二手房交易三級(jí)市場(chǎng)。因此,如何有效預(yù)防,規(guī)制二手房交易中的欺詐行為,能夠使購(gòu)房者的合法利益得到有效保護(hù),維護(hù)正常的交易秩序和交易安全,減少交易的風(fēng)險(xiǎn)性,同時(shí)促進(jìn)整個(gè)房地產(chǎn)交易市場(chǎng)的良性發(fā)展,有著重要的理論和實(shí)踐意義。 本文共分為五個(gè)部分: 首先為緒論,通過一些典型案例提出問題,說明研究本課題的目的是維護(hù)當(dāng)事人的合法利益,研究意義是通過制裁和遏制二手房交易中欺詐行為,充分體現(xiàn)法律規(guī)范的教育功能,營(yíng)造誠(chéng)信的社會(huì)環(huán)境。 第一章是二手房交易及交易中欺詐行為概述。本章節(jié)主要從二手房交易概念及欺詐行為的定義入手,在比較一手房交易與二手房交易,闡述欺詐行為的構(gòu)成要件后,把二手房交易中的欺詐行為定義為:舊房物權(quán)人或房地產(chǎn)中介機(jī)構(gòu)在房屋交易過程中欺騙購(gòu)房者,使其陷于對(duì)房屋情況的錯(cuò)誤認(rèn)識(shí),向舊房物權(quán)人或房地產(chǎn)中介機(jī)構(gòu)作出購(gòu)買的意思表示。接著分析這種欺詐行為的社會(huì)危害性及在具體交易過程中常見的類型:一是指舊房產(chǎn)權(quán)人的欺詐行為常見的類型;二是指房地產(chǎn)中介機(jī)構(gòu)的欺詐行為的常見的類型。 第二章是我國(guó)二手房交易中欺詐行為法律規(guī)定及制度缺陷。隨著我國(guó)社會(huì)經(jīng)濟(jì)的躍式增長(zhǎng),房地產(chǎn)市場(chǎng)也在飛速發(fā)展,人們對(duì)良好的社會(huì)秩序和高質(zhì)量社會(huì)生活的追求,幾乎離不開法律規(guī)范的調(diào)整。本章以介紹國(guó)外一些國(guó)家關(guān)于不動(dòng)產(chǎn)交易的制度及具體實(shí)踐,以期為我國(guó)在二手房交易方面的相關(guān)制度有所借鑒;從《民法通則》、《合同法》、《房屋登記辦法》、《房地產(chǎn)登記技術(shù)規(guī)程》中關(guān)于交易行為與房屋交易登記的相關(guān)規(guī)定。反觀日益發(fā)展的二手房交易三級(jí)市場(chǎng),卻沒有比較完善的專門法律法規(guī)對(duì)這類交易行為進(jìn)行規(guī)制,一旦發(fā)生欺詐行為難以保障受害者的合法權(quán)益,造成法律適用的空缺,體現(xiàn)出法律的滯后性及制度的不完善性。 第三章是本論文的主體部分。首先,建議完善我國(guó)二手房交易法律,由確定交易的目的和基本原則,規(guī)定交易主體的權(quán)利義務(wù)及實(shí)施欺詐行為的法律責(zé)任的承擔(dān)。其次,從房地產(chǎn)主管部門的監(jiān)管,《合同法》與《物權(quán)法》三個(gè)方面,強(qiáng)化我國(guó)二手房交易中的保護(hù)機(jī)制,,加強(qiáng)對(duì)于兩大類欺詐行為的防范,有針對(duì)性地提出具體的防范措施。通過完善專門性法律,維護(hù)了交易三級(jí)市場(chǎng)的安全性,一旦侵害購(gòu)房者的欺詐行為,可以直接適用這些規(guī)范,同時(shí)也是法制與法治的內(nèi)涵的具體體現(xiàn)。 最后是本文的結(jié)束語,通過對(duì)本文寫作結(jié)構(gòu)的簡(jiǎn)單總結(jié),籍希望對(duì)我國(guó)處于初始階段的二手房三級(jí)交易市場(chǎng)在理論上與實(shí)踐中能夠進(jìn)一步進(jìn)行探討。
[Abstract]:The development of the real estate market in China has played a main role in the economic growth of our country. In the modern real estate market of our country, the role of the play is becoming more and more prominent.
