房地一體化土地管理模型設(shè)計(jì)

【摘要】:土地和房屋是人類賴以生存和發(fā)展的基礎(chǔ)?紤]到土地和房屋在現(xiàn)實(shí)中的不可分割性,在房屋發(fā)生轉(zhuǎn)讓或者抵押時(shí),該房屋所占用范圍內(nèi)的土地也應(yīng)該同時(shí)進(jìn)行轉(zhuǎn)讓或者抵押,反之亦然。另外,從土地和房屋自然屬性上的完整性考慮,土地使用權(quán)證以及房屋所有權(quán)證也應(yīng)該是統(tǒng)一發(fā)放的。再者,從立法角度看,在許多法律法規(guī)中都提出了實(shí)行房地一體化管理的相關(guān)規(guī)定,,特別是針對(duì)登記工作。但是,目前在我國(guó)的大部分地區(qū),土地和房屋仍然實(shí)行的是分開管理的模式,而這樣的現(xiàn)狀為房地產(chǎn)市場(chǎng)的發(fā)展、交易過程造成了諸多的問題。 針對(duì)我國(guó)房地一體化管理的問題,本文試圖從技術(shù)角度提出相應(yīng)的解決方案。根據(jù)Peter van Oosterom教授提出的土地管理成熟度模型(Land Administration Maturity Model(LAMM)),本文主要是在標(biāo)準(zhǔn)化的階段來解決一體化的問題,具體引入了土地管理領(lǐng)域模型(Land Administration Domain Model(LADM)-ISO19152)的理論。在此理論的基礎(chǔ)上,本文以房地一體化為重點(diǎn),完成了對(duì)我國(guó)土地管理領(lǐng)域模型(LADM CountryProfile for China, CNLADM1)的設(shè)計(jì)。 本研究首先以相關(guān)法律法規(guī)為基礎(chǔ),分析得到了一系列針對(duì)房地一體化管理的法律約束。同時(shí),土地和房屋數(shù)據(jù)庫(kù)現(xiàn)狀結(jié)構(gòu)的分析則是以重慶市為例,具體參照《重慶市城鎮(zhèn)地房籍?dāng)?shù)據(jù)庫(kù)標(biāo)準(zhǔn)》(以下簡(jiǎn)稱《標(biāo)準(zhǔn)》)來進(jìn)行。隨后,在分析研究的基礎(chǔ)上,參照LADM標(biāo)準(zhǔn)來設(shè)計(jì)我國(guó)的土地管理領(lǐng)域模型(CNLADM)。最后,則是通過建立評(píng)價(jià)體系來對(duì)CNLADM進(jìn)行相應(yīng)的評(píng)價(jià)。 總的來講,本文的目標(biāo)主要是以房地一體化為重點(diǎn),完成對(duì)我國(guó)土地管理領(lǐng)域模型的設(shè)計(jì)。鑒于本文的重點(diǎn)是房地?cái)?shù)據(jù)庫(kù)的一體化,故而該CNLADM模型主要涵蓋了我國(guó)土地以及房屋管理領(lǐng)域兩方面的相關(guān)內(nèi)容。
[Abstract]:Land and housing are the basis for human survival and development. Considering the indivisibility of land and house in reality, when the house is transferred or mortgaged, the land occupied by the house should be transferred or mortgaged at the same time, and vice versa. In addition, from the integrity of the natural attributes of land and houses, land use warrants and building ownership certificates should also be issued uniformly. Furthermore, from the legislative point of view, in many laws and regulations, the implementation of the integrated management of premises related provisions, especially for registration. However, at present, in most areas of our country, land and housing are still managed separately, and this situation has caused many problems for the development of the real estate market and the transaction process. Aiming at the problem of the integrated management of our country's premises, this paper tries to put forward the corresponding solutions from the technical point of view. According to the land Administration maturity model proposed by Professor Peter van Oosterom, this paper mainly deals with the problem of integration in the stage of standardization, and introduces the theory of Land Administration Domain Model LADM-ISO 19152. On the basis of this theory, this paper focuses on the integration of premises and completes the design of land management domain model in China (CNLADM1). Firstly, based on the relevant laws and regulations, a series of legal constraints on the integrated management of premises are obtained. At the same time, the analysis of the present structure of land and house database takes Chongqing as an example, referring specifically to "Chongqing Urban Land and Housing Database Standard" (hereinafter referred to as "Standard"). Then, on the basis of analysis and research, the land management domain model of China is designed with reference to LADM standard. Finally, the evaluation system is established to evaluate CNLADM. In general, the aim of this paper is to complete the design of land management model in our country, focusing on the integration of premises. Since the emphasis of this paper is the integration of premises database, the CNLADM model mainly covers two aspects of land and housing management in China.
