【摘要】:正問題某小區(qū)業(yè)主甲與房地產(chǎn)開發(fā)商乙簽訂了《車位使用協(xié)議》,約定小區(qū)內(nèi)第5號地上停車位由甲長期獨(dú)占使用,甲向乙支付了2萬元車位使用費(fèi)。該車位系經(jīng)規(guī)劃審批建設(shè)的停車位,鋪裝了植草磚,占地面積按50%計入綠化面積。后業(yè)委會主張該停車位為全體業(yè)主共有。請問:甲乙簽訂的這份車位使用協(xié)議是否有效?解答一、本案中第5號停車位的權(quán)屬性質(zhì)
[Abstract]:The owner of a residential area and real estate developer B signed a "parking space use agreement", agreed that the residential area No. 5 above ground parking space by a long-term exclusive use, A paid 20,000 yuan to B parking fees.
