【摘要】:私權保護不僅是現(xiàn)代國家的重要機能,也是市場經(jīng)濟的客觀要求,不動產(chǎn)登記法律制度與私權保護密切相關。不動產(chǎn)在民事主體間通過法律行為或非法律行為流轉,為維護當事人及第三人利益,都應依法公示,而登記則是不動產(chǎn)物權公示的最好方式。依傳統(tǒng)民法理論,物權作為對世權,具有排他性和優(yōu)先性。物權的這種特性也要求物權的變動須向公眾公示。不動產(chǎn)物權登記制度就是為物權公示服務的。不動產(chǎn)登記法律制度作為物權法的基礎制度,在不動產(chǎn)物權變動中起著至關重要的作用。它對于明確不動產(chǎn)權利歸屬、提高交易效率、保護交易安全及促進國家對不動產(chǎn)的管理,都具有重要意義。 世界上大多數(shù)國家尤其是傳統(tǒng)大陸法系國家如德國、法國、瑞士、日本等,都已建立起比較完善的房屋和土地等不動產(chǎn)登記法律制度,作為不動產(chǎn)法律制度的重要組成部分。我國因歷史及現(xiàn)實的原因,現(xiàn)有的不動產(chǎn)登記法律制度尚不完備,難以適應社會經(jīng)濟的發(fā)展,我國的物權法尚未制定出來,也未有統(tǒng)一的不動產(chǎn)登記法。從我國物權法律發(fā)展來看,我國物權法應確立不動產(chǎn)物權的設立、轉移、變更、消滅等物權變動的登記制度,強調登記的公示公信作用。不動產(chǎn)法將是我國物權立法的重點內(nèi)容,其中不動產(chǎn)登記法律制度應該在我國的物權法中有明確規(guī)定。 本文通過考查相關國家不動產(chǎn)登記制度,借鑒國內(nèi)外的理論研究成果,吸收國內(nèi)外的先進實踐經(jīng)驗,就我國目前及未來不動產(chǎn)登記法律制度的相關問題進行了探討和研究。 本文共分四個部分,計約四萬字。 第一部分:不動產(chǎn)登記制度概論。這部分首先簡要介紹了有關法典對不動產(chǎn)含義的不同規(guī)定和一些學者的理解,表達了筆者贊同的觀點。其次對不動產(chǎn)登記制度在國內(nèi)外的歷史發(fā)展進行了介紹,借鑒國外幾種主要登記制度模式,結合我國實際情況,確立適合我國國情的登記模式。 第二部分:不動產(chǎn)登記制度價值功效。一項制度的長期存在必有其合理價值,各國雖對不動產(chǎn)登記的效力規(guī)定并不完全一致,但就登記作為物權公示方法而言,卻是統(tǒng)一的。公示對于市場經(jīng)濟秩序的建立和維護都具有十分重要的意義,登記制度價值在于明確不動產(chǎn)物權歸屬,預防和解決糾紛;維護交易秩序,保護交易安全;提高交易效率;有利于國家對不動產(chǎn)的管理,以及風險預告警示等。凡事皆有利弊之分,作為不動產(chǎn)公示制
[Abstract]:The protection of private rights is not only an important function of modern countries, but also an objective requirement of market economy. The legal system of registration of real estate is closely related to the protection of private rights. In order to protect the interests of the parties and the third party, immovable property should be publicized according to law, and registration is the best way to publicize the real right of immovable property. According to the traditional theory of civil law, real right, as a right to the world, is exclusive and preferential. This characteristic of real right also requires the change of real right to be announced to the public. Real property registration system is for the real right publicity services. As the basic system of real right law, the legal system of real estate registration plays a vital role in the change of real property right. It is of great significance to clarify the ownership of real estate rights, improve the efficiency of transactions, protect the security of transactions and promote the management of real estate by the state. Most countries in the world, such as Germany, France, Switzerland, Japan and so on, have established relatively perfect real estate registration system, such as housing and land, as an important part of the real estate legal system. Due to the historical and practical reasons, the existing legal system of real estate registration is still incomplete and difficult to adapt to the development of social economy. The property law of our country has not yet been formulated, nor has a unified law of real estate registration. From the point of view of the legal development of real right in our country, the real right law of our country should establish the registration system of the real right change, such as the establishment, transfer, change and elimination of the real property right, and emphasize the role of public information of registration. The law of real estate will be the key content of the legislation of real right in our country, in which the legal system of registration of real estate should be clearly stipulated in the law of real right of our country. By examining the relevant national real estate registration system, drawing on the theoretical research results at home and abroad and absorbing the advanced practical experience at home and abroad, this paper discusses and studies the relevant problems of the present and future real estate registration legal system in China. This article is divided into four parts, about 40, 000 words. Part I: introduction to real estate registration system. This part first briefly introduces the different provisions of the Code on the meaning of real estate and the understanding of some scholars, and expresses the views that the author agrees with. Secondly, this paper introduces the historical development of the real estate registration system at home and abroad, draws lessons from several main registration system models of foreign countries, and establishes the registration mode suitable for the national conditions of our country in combination with the actual situation of our country. The second part: the value effect of real estate registration system. The long-term existence of a system must have its reasonable value, although the effectiveness of the registration of real estate in various countries is not completely consistent, but as a method of publicizing real right, it is unified. Publicity is of great significance to the establishment and maintenance of market economic order. The value of registration system lies in defining the ownership of real estate, preventing and resolving disputes, maintaining the order of transaction, protecting transaction security, improving the efficiency of transaction. Conducive to the management of real estate, as well as risk warning and so on. Everything has its advantages and disadvantages, as a real estate publicity system
