【摘要】：為解決不動(dòng)產(chǎn)信托登記有名無(wú)實(shí)的尷尬問(wèn)題和房地產(chǎn)投資信托基金登記的法律瓶頸,通過(guò)對(duì)不動(dòng)產(chǎn)信托登記與不動(dòng)產(chǎn)物權(quán)登記進(jìn)行文獻(xiàn)分析,發(fā)現(xiàn)兩大法系對(duì)信托財(cái)產(chǎn)權(quán)屬的立法存在巨大差異,提出借鑒中國(guó)臺(tái)灣地區(qū)的相關(guān)立法,在不動(dòng)產(chǎn)物權(quán)登記的基礎(chǔ)上,對(duì)不動(dòng)產(chǎn)信托登記的效力、主體、事項(xiàng)提出相關(guān)立法建議,對(duì)房地產(chǎn)投資信托基金登記提出適當(dāng)進(jìn)行技術(shù)性調(diào)適的建議。
[Abstract]:In order to solve the real estate trust registration in the legal bottleneck embarrassment and real estate investment trust registration, the registration of real estate trust and real property registration documents analysis, it is found that there are great differences in the legislation on trust property ownership of the two legal systems, proposed legislation in Taiwan China, in based on the real estate registration, the real estate trust registration effect, the subject, put forward relevant legislative proposals on the matter, the real estate investment trust fund registration to provide appropriate technical adjustment suggestions.
