【摘要】：由FIDIC（國際咨詢工程師聯(lián)合會）出版的《施工合同條件》（以下簡稱“FIDIC”合同）在國際上得到了廣泛的認(rèn)可與使用，近年在國內(nèi)的影響力也不斷擴大。國內(nèi)現(xiàn)有的研究主要集中于對FIDIC合同條文的分析及應(yīng)用技巧，建筑企業(yè)或房地產(chǎn)開發(fā)企業(yè)法律事務(wù)管理部門應(yīng)如何變革以適應(yīng)FIDIC合同環(huán)境卻鮮有研究。 本文在研究分析FIDIC合同特點、對比分析FIDIC合同文本與建設(shè)部1999版《建設(shè)工程施工合同（示范文本）》的基礎(chǔ)上，對建筑企業(yè)或房地產(chǎn)開發(fā)企業(yè)法律事務(wù)管理部門的人力資源、組織架構(gòu)、事務(wù)管理等進(jìn)行變革以適應(yīng)FIDIC合同環(huán)境進(jìn)行了分析和研究，主要內(nèi)容和結(jié)果包括： 本文簡要介紹了FIDIC（國際咨詢工程師聯(lián)合會）及1999版《施工合同條件》（Conditions of Contract）的基本情況，，對FIDIC合同的案例法體系特點進(jìn)行了重點說明，并重點介紹了“土木工程施工合同條件（Conditions of contract for works of civilengineering construction）”的主要核心條款。本文還分析了FIDIC合同條件與建設(shè)部1999版《建設(shè)工程施工合同（示范文本）》的主要差異。本文分析了國內(nèi)房地產(chǎn)開發(fā)企業(yè)法律事務(wù)管理工作中存在的不足之處，及FIDIC合同文本給國內(nèi)工程合同環(huán)境帶來的沖擊和影響，并重點討論了FIDIC合同環(huán)境下的法務(wù)部內(nèi)部建設(shè)和企業(yè)內(nèi)部關(guān)系處理等問題，在這方面有一定的新穎性。最后還分析了企業(yè)法律服務(wù)來源選擇的問題。
[Abstract]:The term of Construction contract published by FIDIC (International Federation of Consulting Engineers) (hereinafter referred to as "FIDIC" contract) has been widely recognized and used in the world. In recent years, the influence in China has been expanding. The existing research focuses on the analysis and application skills of FIDIC contract. However, there is little research on how the legal affairs management department of the construction enterprise or the real estate development enterprise should change to adapt to the FIDIC contract environment. This paper studies and analyzes the characteristics of FIDIC contract, and compares the text of FIDIC contract with that of Ministry of Construction 1999 edition < Construction contract (demonstration text)]. In order to adapt to the FIDIC contract environment, the human resources, organization structure and affairs management of the legal affairs management department of the construction enterprise or the real estate development enterprise are analyzed and studied. The main elements and outcomes include: This paper briefly introduces the basic situation of FIDIC (International Federation of Consulting Engineers) and 1999 edition of "conditions of contract of Construction". The characteristics of case law system of FIDIC contract are explained emphatically. The contract conditions of civil engineering construction are introduced in detail. Conditions of contract for works of civilengineering construction). This paper also analyzes the FIDIC contract conditions and Ministry of Construction 1999 edition < Construction contract (Model text). This paper analyzes the deficiencies in the legal affairs management of domestic real estate development enterprises. And the impact and impact of the FIDIC contract text on the domestic engineering contract environment, and mainly discusses the internal construction of the legal Department and the handling of the internal relations of the enterprise under the FIDIC contract environment. In this respect, there are some novelty. Finally, the choice of enterprise legal service source is analyzed.
