農(nóng)民工養(yǎng)老保險關(guān)系轉(zhuǎn)移接續(xù)問題研究

【摘要】:農(nóng)民工養(yǎng)老保障是中國社會保障體系的重要組成部分,截至目前,雖然我國尚未建立專門針對農(nóng)民工的養(yǎng)老保險制度,但是鑒于農(nóng)民工這樣一種“飄忽不定”的流動性群體,國家作出規(guī)定,當(dāng)農(nóng)民工沒有外出務(wù)工、全年在家務(wù)工時可自愿參加新型農(nóng)村養(yǎng)老保險;在農(nóng)民工進城務(wù)工,無論進入哪一個省市哪一個企業(yè)打工,均必須按照當(dāng)?shù)叵嚓P(guān)法律的規(guī)定,與用人單位共同參加城鎮(zhèn)職工基本養(yǎng)老保險。顯然,這一法律規(guī)定對于農(nóng)民工來說,是一個福音,,一個國家切實保障其退休后年老生活的福音。對于國家來說,是堅持以人為本、改善民生的真切體現(xiàn),是建立健全完善的社會保障體系的必然要求。讓農(nóng)民工繳納社會保險可以,畢竟可以保障退休后的基本生活,問題是農(nóng)民工的養(yǎng)老保險如何轉(zhuǎn)移呢?轉(zhuǎn)移又會遇到什么問題呢?2008年、2009年曾經(jīng)幾度引發(fā)退保潮,這又是為何?《城鎮(zhèn)企業(yè)職工基本養(yǎng)老保險關(guān)系轉(zhuǎn)移接續(xù)暫行辦法》對于農(nóng)民工跨省轉(zhuǎn)移養(yǎng)老保險關(guān)系作用究竟有多大?是福音?還是擺設(shè)?新頒布的《城鄉(xiāng)養(yǎng)老保險制度銜接暫行辦法》應(yīng)當(dāng)在農(nóng)民工養(yǎng)老保險關(guān)系轉(zhuǎn)移接續(xù)中發(fā)揮怎么的作用? 為此,本文從農(nóng)民工群體入手,展開了對農(nóng)民工養(yǎng)老保險關(guān)系轉(zhuǎn)移接續(xù)問題的研究。首先,在明確界定一系列概念的基礎(chǔ)上,找準(zhǔn)本研究賴以支撐下來的三大理論基礎(chǔ),即公民身份與權(quán)利、制度變遷理論、補償原則說;其次,將官方數(shù)據(jù)與調(diào)查數(shù)據(jù)、訪談內(nèi)容相結(jié)合,對農(nóng)民工養(yǎng)老保險關(guān)系轉(zhuǎn)移接續(xù)面臨的困境做出有理有據(jù)的分析;然后,運用三大理論,深入探討這些困境得以形成的原因;最后,以制度變遷理論為核心,找出應(yīng)對農(nóng)民工養(yǎng)老保險關(guān)系轉(zhuǎn)移接續(xù)困境的破解之道,即“有法可依、有法必依、執(zhí)法必嚴(yán)、違法必究”,并輔之以道德約束和個人自覺。
[Abstract]:The old-age security of migrant workers is an important part of China's social security system. Up to now, although China has not established a special old-age insurance system for migrant workers, but in view of the migrant workers such a "volatile" mobile group, The state has stipulated that when migrant workers do not go out to work, they can voluntarily participate in a new type of rural old-age insurance when they work at home throughout the year; and when migrant workers enter the city to work, no matter which province, city or enterprise they enter, They must, in accordance with the relevant local laws, take part in the basic old-age insurance for urban workers jointly with the employing units. Obviously, this legal provision is a boon for migrant workers. A country effectively protects the good news of its retirement life. For the country, it is a true manifestation of adhering to the people-oriented approach and improving the people's livelihood. It is necessary to establish a sound social security system. Let migrant workers pay social insurance can, after all, can protect the basic life after retirement, the problem is how to transfer the old-age insurance of migrant workers? What are the problems with the transfer? In 2008, 2009 has several times triggered a wave of retreat, this is why? Interim measures for the transfer of basic Endowment Insurance relationships among employees in Urban Enterprises how much does it play on the role of transferring pension insurance relationships across provinces among migrant workers? The Gospel? Or furnishings? The newly promulgated interim measures for linking up the Urban and Rural Old-age Insurance system should play a role in the transfer of the relationship between migrant workers' pension insurance? For this reason, this paper starts with the migrant workers' group, and carries out a study on the transfer of the relationship between migrant workers' endowment insurance. Firstly, on the basis of defining a series of concepts, the paper finds out the three theoretical bases on which this research is based. That is, citizenship and rights, the theory of institutional change, the principle of compensation; secondly, combining official data with survey data, interview content, to make a reasonable analysis of the plight of the transfer of migrant workers pension insurance relationship; then, Using the three theories, the causes of these difficulties are discussed in depth. Finally, taking the institutional change theory as the core, the author finds out the solution to the plight of migrant workers' pension insurance relationship transfer, that is, "there are laws to rely on, there are laws to be followed." Law enforcement must be strict, law violation must be prosecuted, and supplemented by moral constraints and personal consciousness.
