多學(xué)科視角下的混合所有制職業(yè)院校屬性論

【摘要】：屬性問題是混合所有制職業(yè)院校學(xué)院辦學(xué)的根本問題。因為混合所有制職業(yè)院校辦學(xué)實踐中遇到的諸多問題或多或少均涉及其屬性問題。對混合所有制職業(yè)院校屬性問題認(rèn)識不清,則很容易導(dǎo)致對其理解上的偏差,繼而引發(fā)其辦學(xué)實踐的混亂。和其他事物一樣,混合所有制職業(yè)院校的屬性也是多方面的�；诋a(chǎn)權(quán)經(jīng)濟(jì)學(xué)視角所理解的混合所有制職業(yè)院校的辦學(xué)屬性(所有權(quán)屬性)則表現(xiàn)為國有資本的主導(dǎo)性,不同所有制性質(zhì)資本結(jié)構(gòu)的多元性和開放性;基于哲學(xué)(唯物辯證法)視角所理解的混合所有制職業(yè)院校的功能屬性則表現(xiàn)為"非營利"和"營利"二者的兼容性;基于民法學(xué)視角所理解的混合所有制職業(yè)院校法人屬性則應(yīng)該歸類為非營利性法人中的"事業(yè)單位法人"。
[Abstract]:Attribute problem is the fundamental problem of mixed ownership vocational colleges. Many problems encountered in the practice of mixed ownership vocational colleges are more or less related to their attributes. If we do not understand the attributes of the mixed ownership vocational colleges, it will easily lead to the deviation of their understanding and lead to confusion in the practice of running their schools. As with other things, mixed ownership of the attributes of vocational colleges is multifaceted. Based on the angle of view of property right economics, the school running attribute (ownership attribute) of the mixed ownership vocational colleges is shown as the leading role of the state-owned capital, and the diversity and openness of the capital structure of different ownership nature. The functional attributes of mixed ownership vocational colleges based on philosophy (materialist dialectics) are the compatibility of "non-profit" and "profit-making". On the basis of the view of civil law, the legal person attribute of the mixed ownership vocational college should be classified as the "institution legal person" among the non-profit legal persons.
