【摘要】：目前，我國(guó)對(duì)中等職業(yè)學(xué)校學(xué)生實(shí)習(xí)權(quán)法律保障問(wèn)題理論研究和實(shí)證研究比較少，多數(shù)是從教學(xué)環(huán)節(jié)、學(xué)生和學(xué)校，企業(yè)之間的關(guān)系去關(guān)注，卻沒(méi)有從法律保障角度對(duì)中等職業(yè)學(xué)校學(xué)生實(shí)習(xí)權(quán)保障問(wèn)題作詳細(xì)的介紹和深入的研究。德國(guó)和日本是世界上研究和實(shí)行中等職業(yè)學(xué)校實(shí)習(xí)權(quán)法律保障比較成熟的國(guó)家，而我國(guó)在這方面的研究和工作雖然已經(jīng)取得了一些成果和進(jìn)展，但總體仍然不夠成熟。部分學(xué)者從法律的視角對(duì)中等職業(yè)學(xué)校學(xué)生實(shí)習(xí)權(quán)法律保障問(wèn)題進(jìn)行了相關(guān)研究，，然而以憲法、行政法、民法作為法律基礎(chǔ)的研究較少，所以怎樣研究和制定出適合我國(guó)國(guó)情的中等職業(yè)學(xué)校學(xué)生實(shí)習(xí)權(quán)法律保障機(jī)制具有重要的現(xiàn)實(shí)意義。 論文主要通過(guò)法律的視角對(duì)中等職業(yè)學(xué)校學(xué)生實(shí)習(xí)權(quán)的保障進(jìn)行研究。第一部分是文章的引言，主要介紹研究意義、核心概念的界定、國(guó)內(nèi)研究現(xiàn)狀等。第二部分對(duì)我國(guó)中等職業(yè)學(xué)校學(xué)生實(shí)習(xí)權(quán)的實(shí)現(xiàn)狀況。第三部分主要介紹我國(guó)中等職業(yè)學(xué)校學(xué)生實(shí)習(xí)遭遇侵權(quán)的成因。第四部分主要分析如何加強(qiáng)中等職業(yè)學(xué)校學(xué)生實(shí)習(xí)權(quán)法律保護(hù)對(duì)策。本章分別從增強(qiáng)實(shí)習(xí)主體法制觀念,提高法律意識(shí)，進(jìn)一步完善健全相關(guān)法律法規(guī)，加強(qiáng)中等職業(yè)學(xué)校學(xué)生實(shí)習(xí)權(quán)保護(hù)的執(zhí)法力度幾方面去研究，以進(jìn)一步推動(dòng)我國(guó)中等職業(yè)學(xué)校學(xué)生實(shí)習(xí)權(quán)法律保障措施的制定與實(shí)施提供建設(shè)性意見(jiàn)。 論文主要采用文獻(xiàn)法和案例分析的方法，對(duì)我國(guó)中職院校實(shí)習(xí)生現(xiàn)狀進(jìn)行分析，對(duì)實(shí)習(xí)生實(shí)習(xí)權(quán)收到侵害原因進(jìn)行研究。
[Abstract]:At present, there are few theoretical and empirical studies on the legal protection of students' internship right in secondary vocational schools in our country. Most of them focus on the relationship between teaching links, students, schools and enterprises. However, there is no detailed introduction and in-depth study on the issue of the right to practice in secondary vocational schools from the perspective of legal protection. Germany and Japan are mature countries in the world where the legal protection of the right to practice in secondary vocational schools is studied and implemented. Although our research and work in this area has made some achievements and progress, it is still not mature. Some scholars have carried out relevant research on the legal protection of students' internship right in secondary vocational schools from the perspective of law. However, there are few studies on constitution, administrative law and civil law as the legal basis, so it is of great practical significance to study and formulate the legal guarantee mechanism of the students' practice right in the secondary vocational school which is suitable for the national conditions of our country. The first part is the introduction of the article, which mainly introduces the significance of the research, the definition of the core concepts. The second part is about the realization of students' practice right in secondary vocational schools. The third part mainly introduces the causes of students' practice infringement in our secondary vocational schools. Part 4th mainly analyzes how to do this. The countermeasures of strengthening the legal protection of students' right to practice in secondary vocational schools. To improve legal awareness, further improve and improve relevant laws and regulations, and strengthen the law enforcement efforts to protect students' right to practice in secondary vocational schools. In order to further promote the establishment and implementation of the legal safeguard measures of the students' internship right in our secondary vocational schools, constructive suggestions are provided. This paper mainly adopts the method of literature and case analysis to analyze the current situation of interns in secondary vocational colleges and to study the causes of the infringement of interns' right to practice.
