【摘要】：學(xué)生事務(wù)管理作為高等教育管理的中心環(huán)節(jié)之一，其核心在于為學(xué)生提供良好的學(xué)習(xí)生活環(huán)境，為學(xué)生的全面發(fā)展提供服務(wù)，同時(shí)維持正常的校園秩序，使教學(xué)活動(dòng)得以順利開展�，F(xiàn)代學(xué)生事務(wù)管理體系的突出特點(diǎn)是科學(xué)化、專業(yè)化和法制化。學(xué)生事務(wù)管理應(yīng)當(dāng)在法律規(guī)范的保障和引導(dǎo)下進(jìn)行，通過合法的手段解決學(xué)生事務(wù)管理中出現(xiàn)的矛盾和問題，不僅可以提高我國學(xué)生事務(wù)管理水平和效率，同時(shí)也符合我國的“依法治校”方針。建立完善的法律保障體系，可以使學(xué)校行為從法律上獲得支持，也可以使學(xué)生得到國家法律保障，獲得司法救濟(jì)，維護(hù)自身權(quán)利，提高學(xué)生的公民意識(shí)。我國高校改革正在穩(wěn)步推進(jìn)，學(xué)生事務(wù)管理工作正在經(jīng)歷一場(chǎng)巨大的變革，在改革進(jìn)程中，很多矛盾日益凸顯，引起了研究者對(duì)學(xué)生事務(wù)管理問題的廣泛關(guān)注。 “以學(xué)生為本”和“依法治�！笔屈h中央、國務(wù)院提出的學(xué)生事務(wù)管理理念，這種理念要求將學(xué)生事務(wù)管理工作必須以學(xué)生為中心，依法治校，通過高校靈活的工作方式和多樣化、現(xiàn)代化的教育手段，將發(fā)揮學(xué)生的主體作用與高校自身的教育、管理、服務(wù)職能有機(jī)結(jié)合，從而促進(jìn)學(xué)生的全面發(fā)展。為了實(shí)現(xiàn)這一目標(biāo)，不但需要學(xué)生事務(wù)管理者轉(zhuǎn)變思想，改變自身的角色定位，同時(shí)在制度上，需要建立一個(gè)簡單、高效、法治化的管理模式，，從根本上消除制約我國學(xué)生事務(wù)管理發(fā)展的各種障礙。 本文共包含六個(gè)部分，第一部分為引言，是對(duì)研究背景、現(xiàn)狀、意義、技術(shù)路線、創(chuàng)新點(diǎn)的說明；第二部分對(duì)“依法治校”和學(xué)生事務(wù)管理的概念進(jìn)行了界定，對(duì)兩者的關(guān)系進(jìn)行分析，為研究提供理論基礎(chǔ)；第三部分是對(duì)我國學(xué)生事務(wù)管理現(xiàn)狀的分析，找出存在的問題；第四部分是美國學(xué)生事務(wù)管理法治化保障的分析，并與我國學(xué)生事務(wù)管理進(jìn)行對(duì)比；第五部分是對(duì)建立新型學(xué)生事務(wù)管理模式的探索性研究；第六部分為研究結(jié)論與建議。本文的創(chuàng)新點(diǎn)在于從法治化角度對(duì)學(xué)生事務(wù)管理模式的分析，找出我國學(xué)生事務(wù)管理存在的問題，分析問題，提出對(duì)策，建立新型的學(xué)生事務(wù)管理模式。
[Abstract]:As one of the central links of higher education management, the core of student affairs management is to provide students with a good learning and living environment, to provide services for the all-round development of students, and at the same time to maintain a normal campus order. So that the teaching activities can be carried out smoothly. The outstanding characteristics of modern student affairs management system are scientization, specialization and legalization. The management of student affairs should be carried out under the protection and guidance of legal norms, and the contradictions and problems in student affairs management should be solved by legal means, which can not only improve the level and efficiency of student affairs management in our country. At the same time, it is also in line with the principle of "administering the school according to law" in our country. The establishment of a perfect legal guarantee system can enable school behavior to be supported by law, as well as students to obtain national legal protection, obtain judicial relief, safeguard their own rights and improve students' civic awareness. The reform of colleges and universities in our country is advancing steadily, and the management of student affairs is undergoing a great change. In the process of reform, many contradictions have become increasingly prominent, which has aroused widespread concern of researchers on the management of student affairs. "Student-oriented" and "running the school according to law" are the concepts of student affairs management put forward by the CPC Central Committee and the State Council. This concept requires that the management of student affairs must be student-centered and run the school according to law. Through the flexible working methods and diversified and modern educational means of colleges and universities, the main role of students will be combined with the education, management and service functions of colleges and universities, so as to promote the all-round development of students. In order to achieve this goal, it is not only necessary for student affairs managers to change their thinking and role orientation, but also to establish a simple, efficient and legalized management model in the system. Fundamentally eliminate all kinds of obstacles that restrict the development of student affairs management in our country. This paper consists of six parts, the first part is the introduction, which is an explanation of the research background, present situation, significance, technical route and innovation. The second part defines the concepts of "running schools according to law" and student affairs management, analyzes the relationship between them, and provides a theoretical basis for the research. The third part is the analysis of the present situation of student affairs management in our country, and finds out the existing problems. The fourth part is the analysis of the legal guarantee of student affairs management in the United States, and compared with the student affairs management in our country; the fifth part is the exploratory research on the establishment of a new student affairs management model; the sixth part is the research conclusions and suggestions. The innovation of this paper lies in the analysis of the management mode of student affairs from the perspective of rule of law, finds out the problems existing in the management of student affairs in our country, analyzes the problems, puts forward some countermeasures, and establishes a new type of management mode of student affairs.
