【摘要】：我國(guó)高校自主招生自2001年正式開(kāi)始試行，至今已有十余年之久。自主招生是選拔優(yōu)秀創(chuàng)新人才的新探索，也是擴(kuò)大高校招生自主權(quán)，深化高校招生錄取制度改革的重要舉措。然而，近幾年在試行和推廣中卻出現(xiàn)了諸多問(wèn)題，，究其原因主要是由于自主招生程序的問(wèn)題而產(chǎn)生的。因此，本研究主要針對(duì)我國(guó)公立高校自主招生從2001年到2011年十年間的自主招生程序問(wèn)題進(jìn)行研究。首先，通過(guò)收集分析已有的相關(guān)官方文本和高校有關(guān)規(guī)定對(duì)自主招生問(wèn)題的研究現(xiàn)狀進(jìn)行了歸納，研究中對(duì)高校自主招生程序的相關(guān)概念及理論等進(jìn)行了初步的綜述，以其為本研究奠定一個(gè)良好的基礎(chǔ)。其次，從法律層面和實(shí)踐層面對(duì)其進(jìn)行分析。在法律規(guī)范中，我國(guó)現(xiàn)有立法對(duì)公立高校自主招生程序的規(guī)定較少。實(shí)踐方面，自主招生屢遭質(zhì)疑的案例頻見(jiàn)報(bào)端，招生程序存在不規(guī)范的問(wèn)題。本文試圖在已有研究成果的基礎(chǔ)上，進(jìn)一步豐富我國(guó)公立高校自主招生相關(guān)理論的研究范圍，拓寬我國(guó)公立高校自主招生研究的視野，為我國(guó)公立高校自主招生的法律程序研究提供一個(gè)嶄新的思路。 本文主要采用的研究方法有案例研究法、文獻(xiàn)檢索法、問(wèn)卷法和訪談?wù){(diào)查法。本文共分為7部分： 第一部分，引言。本文主要闡明的是選題的原因和目的、研究?jī)?nèi)容和研究意義，并指出了本文的研究思路和研究方法。 第二部分，相關(guān)概念的研究。首先，探討了自主招生、自主招生程序等相關(guān)概念。其次，明晰了高校自主招生程序的內(nèi)涵和外延。 第三部分，自主招生相關(guān)理論研究，論述了程序正義理論、教育公平理論和權(quán)利制約理論是構(gòu)建我國(guó)公立高校自主招生程序的理論基礎(chǔ)。 第四部分，我國(guó)公立高校自主招生程序的現(xiàn)狀及問(wèn)題分析。首先，闡述了我國(guó)公立高校自主招生程序的相關(guān)法律規(guī)定和實(shí)施現(xiàn)狀。其次，剖析了我國(guó)公立高校自主招生法律層面和實(shí)踐層面存在的問(wèn)題。 第五部分，我國(guó)公立高校自主招生程序存在問(wèn)題的原因分析。主要結(jié)合案例和自主招生相關(guān)的材料分析，得出自主招生程序出現(xiàn)問(wèn)題的主要原因歸結(jié)于法律層面、經(jīng)濟(jì)層面、制度層面和文化層面四個(gè)方面。 第六部分，我國(guó)公立高校自主招生程序的構(gòu)建。首先，提出了我國(guó)公立高校自主招生程序的立法建議；其次，論述了我國(guó)公立高校自主招生程序的初步設(shè)想。 最后一部分是“結(jié)束語(yǔ)”，對(duì)全文的主要問(wèn)題和基本觀點(diǎn)進(jìn)行概括和總結(jié)，并指出有待于進(jìn)一步的研究。
[Abstract]:It has been more than ten years since 2001. Independent enrollment is a new exploration to select excellent and innovative talents and an important measure to expand the autonomy of enrollment and deepen the reform of enrollment system in colleges and universities. However, in recent years, there have been many problems in the trial and promotion, mainly due to the problem of independent enrollment procedures. Therefore, this study mainly focuses on the independent enrollment process of public universities from 2001 to 2011. First of all, through the collection and analysis of the existing relevant official texts and the relevant regulations of colleges and universities, this paper summarizes the current situation of the research on autonomous enrollment, and summarizes the related concepts and theories of the autonomous enrollment procedure in universities. Based on this study, a good foundation was established. Secondly, it is analyzed from the legal level and the practical level. In the legal norm, the existing legislation of our country has less stipulation on the independent enrollment procedure of public colleges and universities. In practice, the cases of independent enrollment are frequently questioned, and the enrollment procedure is not standardized. On the basis of the existing research results, this paper attempts to further enrich the scope of research on the related theories of autonomous enrollment of public colleges and universities in China, and broaden the horizons of the research on autonomous enrollment of public universities in our country. It provides a new idea for the study of the legal procedure of independent enrollment in public colleges and universities in our country. The main research methods used in this paper are case study, literature retrieval, questionnaire and interview. This article is divided into seven parts: the first part, introduction. This paper mainly expounds the reason and purpose, the content and significance of the research, and points out the research ideas and methods of this paper. The second part, the research of related concepts. First of all, this paper discusses the related concepts of independent enrollment and independent enrollment procedures. Secondly, it clarifies the connotation and extension of the independent enrollment procedure in colleges and universities. In the third part, the author discusses the theory of procedural justice, the theory of educational fairness and the theory of right restriction, which are the theoretical basis of constructing the independent enrollment procedure of public colleges and universities in our country. The fourth part, the present situation and the question analysis of our country public university independent enrollment procedure. First of all, this paper expounds the relevant legal provisions and implementation status of the independent enrollment procedure of public universities in our country. Secondly, it analyzes the problems existing in the legal and practical aspects of independent enrollment in public colleges and universities in China. The fifth part analyzes the causes of the problems in the independent enrollment procedure of public colleges and universities in China. Based on the analysis of cases and related materials, this paper concludes that the main reasons for the problems in the process of autonomous enrollment are legal, economic, institutional and cultural aspects. The sixth part, the construction of the independent enrollment procedure of public colleges and universities in our country. First of all, it puts forward the legislative suggestions of the independent enrollment procedure of public universities in our country; secondly, it discusses the tentative ideas of the autonomous enrollment procedure of public universities in China. The last part is the conclusion, which summarizes the main problems and basic viewpoints, and points out that further research is needed.
