我國(guó)高校領(lǐng)導(dǎo)問(wèn)責(zé)制研究

【摘要】:黨委領(lǐng)導(dǎo)下的校長(zhǎng)負(fù)責(zé)制是一個(gè)比較理想的領(lǐng)導(dǎo)體制,但是在實(shí)施過(guò)程中由于領(lǐng)導(dǎo)的職責(zé)范圍劃分不清,權(quán)力與責(zé)任容易失衡,,最終導(dǎo)致教育腐敗。高校領(lǐng)導(dǎo)問(wèn)責(zé)制有利于提高高校領(lǐng)導(dǎo)者的責(zé)任感,有助于增強(qiáng)公眾的監(jiān)督意識(shí)。盡管高校領(lǐng)導(dǎo)問(wèn)責(zé)制在研究和推行的過(guò)程中取得了一定的成果,然而對(duì)于具體教育領(lǐng)域內(nèi)高校領(lǐng)導(dǎo)問(wèn)責(zé)還沒(méi)有成文的規(guī)定,導(dǎo)致高校領(lǐng)導(dǎo)問(wèn)責(zé)制成為一紙空文。本研究試圖通過(guò)對(duì)我國(guó)高校領(lǐng)導(dǎo)問(wèn)責(zé)制的必要性和現(xiàn)實(shí)困境分析,從領(lǐng)導(dǎo)問(wèn)責(zé)主體、問(wèn)責(zé)對(duì)象、問(wèn)責(zé)行為、問(wèn)責(zé)范圍、問(wèn)責(zé)后果、問(wèn)責(zé)機(jī)構(gòu)、問(wèn)責(zé)程序、問(wèn)責(zé)救濟(jì)八個(gè)邏輯范疇構(gòu)建出我國(guó)高校領(lǐng)導(dǎo)問(wèn)責(zé)制法律體系。本文主要由四部分構(gòu)成: 第一章,引言。主要介紹了問(wèn)題提出的背景、研究目的、研究意義、研究?jī)?nèi)容、文獻(xiàn)綜述和研究方法。 第二章,高校領(lǐng)導(dǎo)問(wèn)責(zé)制的相關(guān)理論概述。一是基本概念的界定,主要包括問(wèn)責(zé)制、高校問(wèn)責(zé)制和高校領(lǐng)導(dǎo)問(wèn)責(zé)制;二是相關(guān)理論綜述,包括人民主權(quán)理論、權(quán)責(zé)統(tǒng)一理論和程序法治理論。 第三章,實(shí)施我國(guó)高校領(lǐng)導(dǎo)問(wèn)責(zé)制的必要性及現(xiàn)實(shí)困境分析。首先提出建立高校領(lǐng)導(dǎo)問(wèn)責(zé)制度的必要性:高校領(lǐng)導(dǎo)問(wèn)責(zé)制現(xiàn)實(shí)性需求、依法治教的迫切需要、提高高等教育管理效益的內(nèi)在要求、改善中國(guó)高校領(lǐng)導(dǎo)政治生態(tài)的重要內(nèi)容、借鑒國(guó)外高校問(wèn)責(zé)的成功經(jīng)驗(yàn)的必要性;其次從我國(guó)高校領(lǐng)導(dǎo)問(wèn)責(zé)發(fā)展現(xiàn)狀和問(wèn)題兩個(gè)方面總結(jié)分析我國(guó)高校領(lǐng)導(dǎo)問(wèn)責(zé)制的現(xiàn)實(shí)困境。高校領(lǐng)導(dǎo)問(wèn)責(zé)制在我國(guó)所賴以形成的土壤還不成熟,思考我國(guó)現(xiàn)階段的實(shí)際情況,說(shuō)明在“黨委領(lǐng)導(dǎo)下的校長(zhǎng)負(fù)責(zé)制”的模式中,并不存在著真正的高校領(lǐng)導(dǎo)問(wèn)責(zé)機(jī)制,從而表明構(gòu)建高校領(lǐng)導(dǎo)問(wèn)責(zé)制的必要性和緊迫性。 第四章,完善我國(guó)高校領(lǐng)導(dǎo)問(wèn)責(zé)制的對(duì)策。提出實(shí)施高校領(lǐng)導(dǎo)問(wèn)責(zé)制所應(yīng)堅(jiān)持的基本原則;通過(guò)國(guó)外經(jīng)驗(yàn)的借鑒和相關(guān)文獻(xiàn)的分析與思考、結(jié)合我國(guó)的具體國(guó)情,提出改進(jìn)建議,從領(lǐng)導(dǎo)問(wèn)責(zé)主體、問(wèn)責(zé)對(duì)象、問(wèn)責(zé)行為、問(wèn)責(zé)范圍、問(wèn)責(zé)后果、問(wèn)責(zé)機(jī)構(gòu)、問(wèn)責(zé)程序、問(wèn)責(zé)救濟(jì)構(gòu)建出適合我國(guó)國(guó)情的高校領(lǐng)導(dǎo)問(wèn)責(zé)制法律體系,探索與高校領(lǐng)導(dǎo)問(wèn)責(zé)制相配套的理念以及法律制度實(shí)施保障。
[Abstract]:The principal responsibility system under the leadership of the Party committee is an ideal leadership system, but in the process of implementation, due to the unclear division of the responsibilities of the leaders, power and responsibility are easily out of balance, leading to education corruption. The accountability system of university leaders is helpful to enhance the sense of responsibility of university leaders and enhance the public's consciousness of supervision. Although some achievements have been made in the research and implementation of the leadership accountability system in colleges and universities, there is no written provision for the accountability of university leaders in the specific field of education, which leads to the accountability system of university leaders becoming a dead letter. This study attempts to analyze the necessity and realistic predicament of the leadership accountability system in colleges and universities in China, from the leadership accountability subject, the accountability object, the accountability behavior, the accountability scope, the accountability consequence, the accountability institution, the accountability procedure. The eight logical categories of accountability remedy construct the legal system of leadership accountability system in colleges and universities in China. This paper consists of four parts: Chapter one, introduction. This paper mainly introduces the background, purpose, significance, content, literature review and research methods of the problem. The second chapter is an overview of the relevant theories of leadership accountability in colleges and universities. One is the definition of basic concepts, including the accountability system, the university accountability system and the leadership accountability system, and the other is the summary of relevant theories, including the theory of people's sovereignty, the unified theory of power and responsibility and the theory of rule of law by procedure. The third chapter analyzes the necessity and realistic predicament of implementing the leadership accountability system in colleges and universities in China. First of all, the paper puts forward the necessity of establishing the system of leadership accountability system in colleges and universities: the realistic demand of leadership accountability system in colleges and universities, the urgent need of administering education according to law, the internal requirements of improving the efficiency of higher education management, and the important content of improving the political ecology of Chinese university leaders. It is necessary to draw lessons from the successful experiences of foreign universities and colleges, and then summarize and analyze the realistic predicament of the leadership accountability system in our country from two aspects: the present situation and the problems of the development of leadership accountability in our country's colleges and universities. The soil on which the accountability system of university leaders is formed in our country is still immature. Considering the actual situation of our country at the present stage, we can see that there is no real mechanism of leadership accountability in the mode of "President responsibility system under the leadership of Party Committee". Therefore, it shows the necessity and urgency of constructing leadership accountability system in colleges and universities. The fourth chapter, consummates our country university leadership accountability system countermeasure. This paper puts forward the basic principles to be adhered to in the implementation of the leadership accountability system in colleges and universities, through the analysis and reflection of foreign experiences and relevant literature, and combining with the specific conditions of our country, puts forward some suggestions for improvement, including leadership accountability subject, accountability object, accountability behavior, and so on. The scope of accountability, the consequences of accountability, accountability institutions, accountability procedures, accountability relief to build a suitable legal system for our country's leadership accountability system, explore the concept of matching with the university leadership accountability system and the implementation of the legal system protection.
